“My McD’s® App World Taste Tour Contest” (the “Contest”) Official Contest Rules (the “Official Rules”)

  1. OVERVIEW: McDonald’s Restaurants of Canada Limited (“Sponsor”) is offering a Contest through its My McD’s® App (the “App”). The App provides customers with various weekly food discount or other food-related offers, nutrition information, and benefits, all available through the App. The food discounts and other food-related offers may vary in content and number in different regions of Canada. In these Official Rules the food discounts and other food-related offers, are referred to individually as an “Offer” and collectively as “Offers.” The App offers customers the ability to place orders, redeem Offers and pay for those Offers or orders via a valid credit or debit card (a “payment card”) which the customer enters in his/her App settings during registration of his/her App in order to easily pick-up (and pay for) his/her food at a participating McDonald’s® restaurant in Canada via “Mobile Ordering”. Note: a person under the age of majority should only use Mobile payment with the permission of a parent/legal guardian. If a person wishes to participate in this Contest but does not wish to redeem an Offer or make a purchase via Mobile Ordering, he/she can follow the instructions found in Rule 5.D. to receive an entry without making a purchase from McDonald’s. Participants agree to comply in full with all of the provisions of these Official Rules. A Participant who wishes to download, register and activate the App to receive Offers and participate in the Contest will need a “Digital Device” and a valid email address . The Participant then must download the App from the App Store or get it from Google Play and install and activate the App on his/her Digital Device. The App is free but is available only in the Apple App Store or from Google Play (for iOS/Android). See Rule 9 for system requirements.

All envelopes containing mail-in entries must be received no later than July 29, 2018. If a mail-in entry is received after July 29, 2018, no Entry will be recorded on behalf of the person who submitted that envelope. One (1) Entry will be recorded on behalf of a Participant for each mail-in entry he/she submits which is in full compliance with the requirements set out in this Rule 5D. There is no limit to the number of mail-in entries which a Participant submits in compliance with those requirements.

    5. Limits: There is a limit of one (1) Offer redemption per transaction.

  6. Contest Draw/Winner Notification: On or about August 13, 2018, the Sponsor will select one (1) potential winning Entry at random as follows: one potential winning Entry and ten (10) backup potential winning Entries (each a “Backup Entry”) will be drawn at random from among all eligible Entries recorded during the Contest Period. Subject to the provisions of these Official Rules, the Participant whose Entry is selected first as a potential winning Entry will be the potential Prize winner, and that potential Prize winner will be notified to that effect by the Redemption Centre by email as follows: the potential winning notification will be sent via email within two business days following the date of the draw, to the email address associated with the potential Prize winner’s registration or, in the case of a mail-in Entry, to the email address provided in the mail-in Entry. The potential Prize winner will be required to contact the Redemption Centre, in accordance with the information provided in the email, and to do so by the date stated in that email. If that contact occurs, the Redemption Centre will supply the potential Prize winner with certain Prize claim documents (the “Prize Claim Documents”), together with instructions to complete and submit the Prize Claim Documents to the Redemption Centre, and stating the deadline by which those completed Prize Claim Documents must be received by the Redemption Centre. The Prize Claim Documents will comprise a) a declaration and release (a “Declaration and Release”). The Declaration and Release contains among other things a release of liability, a publicity release and the Skill-Testing Question (the “Skill-Testing Question”) which must be correctly answered by the potential Prize winner without any assistance, whether electronic, mechanical or other. The Declaration and Release must be completed and submitted to the Redemption Centre by the potential Prize winner, and b) guest releases, each of which includes a liability and publicity release and which must be completed by up to three guests proposed by the potential Prize winner and returned to the Redemption Centre along with the Declaration and Release.

If the Redemption Centre finds that the Prize Claim Documents are properly submitted and completed (and that the Skill-Testing Question is correctly answered), then that potential Prize winner will be declared the winner of the Prize and the Redemption Centre will contact the winner in approximately two (2) to four (4) weeks to arrange for fulfillment of the Prize.

If the potential Prize winner fails to contact the Redemption Centre as referred to above or fails to complete properly and return the Prize Claim Documents by the deadline, or if his/her answer to the Skill-Testing Question is not correct or no answer to the Skill-Testing Question is provided, then that potential Prize winner will be disqualified from the Contest and will not receive the applicable Prize. In such a case, the Participant on whose behalf the first Backup Entry drawn was recorded will be notified by the Redemption Centre and the process described above for the Prize will apply to that Participant. The Sponsor will continue that process until a Participant is declared to be the winner of the Prize, or until no Backup Entries remain in which case the Prize will be forfeited and will not be awarded in the Contest. If, for any reason, a Participant whose Entry is drawn is not declared the winner of the Prize, then that potential Prize winner will not have any claim against the Sponsor, the Contest Entities, or against any other person, firm or corporation in respect of the Prize, the Contest, or any matter related to the Contest.

  7. PRIZE/ENTRY CONDITIONS/RESTRICTIONS. Prize and Odds of Winning: One (1) Prize is available to be won in the Contest. The approximate retail value (the “ARV”) of the entire Prize is $25,000 CDN. The Prize winner will receive a trip for himself/herself and up to three (3) guests to the Prize winner’s choice of China, Italy or Australia. The Prize includes round trip economy class air travel for the Prize winner and guests, from a major commercial airport nearest winner’s home in Canada (as determined solely by Sponsor), ground transportation between the destination airport and hotel, six (6) nights hotel accommodations (one quad-occupancy or two standard-double-occupancy rooms) in a hotel designated by Sponsor in its sole discretion, and $1,200 for meals and miscellaneous expenses. If the actual cost of the Prize is less than the stated ARV in these Official Rules, any difference will not be awarded.

The odds of winning the Prize will depend on the number of Entries recorded on behalf of Entrants during the Contest Period.

Prize Conditions: Any matters concerning the trip portion of the Prize or which otherwise are related to the Prize which arise after the awarding of the Prize but which are not contemplated by these Official Rules will be determined by Sponsor in its sole discretion. Any difference between the ARV of the Prize and its actual value will not be awarded and any difference will not be refunded. There is no substitution or cash equivalent for the Prize, except that Sponsor in its sole discretion can substitute for the Prize, a prize of equal or greater value if, for any reason, the Prize is not available. All federal/provincial taxes (including, without limitation, federal, provincial and/or local income taxes) on or connected with the Prize, and the reporting consequences thereof, are solely the responsibility of the Prize winner. If required by law, Sponsor reserves the right to withhold and remit to the appropriate taxing authorities the amount of any taxes due. Expenses not specifically stated as included in the Prize are the sole responsibility of the Prize winner.

If Sponsor so elects, the potential Prize winner may be required to submit to, and cooperate in, a confidential background check to confirm eligibility and security requirements, as determined by Sponsor in its sole discretion, to help ensure that the use of any such person in advertising or publicity for the Contest will not bring Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Contest or Sponsor as determined by Sponsor in its sole discretion. Sponsor reserves the right to refrain from conducting any advertising or publicity associated with a winner for any reason. Travel must be completed by February 28, 2019. If any activity relating to the Prize is cancelled or postponed for any reason, the balance of the Prize will be awarded in full satisfaction of the Prize awarded. Travel and other arrangements will be determined solely by Sponsor. All guests of the Prize winner must be legal age of majority in their Province/territory of residence. If the Prize winner has not reached the age of majority in his/her Province/territory of residence, one of Prize winner’s guests must be the Prize winner’s parent/legal guardian; and if one of the Prize winner’s guests has not reached the age of majority in his/her Province/territory of residence, that guest must be the Prize winner’s child or legal ward. Air travel will be round trip (originate from and end at the same airport) economy class from and to an airport selected by Sponsor. Reservations must be made and tickets issued prior to travel. Tickets and certificates are non-refundable and non-transferable and are not redeemable for cash. Changes to reservations are not permitted. The Prize winner and guest(s) must travel together on the same itinerary and are solely responsible for obtaining, at their sole cost, and possessing any required travel-related documents (including a valid passport and any required visa(s) and if and as applicable properly competed parental consent documents) prior to departure as well as fulfilling any/all travel and security requirements. Sponsor reserves the right in its sole discretion to designate all flight/travel particulars and route or routes (as the case may be). Flight schedules are subject to change without notice. No insurance is provided as part of the Prize, and obtaining any insurance (including, but not limited to, travel insurance including coverage of travel delay, health, accident and medical insurance, and property loss or damage insurance) is the sole responsibility of the Prize winner and, as applicable, of the Prize winner’s guests. Sponsor is not and shall not be liable for any missed opportunities or expenses incurred as a consequence of flight cancellation/delay or ground transportation delay. If a winner (and/or the winner’s guest[s]) is not able to participate in any portion of the Prize, that unused portion will not be substituted for cash or by way of any other prize. The Prize winner may be required to provide a current valid major payment card at time of hotel check-in to cover incidentals, and any and all costs, fees, and expenses not expressly stated to be included in the Prize description. The Prize winner and guest(s) agree to maintain their respective behavior in accordance with all applicable laws and generally accepted social practices in connection with participation in any Prize-related activity. The Prize Winner (or his/her parent/legal guardian if winner is a Minor) understands and agrees that Sponsor, in its sole discretion, has the right to disqualify and remove the Prize winner and/or any guest or guests from any event at any time if that winner or guest’s/guests’ behavior at any point is/are uncooperative, disruptive, or may or do cause damage to person, property, or to the reputation of Sponsor, or otherwise violates the policies of the Sponsor. The Prize winner is solely responsible for ensuring the proper behavior of each of his/her guests.

In the event of a dispute concerning the identity of a Participant, the Participant will be the registered account holder of the email address associated with the disputed Entry, but only if that person meets all other eligibility criteria. Otherwise, the Entry may be disqualified and any Prize potentially won will be forfeited in Sponsor’s sole discretion. A registered account holder is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the applicable email address.
