重要:請仔細閱讀並瞭解這些條款和條件(「條款」)。其中包含麥當勞責任的限制,以及其他會影響您的權益的規定。

安裝、存取或使用任何網站、行動apps(應用程式)、電郵新聞信及訂閱,以及其他有張貼或提到這些條款的其他數位功能(合稱「線上服務」),您就與麥當勞授權發展商和德昌股份有限公司(「麥當勞」或「我們」)成立了具有拘束力的合約,由位於台北市中正區林森南路一號3樓之總部負責控制及運作。

您也應該審視我們的隱私權聲明,該聲明說明我們是如何蒐集、使用及共享資料。

若您尚未年滿十八歲,您就必須和您的父母或監護人一起審視這些條款。您的父母或監護人必須瞭解並同意這些條款,您才可以使用線上服務。

如果您或您的父母或監護人不同意這些條款,那您就必須立即停止使用線上服務,並要求麥當勞關閉您所設立的任何線上服務帳號。有關關閉或刪除帳號,請參考「1.有關線上服務>如何聯繫我們」的條文,並提供所欲刪除帳號之電子郵件資訊。

 

1.   有關線上服務。

 

您應對於您的裝置和帳號負責。您應自行負責使用線上服務所需之任何裝置、軟體及服務。麥當勞並不保證線上服務在任何特定的裝置上或與任何特定的軟體一同使用會具有完全的功能。您亦應自行負責使用線上服務時的任何傳訊及數據傳輸費用、收費與稅金,其中包括我們用您選擇的簡訊、電子郵件或其他方式和您進行的通訊。您只能使用您所擁有或控制的裝置使用線上服務,您也只能使用經過授權的作業系統(例如,蘋果裝置使用蘋果iPhone OS)使用線上服務。如果您設立一個線上服務帳號,您應自行負責保持該帳號以及利用該帳號進行所有活動的安全性,並必須時時保持帳號資料的正確。

麥當勞更新或終止線上服務的權利。您瞭解並同意,(不論有無通知)麥當勞得隨時更新、修改或終止線上服務(或您對線上服務的存取利用),其中包括對您裝置上安裝之任何麥當勞行動app應用程式的推播更新(或將功能移除或將使用應用程式的存取移除)。

條款更新。麥當勞亦得隨時自行決定更新條款。如果麥當勞對條款做重大的變更,我們會以任何合理的方式通知您,例如在線上服務上張貼新的條款。如果您不同意變更後的條款,您就必須立即停止使用線上服務,並要求麥當勞關閉您所設立的任何線上服務帳號。有關關閉或刪除帳號,請參考「1.有關線上服務>如何聯繫我們」的條文,並提供所欲刪除帳號之電子郵件資訊。

2.   麥當勞隱私權保護聲明以及與您的通訊。

 

麥當勞隱私權保護聲明。麥當勞隱私權保護聲明 (https://www.mcdonalds.com/tw/zh-tw/privacy-policy.html) 說明我們處理資料的做法,其中包括我們如何蒐集、使用及分享資料。

我們如何和您進行通訊。透過線上服務,您可以選擇同意接收電子郵件、用您提供給我們的行動電話號碼接收簡訊、或接收來自於我們的推播通知。如果您選擇同意這些通訊方式,您瞭解並同意您會收到來自於麥當勞的行銷、交易及其他的訊息。

麥當勞得依隱私權保護聲明,使用您提供給我們的資訊和您進行通訊。

選擇退出通訊的通則。您可以選擇我們和您進行通訊的方式。您通常可以在使用的線上服務個人資料欄位找到通訊偏好以及如何選擇退出的說明。您也可以利用您裝置的設定功能,變更您的通訊偏好。此外,我們的通訊方式本身也有選擇退出的功能。您瞭解並同意,您可能需要針對不同的通訊方法,個別管理您的通訊偏好。例如,如果您選擇退出接收行銷電郵,您可能仍因選擇同意接收簡訊而仍會收到行銷簡訊。在我們竭盡所能提供便利的方法讓您管理您通訊偏好的同時,您仍然需要為各種線上服務調整您的通訊偏好。請注意,對於某些與帳號相關以及交易相關的通訊而言,停止接收這些通訊的唯一辦法,可能就是關閉您的線上服務帳號。

 

3.   麥當勞會員計畫

 

參加資格與登錄

麥當勞會員計畫為我們感謝顧客的一種回饋方式。若要取得麥當勞會員計畫的回饋以及優惠兌換服務,您必須註冊為麥當勞APP會員(以下簡稱麥當勞會員或會員)以及同意本條款。

如何加入麥當勞會員

您可透過App Store或Google Play下載麥當勞APP (名稱: McDonald’s)申請會員帳號,當您完成註冊後即成為會員,註冊過程您需要於申請頁面提供以下資訊:電子郵件(email)、行動電話、姓名、性別、生日與帳號密碼等。

每一個電子郵件僅限申請一個APP會員帳號。您帳號內的姓名、電子郵件或任何其他的資料如有變更,您可至APP 「我的帳號(My Account)」 內編輯更新。如未即時更新資料或更新錯誤 (例:更新電子郵件輸入錯誤)而致權益損失,我們恕不負責。

若您要刪除帳號,請選擇APP個人資料欄位中的「刪除帳號 (Delete Account)」,即可隨時將您的帳號刪除。確認刪除後,帳號內所對應之M Point、回饋券、優惠券等亦即隨之刪除,將無法退還也無法再參與相對應之兌換,相關交易紀錄及您相關的個人資料亦將一併刪除。因此,我們建議您審慎規劃所有的刪除事宜,以免損失累積的回饋以及優惠。帳號一旦刪除,即無法再加以回復。若欲再享有會員權益及本應用程式相關功能,需重新透過本應用程式註冊帳號,該帳號則為全新帳號。

麥當勞會員權益-

優惠券

您將會透過麥當勞APP接收到優惠券的相關內容。優惠券的適用條款如下:

(1). 優惠券僅限特定的線上服務提供者,應於到期日前兌換,並且僅適用於所顯示的產品,且僅限於指定參與的餐廳使用,並須視供應情況而定;

(2). 優惠券須視供餐時段而定(例如,非早餐餐點之優惠券,在供應早餐時段恕不提供);

(3). 除非另有使用條款,每張優惠券僅限兌換一次,並在兌換後失效;

(4). 除非另有使用條款,每次限兌換一份優惠券指定餐點,恕不得更換品項或加價升級。

(5). 優惠券不得轉讓、不得兌換現金或其他替代品、不得分割、出售或轉售。僅限於在我們所運營的麥當勞餐廳使用。

(6). 優惠券僅可在店內櫃台、自助點餐機或得來速通過掃描優惠QR code或以優惠代碼進行使用。

(7). 此外,亦可能有其他適用於該優惠券的特定條款及適用條件,將會另外告知與說明。

(8). 只有麥當勞APP提供之優惠券為有效並可兌換優惠內容,優惠商品限麥當勞APP持有人兌換使用且不得銷售,麥當勞對於以其他方式取得的任何優惠券之真實性一概不作出擔保。

(9). 麥當勞有從系統中刪除所有尚未使用的優惠券之權。

(10). 不完整或以機械複製、偽造、第三方軟體產生或其他自動化或機械式使用麥當勞APP或接收的優惠券,無論全部或部分,將不被接受。

(11). 若您刪除麥當勞APP會員帳號,會員帳號內之未使用優惠券將同步清空歸零,無法換算為現金或其他商品進行退還,亦無法補發。

(12). 部分餐廳不適用,請以官網公告為主。

如何使用優惠券。

您可以通過以下方式使用優惠券:

(1). 在餐廳櫃台掃描優惠券QR code或以優惠代碼進行使用

(2). 通過自助點餐機掃描優惠券QR code或以優惠代碼進行使用

(3). 在得來速向接受您訂單的工作人員讀出有效的優惠代碼進行使用

M Point

如您出示麥當勞APP會員帳號至全台任一麥當勞餐廳消費,或以麥當勞APP帳號密碼登入歡樂送,單筆消費金額每NT$1元可獲贈1個M Point(NT$20元可獲贈20個 M Point…以此類推)。消費獲贈之M Point會在當筆消費時間24小時內由系統派送至會員帳號中(網路斷線等特殊因素除外)並可在麥當勞APP中的會員紀錄查詢。所有資料均以麥當勞系統最終紀錄為準。

您可以通過以下方式獲得M Point(如果您在購買時沒有依照以下程序,您就無法獲得M Point,之後也無法再主張您應獲得M Point):

(1). 在餐廳櫃台或自助點餐機上掃描您的會員QR code或以會員代碼進行使用

(2). 在得來速掃向接受您訂單的工作人員讀出有效的會員代碼

(3). 使用麥當勞APP帳號密碼登入歡樂送線上訂餐服務

(4). 部分餐廳不適用,請以官網公告為主。

如果您在購買時未依循此流程,則不會獲得M Point或有任何M Point的補償措施。

M Point有效期限為獲得後的次年該月底前有效(例如:於2023年10月26日獲得20 個M Point,則該20 個M Point有效期限為2024年10月31日止,以此類推),M Point過期後即失效,恕無法展延,因此請注意於M Point到期前完成回饋券之兌換。

麥當勞將不定期舉辦額外M Point獎勵活動。有關任何獎勵活動或促銷活動的更多訊息將在該活動或促銷活動的相關條款中提供。

每個帳號的上限為50,000 個M Point。一旦您達到最高M Point額度後,後續的交易將無法再獲取M Point。麥當勞有權更改M Point相關限制與條款,並可在事先通知或未事先通知的情況下進行更改。

M Point兌換回饋券

您透過麥當勞APP會員之消費或參與活動後所累積的M Point,將可用以兌換回饋券,即在麥當勞APP內使用M Point不定期兌換指定回饋產品,適用條款如下:

(1). 使用M Point兌換回饋券只限APP所顯示的回饋產品;回饋券凡經兌換完成將無法再返還為M Point,逾期之 M Point 將不得用以兌換回饋券。

(2). 回饋券應於其到期日前使用,逾期失效,且僅限於指定參與的餐廳中使用,並須視供應狀況而定。

(3). 回饋券須視供餐時段而定(例如,非早餐餐點之回饋產品,在供應早餐時段恕不提供)

(4). 每張回饋券僅限使用一次,並於使用完成後失效

(5). 每次限使用一份回饋券所示的餐點,恕不得更換品項或加價升級。

(6). 回饋產品的兌換餐點受供應數量限制,請依使用說明至麥當勞餐廳兌換。如任何餐廳,無論任何原因,無法提供回饋券所示的餐點(或餐點的任何部分),則該餐廳有權以相等或更高售價的一個或多個產品替換之。

(7). 回饋券不得轉讓、不得兌換現金或其他替代品、不得分割、出售或轉售。僅限於在我們所運營的麥當勞餐廳使用。

(8). 回饋券只能在餐廳的點餐櫃檯、自助點餐機或得來速使用,歡樂送恕不適用。此外,回饋券可能適用特定活動條款,特定條款請詳見相關活動說明。只有麥當勞APP提供之回饋券為有效並可兌換回饋內容,回饋券限麥當勞APP持有人兌換使用且不供銷售,麥當勞對以其他方式取得的任何回饋券之真實性一概不作出擔保。

(9). 麥當勞將保留從系統中刪除所有尚未使用回饋券的權利。

(10). 不完整或以機械複製、偽造、第三方軟體產生或其他自動化或機械式使用麥當勞APP或接收的回饋券,無論全部或部分,將不被接受。

(11). 若您刪除麥當勞APP會員帳號,會員帳號內累積之未使用回饋券及M Point將同步清空歸零,無法換算為現金或其他商品進行退還,亦無法補發。

(12). 回饋券之使用方式與優惠券相同,即在店內櫃台、自助點餐機或得來速通過掃描QR code或以代碼進行使用。

(13). 部分餐廳不適用,請以官網公告為主。

退貨與刪除會員

(1). 任何時候因任何原因將一筆消費退貨,並退還全額或部分新台幣,我們將有權扣除該退貨相應之M Point。消費換貨亦同,但若換貨後的產品價值相同或更高者除外。

(2). 若您決定刪除麥當勞APP會員帳號不再使用,會員帳號內累積之未使用優惠券、回饋券及M Point將同步清空歸零,無法換算為現金或其他商品進行退還,亦無法補發。另請注意,優惠券、回饋券及 M Point 均 無法於不同會員帳號之間進行移轉。

可疑的活動

如果我們偵測到包括但不限於任何下列有關您的帳號的可疑活動,我們即有權採取其認為適當的作為,其中包括移除或暫停您的帳號:

(i)  從事非法或詐騙活動;

(ii)  提供或企圖提供虛偽或故意誤導的資訊,或對我們或參加活動的餐廳做虛假的陳述;或

(iii) 非依條款而販售、讓與、轉讓或取得任何獎勵、優惠券、M Point 或回饋券,或將任何獎勵、優惠券、M Point 或回饋券提供販售、讓與、轉讓或取得;或

(iv)  (利用詐騙或其他方式)獲得過多M Point。

注意事項與通則

麥當勞保有麥當勞APP所有會員相關活動、材料與廣告的所有權及智慧財產權。

您是直接跟餐廳購買。當您兌換優惠時,您是直接跟參與活動的麥當勞餐廳兌換,供應產品的契約是成立於您和該接受您點餐兌換之餐廳(並非麥當勞本身或麥當勞體系的任何其他成員)。您領取產品的餐廳應負責準備產品,並將產品提供給您。您另外並瞭解且同意,您是直接跟該餐廳購買(並非麥當勞本身或麥當勞體系的任何其他成員),因您跟餐廳購買之任何產品所致生或與之有關的任何責任,麥當勞本身或麥當勞體系的任何其他成員均不負責。所謂「麥當勞體系的成員」,係指麥當勞股份有限公司(即麥當勞的母公司)、其子公司、附屬公司、各該公司的加盟店、代理商、代表人及經銷處,以及他們的主管、董事及員工。

有關線上服務的產品。所有的產品均視您領取餐點之餐廳的供應情況而定。有些餐廳並未供應所有的產品。線上服務上的產品及包裝的影像只是範例而已,可能跟您在餐廳拿到的產品與包裝並不完全相同。其間之不同可能是因為您的裝置顯示之顏色、或例如使用的材料、供應商、地區或季節等其他因素。

有關點餐的價格。如果您發現跟您收取的產品價格有誤,請您和購買該產品的餐廳聯絡,要求退還差價。

退款和您的消費者權益。如果您因任何原因而希望退款,其中包括您對產品不滿意或有其他的原因,有關任何您應獲得的退款,請和您購買該產品的餐廳聯絡。您在這方面的合法權益,並不會受到條款的影響。

 

4.   線上服務的所有權與授權。

 

麥當勞的智慧財產所有權。線上服務中的任何權利,都是麥當勞或其授權人的專屬財產。「線上服務」包含任何及所有線上服務的內容,例如但不限於文字、影像、圖畫、標誌、標頭、按鈕標籤、圖像、語音剪輯、數位下載、資料彙整、軟體、商標、服務商標、商業表徵、音訊、視訊、資料及其他材料(合稱「內容」),以及線上服務中的任何部分。條款的任何內容,均非意圖將任何權利移轉或歸屬給您。您不得採取任何行動去影響、限制或干擾麥當勞或其授權人的權利。

您可使用線上服務的授權。您於個人使用之目的範圍內,被授予一非專屬、個人、不得轉讓及可撤銷的授權,並可依條款之規定使用線上服務,不得用於商業用途。「使用」包括存取、互動及展示。除條款所明確賦予您的授權與權利外,並無以默示的方式賦予您任何的授權與權利。麥當勞並保留所有其他權利。

商標資訊。商標、服務商標及所有的圖像元素,其中包括線上服務的外觀及其體驗感受,都是麥當勞或授權人所專有並受到保護的商標或商業表徵。線上服務另外亦可能包含分屬不同第三方之名稱、商標及服務商標,而係其各自所有的財產。

 

5.   線上服務可接受的使用及限制。

 

可接受的使用及其他限制。您不得以下列方式使用線上服務(包括內容在內),亦不得允許第三方有下列的行為:

a)      以不合法或條款所禁止的任何目的而使用線上服務;

b)     刪除或變更任何著作權、商標或其他的所有權聲明;

c)      企圖取得包括其內容在內之線上服務的所有權或任何產權;

d)     以任何商業方式使用、拷貝、散播、再刊行、展示、揭露、上傳、張貼或傳送線上服務;

e)      租賃、出租、販售、再授權、借貸、翻譯、合併、改編、讓與或轉讓線上服務,或與任何其他的程式或服務結合或整合;

f)       反匯編(disassemble)、反編譯(decompile)、逆向工程(reverse-engineer)、拷貝來源碼或目的碼格式,或根據線上服務製作衍生性作品;

g)      因移轉、提供、出口或再出口線上服務,而違反禁運、貿易制裁或其他技術管制或出口法令;您另外並陳述且保證,您不是 (i) 位在受美國政府禁運或被美國政府指定為「支援恐怖分子」的國家內;或 (ii) 被列在任何美國政府禁止或限制之對象的名單內;

h)     使用任何未經授權的技術或自動化系統存取線上服務或擷取線上服務的內容,其中包括但不限於網路爬蟲(spiders)、網路機器人(robots)、螢幕擷取器(screen scrapers)或離線閱讀器(offline readers);

i)        企圖使線上服務無法運作、損壞、過載、使受損,及未經授權存取線上服務、麥當勞網路或與線上服務相關的任何用戶帳號。

 

6.   責任限制與免責聲明。

 

麥當勞責任限制。任何直接或間接的損失利潤或業績的損害賠償、特別、間接、結果性、懲罰性或附帶損害賠償,不論麥當勞或麥當勞體系的任何其他成員均不負責,其中包括與線上服務相關,或因線上服務所致生之資料損失、人身傷害或財產損害。本條的任何內容,均非意圖限制麥當勞因麥當勞之重大過失或惡意或不法的行為所造成的損害賠償責任。此外,本條的任何內容,均非意圖限制或改變您身為顧客,依適用法律不能加以限制或改變的權利。麥當勞保留所有合法的權利,得依這些條款或依法律之許可,請求損害賠償或其他的賠償。

麥當勞是以「原樣」提供線上服務,並無任何保證。線上服務可能會有不正確或錯誤的地方。麥當勞是以「原樣」提供線上服務,並無任何明示或默示的保證。麥當勞否認所有對於適銷性及適合特定目的的保證。麥當勞並不保證、亦未表示線上服務是正確、可信賴、不會中斷、無錯誤、或瑕疵會被改正,或線上服務無病毒或其他有害的元素。有關您之使用線上服務,您應承擔全部的責任。如果對線上服務不滿意,您對麥當勞的唯一救濟,就是停止使用。此項救濟的限制,是您與麥當勞協議的一部分。

第三方服務。線上服務可能會連結到或允許您使用第三方網站、可下載的材料、內容、社群網路或其他的數位服務(合稱「第三方服務」)。這些第三方可能會有他們自己的條款和條件或隱私權政策,您在使用之前必須先審視及瞭解。麥當勞與任何該第三方均無關聯性,亦不認可任何第三方服務。對於因這些第三方服務所致生或與之相關的任何損失或損害,麥當勞均無責任。

非我們所能控制的情事。因麥當勞無法合理控制的任何情事所造成或與之有關,導致麥當勞因而未能履行條款對其所規定的任何義務,則麥當勞無責任。如有各該情事發生,則麥當勞依條款應盡之義務,在各該情事進行期間將中止;麥當勞雖無義務,但得盡合理的努力想辦法解決,以使得儘管有各該情事,仍得履行其依條款應盡之義務。

 

7.   行動應用程式條款

 

這些條款內含並補充蘋果公司(Apple Inc.)的條款和條件(請參閱https://www.apple.com/legal/itunes/us/terms.html#service)包括其中的「的授權應用程式終端使用者條款(「蘋果條款」),以及谷歌公司(Google Inc.)的系統以及谷哥市場 (Google Play)服務條款 (請參閱https://play.google.com/about/play-terms.html)。如果您是透過蘋果或谷哥應用程式使用線上服務,您也承認並同意:

  • 對於提供有關蘋果/谷哥應用程式的任何支援和維護服務,蘋果/谷哥並無任何的義務。如果您有任何有關蘋果/谷哥應用程式Apps維護和支援的問題,請使用前述的支援服務與麥當勞聯絡,而非與蘋果/谷哥聯絡;
  • 除非這些條款中另有其他明確的規定,有關擁有或使用蘋果/谷哥應用程式的任何求償,是您和麥當勞之間的事(而非不是您或其他任何人與蘋果/谷哥之間的事);及
  • 如果因為您擁有或(依這些條款)使用蘋果/谷哥應用程式而侵害任何智慧財產權,致使第三方有任何的求償,則有關該求償,蘋果/谷哥對您不負責亦無責任;

如果您購買的蘋果/谷哥應用程式並不符合其可適用的任何保固,您可以通知蘋果/谷哥蘋果,則蘋果/谷哥可能會依當時有效的蘋果/谷哥條款和條件,蘋果/谷哥可能會將蘋果/谷哥應用程式的購買價退還給您。依此原則,並在法律許可的最大範圍內,蘋果/谷哥並未提供或簽訂成立任何與蘋果/谷哥應用程式有關的保證、條件或其他條款,對於有關蘋果/谷哥應用程式,或因您或任何人使用蘋果/谷哥應用程式,或因信賴其中之任何內容,因而所造成的任何求償、損失、支出或任何性質的費用,蘋果/谷哥將無需對您負責。

 

8.    其他事項。

 

  • 麥當勞並未做任何陳述表示線上服務適合或可於中華民國以外的地方使用。如果您從其他地方使用線上服務,您應負責遵守當地應適用的法律。
  • 這些條款的準據法是中華民國法律,並應據以解釋之,而不論任何法律衝突原則。如因條款或線上服務所致生或與之有關的任何法律訴訟,您不可撤銷地同意,應以臺北地方法院為第一審管轄法院。
  • 雖然這些條款僅規範麥當勞與您之間的線上服務事宜(且雖然蘋果/谷哥及麥當勞體系的任何其他成員並非這些條款的當事人,然而蘋果/谷哥及麥當勞體系的任何其他成員依條款是第三人受益人,如果各該條款涉及他們,他們就有權對您行使麥當勞依這些條款所享有的各該權利)
  • 這些條款內中英文內容若存有任何歧異,概以中文內容為準。
  • 這些條款終止時,或允許您使用之線上服務終止時,依條款賦予您的相關權利應即終止;不過,您先前之使用線上服務,以及因各該使用所致生或與之有關的任何作為,仍應繼續適用這些條款。上述終止之時,麥當勞及麥當勞體系其他成員的所有權利,其中包括所有的智慧財產權、專有性權利及條款的授權應繼續適用,此外有關所有使用線上服務的限制、所有的責任限制與免責、以及本條關於準據法及管轄之約定,亦均應繼續適用。
  • 這些條款中的各條條款和條件都具有可分性並單獨操作。如果其中有任何的條款和條件不合法、無效或無法履行,則其餘的條款和條件仍然依然有完全的效力。
  • 如果麥當勞未堅持您必須履行條款對您所規定的任何義務,或如果麥當勞未對您行使其權利或遲延行使,並非意味麥當勞對您放棄其權利,亦非意味您無須遵守各該義務。

麥當勞得將條款對其所規定的權利與義務轉讓給其他組織或實體,但這樣做不會影響條款賦予您的權利或我們應履行的義務。您只有在麥當勞書面同意的情況下,才可以將條款對您所規定的權利或義務轉讓給其他人。

By installing, accessing or using any websites, mobile apps, email newsletters and subscriptions, and other digital properties on which these terms are posted or referenced (together, “online services”), you are entering into a binding agreement with McDonald’s developmental licensee PROSPECT HOSPITALITY CO., LTD. (“McDonald’s”, “we” or “us”), which it controls and operates from its headquarters at 3F, No.1, LinSen S.Rd., Zhongzheng District, Taipei, Taiwan (R.O.C.).

The online services are not intended to be used by, or targeted to, anyone under the age of 18. You must be at least 18 years old to use the online services.  If you are not yet 18 years old (or the legal age of majority if different in your jurisdiction), then you must review these terms with your parent or guardian and they must understand and agree to these terms in order for you to use the online services.

If you or your parent or guardian do not agree to these terms, then you must immediately stop using the online services and request that McDonald’s close any online services account that you have created. Please refer to “1. About the online services > How to contact us” for requesting account deletion, please also include the email address of the account that you want deleted.

1.      About the online services

You are responsible for your devices and accounts. You are responsible for any devices, software and services needed to use the online services. McDonald’s does not guarantee that the online services will fully function on any particular device or with any particular software. You are also responsible for any messaging and data charges, fees and taxes for your use of the online services, including when we communicate with you by text, email or other means that you choose. You may only use the online services with devices that you own or control and using only the authorized operating system (e.g., Apple iPhone OS for Apple devices). If you create an online services account, you are responsible for keeping the account secure and for all activity under the account. You must keep your account information accurate at all times.

McDonald’s right to update or terminate the online services. You understand and consent that (with or without notice) McDonald’s may update, modify or terminate the online services (or your access to them) from time to time, including by pushing updates to (or removing functionality or access from) any McDonald’s mobile app that you have installed on your device.

Updates to these terms. McDonald's may also update these terms at any time and at its sole discretion. If McDonald’s makes material changes to the terms, we will notify you by any reasonable means such as by posting the new terms in the online service. If you do not agree to the changed terms, then you must immediately stop using the online services and request that McDonald’s close any online services account that you have created. To close or delete your account, please refer to “1. About the online services > How to contact us” and include the email address of the account that you want deleted as well.

2. Our information practices and communicate with you.

McDonald’s Privacy Statement. The McDonald’s Privacy Statement (https://www.mcdonalds.com/tw/zh-tw/privacy-policy.html)  describes our information practices, including how we collect, use and share information.

How we communicate with you. Through the online services, you may opt in to receive emails, text messages to the mobile number you provide to us or push notifications from McDonald’s. When you opt in to any of these types of communications, you understand and consent that that you will receive marketing, transactional and other messages from McDonald’s. McDonald’s may use the information you have provided to us to communicate with you in accordance with McDonald’s Privacy Statement.

Opting out of communications generally. You have a choice in how we communicate with you. You can generally find your communication preferences with instructions on how to opt out in the profile section of the online service that you use. You may also have the ability to change your communication preferences using your device settings. In addition, our communications themselves may include the opportunity to opt out.  You understand and agree that you may need to separately manage your communication preferences for each communication method. For example, if you opt out of receiving marketing emails, you may still receive marketing text messages if you’ve opted in to receiving them.  Whilst we do our best to offer convenient methods for you to manage your communications preferences, you may need to separately adjust your preferences for each online service.  Please note that for some account-related and transactional communications, the only way to stop receiving these communications may be to close your online services account. 

3. McDonald’s Loyalty Program

Qualification and registration

The McDonald’s Loyalty Program is to show our gratitude to our customers. To access the offers and rewards under the McDonald’s Loyalty Program, you must be registered as a member of the McDonald’s APP (hereinafter referred to as the “McDonald’s member” or “Member”) and agree to the terms therein.

How do I become a McDonald’s member?

You can download the McDonald’s APP (titled as “McDonald’s”) via the App Store or Google Play and register for a membership account. After completion of registration, you will become a member. During the registration process, you need to provide the following information on the application page: email, mobile number, full name, gender, date of birth and account password.

Each email is allowed for the application of one membership account only, and multiple registration under one email account will not be granted. As a Member, you shall be responsible for prompt updates in case there is a change in names, email or any other information under your account. Should there be a loss of benefits due to failure of prompt data update, or incorrect information (for example, incorrect email address), we will not be held liable.

If you wish to delete the account, please select “Delete Account” under “My Account” in the APP anytime, and the account will be deleted afterward; all corresponding M Point, rewards and offers will also be deleted along with the account and cannot be refunded nor redeemed accordingly. The deletion will also include your relevant transaction records and personal data. Therefore, we advise cautious planning on the account deletion to avoid loss of accumulated rewards and benefits. Once the account is deleted, no recovery can be made. Should you wish to enjoy the membership benefits and access relevant functions within the APP, you will be required to register for a new account. 

Benefits for McDonald’s members

Offers

You will receive offers from the McDonald’s APP. The applicable terms for offers are as follows:

(1). The offers are specified to certain online services and shall be redeemed prior to its expiry date. In addition, they are only applicable for items displayed, limited to use at designated participating restaurants and subject to availability.

(2). The availability of the offers is subject to restaurant serving time (e.g. offers for non-breakfast meals are not provided during breakfast hours).

(3). Unless separate terms of use are provided, each offer can only be redeemed once and becomes invalid after redemption.

(4). Unless separate terms of use are provided, each redemption is limited to one offer-designated meal. Exchange of items or upgrade with increased price is not allowed.

(5). The offers cannot be transferred, exchanged for cash or other alternatives, nor separated, sold or resold. The use of offers is only limited to McDonald’s restaurants that we operate.

(6). The offers can only be used by scanning the offer QR code or the offer code at the counter, Self-Order Kiosk in store or Drive Thru.

(7). In addition, there may possibly be other specific terms and conditions applicable to the offer, which will be notified and explained separately.

(8). Only the offers provided from the McDonald’s APP are valid and capable of redeeming the benefits contained. The offer only redeemable only by the registered member of the McDonald’s APP account and cannot be sold. McDonald’s does not warrant the authenticity of any offers obtained via other methods.

(9). We hold the right to delete all unused offers from the system.

(10). Whether in whole or in part, offers that are incomplete or mechanically duplicated, forged, generated with third-party software, or received via other automated or mechanical use of the McDonald’s APP will not be accepted.

(11). Should you delete the membership account of the McDonald’s APP, all unused offers under such account will be cleared and reset to zero simultaneously and cannot be converted into cash or other merchandise as a refund, nor will they be redistributed.

(12). The offers cannot be used in some of the McDonald’s restaurants. Please see McDonald’s website for more information.

How to use the offers?

You may use the offer via the methods below:

(1). Scan the offer QR code or present the offer code at the restaurant counter.

(2). Scan the offer QR code or type in the offer code at the Self-Order Kiosk.

(3). Read out the valid offer code to staff attending to your order at a Drive Thru.

M Point

Should you hold the membership account of the McDonald’s APP, when dining at participating McDonald’s restaurant in Taiwan, or using the same account username and password to log in to McDelivery Service to order, each NT$1 of spend may earn 1 M Point (i.e. NT$20 will earn 20 M Point, and so on). The system will distribute M Point earned into your membership account within 24 hours after transaction (excluding special factors such as network disconnection), which can be found under the membership records in the McDonald’s APP. All transaction records are subject to final records in the McDonald’s system.

You can earn M Point through the process below (If you do not follow this process at the time of purchase you will not earn M point or have any recourse to claim the point.):

(1). At the counter our self-ordering kiosk by scanning your membership QR code.

(2). At the Drive Thru by reading out the alphanumeric code to the crew member attending to your order.

(3). Via our McDelivery services and logging in with McDonald’s App account username and password.

(4).  Not applicable for Some McDonald’s restaurants. Please see McDonald’s website for more information.

If you do not follow this process at the time of purchase, you will not earn points or have any recourse to claim the points. 

M Point expire at the end of the month after the year earned. (e.g., for 20 M Point obtained on October 26, 2023, these 20 M Point will be valid till October 31, 2024, and so on). No extension can be made post the expiry date of M Point. Therefore, please be aware to redeem your rewards prior to expiry of the M Point.

From time to time, McDonald’s may offer bonus campaigns or M Point accelerators that allow you to earn M Point in new and different ways. Further information regarding any bonus campaign or promotions shall be made available in the context of such campaign or promotion. Your account holds a maximum of 50,000 M Point at any one time. Once you have reached the maximum M Point, no more M Point will be granted from subsequent transactions. McDonald’s is entitled to amend relevant constraints and terms on M Point. Such an amendment can be implemented with or without notification in advance.

Using your M Point to redeem reward items.

Your M Point earned from purchases or participating in member exclusive events through the McDonald’s APP can be used to redeem free products in the rewards menu, which may change from time to time. The applicable terms are as follows:

(1). The use of M Point to redeem reward items is only limited to rewards displayed in the APP. After completion of redemption, M Point cannot be returned to you, and the expired M Point may not be used to redeem reward items.

(2). The reward items shall be used prior to their expiration date specified. Its use is limited to participating restaurants and subject to availability.

(3). The availability of the reward item is subject to restaurant serving time (e.g., reward items for non-breakfast meals are not provided during breakfast hours).

(4). Each reward coupon is limited to one use only and will become invalid after use.

(5). Each redemption is limited to the item displayed and can use one reward item per transaction. Exchange of items, item upgrade with additional payment is not allowed.

(6). The meals redeemed from rewards are subject to availability. Please redeem at a McDonald’s restaurant according to instructions. In case any restaurant is unable to provide the meal (or any portion of the meal) displayed on the reward item due to any reason whatsoever, such restaurant is entitled to substitute one or multiple products at an equivalent or higher price.

(7). The rewards are neither transferable, nor can they be exchanged for cash or other alternatives.  Neither can they be sold or resold separately.  The use of the rewards is only limited to McDonald’s restaurants that we operate.

(8). The reward items can only be redeemed at the restaurant counter, Self-Order Kiosk or Drive Thru, and are not applicable for “McDelivery” service.  In addition, there may possibly be other terms and conditions of specific events applicable to the reward coupons. For the particular terms, please refer to the description of relevant events for details. Only the reward provided from the McDonald’s APP is valid and capable of redemption. The reward items are only redeemable for use by the holder of the McDonald’s APP member account and not for resale. McDonald’s does not warrant the authenticity of any reward items obtained via other methods.

(9). We reserve the right to delete all unused reward items from the system.

(10). Whether in whole or in part, rewards within the app that are incomplete or mechanically duplicated, forged, generated with third-party software, or received via other automated or mechanical use of the McDonald’s APP will not be accepted.

(12). The methods of using reward items are identical with offers, meaning they can be used by scanning the QR code or presenting the alpha-numeric code of the reward item at the counter, Self-Order Kiosk in store or Drive Thru.

(13). Rewards cannot be used in some of the McDonald’s restaurants. Please see McDonald’s website for more information.

Returns and membership deletion.

(1).McDonald’s is entitled to remove M Point at any time if products are returned for any reason and a full or partial refund of the purchase price is given. This also applies to the exchange of products, unless the exchange is for products included in the loyalty scheme with an equivalent points value.  The same applies to the exchange of purchased products, except for products of the same or higher value.

(2). Should you decide to delete the membership account of the McDonald’s APP and never use it again, the accumulated unused offers, reward items and M Point under such account will be cleared and reset to zero simultaneously and cannot be converted into cash or returned with other merchandises as refund, nor will they be redistributed. Also please note, neither offers, reward items, nor M Point can be transferred to different membership accounts.

Suspicious Activity

We are entitled to take any action we consider appropriate, including removing or suspending your account if we detect any suspicious activity concerning your account including but not limited to:

(i) engaging in illegal or fraudulent activities;

(ii) supplying or attempting to supply false or misleading information, or making a misrepresentation to McDonald’s or the participating restaurant; or

(iii) selling, assigning, transferring or acquiring, or offering to sell, assign, transfer or acquire any benefit, offers, reward items, or M Point other than in accordance with these terms and conditions; or

(iv) excessive earning M Point (via fraud or other means).

General

We retain at all times ownership of all materials and advertising in connection with the of McDonald’s APP and its membership activities together with all intellectual property rights in and over the materials and advertising of the same.

You purchase products directly from restaurants. When you redeem the merchandise contained, you redeem them directly with a participating restaurant and the contract for supplying the products will be between you and the restaurant that accepts your order (and not with McDonald’s nor any other Members of the McDonald’s System). The restaurant where you collect your products is responsible for preparing the products and providing them to you. YOU FURTHER UNDERSTAND AND AGREE THAT YOU ARE PURCHASING DIRECTLY FROM RESTAURANTS (AND NOT McDONALD’S OR ANY OTHER MEMBERS OF THE McDONALD’S SYSTEM) AND THAT NEITHER McDONALD’S NOR ANY OTHER MEMBERS OF THE McDONALD’S SYSTEM HAVE ANY RESPONSIBILITY ARISING OUT OF OR RELATED TO ANY PRODUCTS THAT YOU PURCHASE FROM RESTAURANTS USING ORDERING.  McDonald’s Corporation (which is McDonald’s parent company), its subsidiaries, affiliates, their franchisees, agents, representatives, and agencies and their officers, directors, and employees are together, “Members of the McDonald’s System”.

About the products in the online services. All products are subject to availability at the restaurant where you collect your order.  Some restaurants do not sell all products.  Images of products and packaging on the online services are examples only and may not be identical to the product or packaging you receive from a restaurant. Differences may be due to your device’s display of colors or factors such as the ingredients used, the supplier, the region of the country and the season of the year.

About the prices when ordering. In the event you discover an error in the price of the product charged to you, please contact the restaurant where you purchased the product to seek a refund of the difference.

Refunds and your consumer rights. If you desire to seek a refund for any reason, including if the products are unsatisfactory or for other reasons, please contact the restaurant where you purchased the product regarding any refund due to you. Your legal rights in this respect are not affected by anything in these terms.

4. Ownership and Licenses for the online services.

McDonald’s intellectual property ownership. Any and all rights in the online services are and shall remain the exclusive property of McDonald’s or its licensors. For purposes of clarity, “online services” includes any and all content on the online services, such as, but not limited to, text, images, graphics, logos, page headers, button icons, images, audio clips, digital downloads, data compilations, software, trademarks, service marks, trade dress, audio, video, data and other materials (together, “content”) as well as any part of the online services. The online services are licensed, not sold, to you.  Nothing in these terms intends to transfer any such rights to, or to vest any such rights in, you. You may not take any action to jeopardize, limit or interfere with McDonald’s or its licensors’ rights. 

Your license to use the online services. Subject to these terms, you are granted a personal, non-exclusive, non-transferable and revocable license to use the online services solely for your own personal, non-commercial purposes solely in accordance with these terms. For purposes of clarity, “Use” includes access, interact with, and display. No licenses or rights are granted to you by implication or otherwise, except for the licenses and rights these terms expressly grant to you. McDonald’s reserves all other rights.  

Trademark information. Trademarks, service marks, and all graphical elements, including the look and feel appearing on the online services, are distinctive and protected trademarks or trade dress of McDonald’s or licensors.  The online services may also contain various third-party names, trademarks, and service marks that are the property of their respective owners.

5. Acceptable uses and restrictions for online services.

Acceptable uses and other restrictions. With respect to the online services (which includes content), you may not, and may not allow third parties, to:

a)       Use the online services for any purpose that is unlawful or prohibited by these terms;

b)      Delete or change any copyright, trademark, or other proprietary notices;

c)       Attempt to obtain ownership or title to the online services, including the content;

d)      Use, copy, distribute, republish, display, disclose, upload, post, or transmit the online services in any commercial manner;

e)      Rent, lease, sell, sub-license, loan, translate, merge, adapt, assign or transfer the online services, or combine them with, or incorporate them into, any other programs or services;

f)        Disassemble, decompile, reverse-engineer, copy in source or object code format, or create derivative works based on the online services;

g)       Transfer, provide, export or re-export the online services in violations of an embargo, trade sanction, or other technology control or export laws and regulations; you also represent and warrant that you are not (i) located in a country subject to a U.S. Government embargo, or designated by the U.S. Government as a “terrorist supporting” country; or (ii) listed on any U.S. Government list of prohibited or restricted parties;

h)      Use or launch any unauthorized technology or automated system to access the online services or extract content from the online services, including but not limited to spiders, robots, screen scrapers, or offline readers;

i)        Attempt to disable, damage, overburden, impair or gain unauthorized access to the online services, McDonald’s network or any user accounts associated with the online services.

6. Limitations on liability and disclaimers.

Limitations on McDonald’s liability. NEITHER McDONALD’S NOR ANY OTHER MEMBERS OF THE McDONALD’S SYSTEM SHALL NOT BE LIABLE FOR ANY DIRECT OR INDIRECT LOST PROFITS OR LOST BUSINESS DAMAGE, SPECIAL, INDIRECT, CONSEQUENTIAL, EXEMPLARY OR INCIDENTAL DAMAGES, INCLUDING LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE RELATED TO OR ARISING OUT OF THE ONLINE SERVICES.  NOTHING IN THIS SECTION IS INTENDED TO LIMIT McDONALD’S LIABILITY FOR DAMAGES TO THE EXTENT CAUSED BY McDONALD’S OWN GROSS NEGLIGENCE OR INTENTIONAL OR UNLAWFUL MISCONDUCT. ADDITIONALLY, NOTHING IN THIS SECTION IS INTENDED TO LIMIT OR ALTER YOUR RIGHTS AS A CONSUMER THAT CANNOT BE LIMITED OR ALTERED UNDER APPLICABLE LAW.  McDonald’s reserves all legal rights to recover damages or other compensation under these terms or as allowed by law.

McDONALD’s PROVIDES THE ONLINE SERVICES "AS IS" AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESSED OR IMPLIED. McDONALD'S DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. McDONALD'S DOES NOT WARRANT OR MAKE ANY REPRESENTATION THAT THE ONLINE SERVICES WILL BE ACCURATE, RELIABLE, UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE ONLINE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ASSUME TOTAL RESPONSIBILITY RELATED TO YOUR USE OF THE ONLINE SERVICES. YOUR SOLE REMEDY AGAINST McDONALD’S FOR DISSATISFACTION WITH THE ONLINE SERVICES IS TO STOP USING THEM. THIS LIMITATION OF RELIEF IS A PART OF THE BARGAIN BETWEEN THE PARTIES.   

Third party services. The online services may link to or allow you to use third-party websites, downloadable materials, content, social networks, or other digital services (together, “third party services”). These third parties may have their separate terms and conditions or privacy policies that you should review and understand before using them. McDonald’s does not endorse and is not associated with any of these third party services. McDONALD’S HAS NO RESPONSIBILITY FOR ANY LOSS OR DAMAGES ARISING FROM OR RELATED TO THESE THIRD PARTY SERVICES.

Events beyond our control. McDONALD’S HAS NO RESPONSIBILITY for McDONALD’S FAILURE TO PERFORM any of ITS obligations under these terms caused by or related to any event beyond McDonald’s reasonable control. If such an event occurs, then McDonald’s obligations under these terms will be suspended for the duration of the event; and McDonald’s may, but is not required to, use reasonable endeavors to find a solution by which its obligations under these terms may be performed despite the event.

7. Mobile Applications

These terms incorporate and supplement the Apple, Inc. (“Apple”) terms and Conditions (available at https://www.apple.com/legal/itunes/us/terms.html#service), including the Licensed Application End User terms therein (“Apple terms”) and the Google Inc. (“Google”)/ Google Play terms and Conditions (available at https://play.google.com/about/play-terms.html). If you are using the online services through Apple application or Google application, you also acknowledge and agree:

  • Apple/ Google has no obligation at all to provide any support or maintenance services in relation to the Apple/ Google Application. If you have any maintenance or support questions in relation to the Apple/ Google Apps, please contact McDonald’s, not Apple/ Google, using the above Support Services details;
  • except as otherwise expressly set out in these terms, any claims relating to the possession or use of the Apple/ Google Application are between you and McDonald’s (and not between you, or anyone else, and Apple/ Google); and
  • in the event of any claim by a third party that your possession or use (in accordance with these terms) of the Apple/ Google Application infringes any intellectual property rights, Apple/ Google will not be responsible or liable to you in relation to that claim;

If the Apple/ Google Application that you have purchased does not conform to any warranty applying to it, you may notify Apple/ Google, which may refund the purchase price of the Apple/ Google Application to you subject to then-current Apple/ Google terms and conditions. Subject to that, and to the maximum extent permitted by law, Apple/ Google does not give or enter into any warranty, condition or other term in relation to the Apple/ Google Application and will not be liable to you for any claims, losses, costs or expenses of whatever nature in relation to the Apple/ Google Application or as a result of you or anyone else using the Apple/ Google Application or relying on any of its content.

8. Miscellaneous.

  • McDonald's makes no representation that the online services are appropriate or available outside of the Taiwan (R.O.C.). If you use the online services from other locations you are responsible for compliance with applicable local laws.
  • These terms will be governed and interpreted pursuant to the laws of Taiwan (R.O.C.), notwithstanding any principles of conflicts of law. You irrevocably consent to the exclusive jurisdiction and venue in Taiwan Taipei District Court for purposes of any legal action arising out of or related to these terms or the online services.
  • Although these terms govern the online services as between McDonald’s and you only (and although Apple/ Google is not a party to, and no other Members of the McDonald’s System are parties to these terms, Apple/ Google and other Members of the McDonald’s System are third party beneficiaries under these terms and will have the right to enforce against you those rights that McDonald’s holds under these terms to the extent such terms may pertain to them.
  • These terms and conditions are written in Chinese. Any translation of these terms and conditions into another language is provided solely for your convenience, and in the event of any discrepancy between the two, the Chinese version will prevail.
  • On termination of these terms or of your permission to use the online services, all rights granted to you under terms shall cease; however, these terms will continue to apply to your prior use of the online services and anything relating to or arising from such use. Upon termination, all of rights of McDonald’s and other Members of the McDonald’s System, including all intellectual property rights, proprietary rights, and licenses in these terms shall survive, as well all restrictions on use, all limitations on liability and disclaimers, and all about governing law and jurisdiction of this Section 8.
  • Each of the terms and conditions in these terms are severable and operate separately. If any of them are unlawful, void or unenforceable, then the remaining terms and conditions will remain in full force and effect.
  • If McDonald’s fails to insist that you perform any of your obligations under these terms, or if McDonald’s does not enforce its rights against you, or delays in doing so, that will not mean that McDonald’s has waived its rights against you and will not mean that you do not have to comply with those obligations.
  • McDonald’s may transfer its rights and obligations under these terms to another organization or entity, but this will not affect your rights or our obligations under these terms. You may only transfer your rights or obligations under these terms to another person if McDonald’s agrees in writing.
