McDonald's As Seen In Prize Draw ("Prize Draw") Terms and Conditions
These are the terms and conditions for the McDonald's As Seen In Prize Draw (the Prize Draw) (the Terms). Entry and claim instructions are deemed to form part of these Terms, although these Terms prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials.
1 Promotion
1.1 This Prize Draw is promoted by McDonald's Restaurants Limited, 11-59 High Road, East Finchley, London N2 8AW ("McDonald's"). The Prize Draw is subject to these Terms. By entering the Prize Draw, you, the entrant, agree to be bound by and accept these Terms.
1.2 The Prize Draw opens at 00:00:01 on 16th August 2023 and closes at 23:59:59 on 29th August 2023 (the "Closing Date"). Entries received after the Closing Date shall be void and shall not be entered into this Prize Draw.
2 Eligibility
2.1 In order to be eligible to enter the Prize Draw each entrant must:
(a) have downloaded, registered and signed-in with the official McDonald's (UK) App (the "App") (entries into this Prize Draw can only be made via the App);
(b) be aged 18 or over and resident in the UK (including Northern Ireland); and
(c) be eligible to enter the Prize Draw under these Terms.
2.2 The following are not eligible to participate in the Prize Draw:
(a) employees of McDonald's, McDonald's franchisees and employees of McDonald's franchisees and their immediate families;
(b) employees of any company responsible for redemption of the prizes or for supplying prizes for the Prize Draw and their respective franchisees, subsidiaries, agents and advisors;
(c) other persons assisting with this Prize Draw or otherwise professionally connected with the Prize Draw; and
(d) any person entering via an agent or using the services of or which is an entity carrying on the business of entering (or advising on entering) prize promotions.
3 How to enter and entry restrictions
3.1 To enter the Prize Draw, an entrant must complete the mandatory fields of the online entry form accessed via the App with entrant’s full name, email address, postal address, date of birth and mobile phone number, tick the boxes on the form to confirm acceptance of these Terms and submit the completed entry form before the Closing Date.
3.2 There is a limit of one entry per email address. If you enter more than once your first entry will be accepted and all others will be disqualified. No third party or bulk entries. You are not permitted to enter the Prize Draw on behalf of another person.
3.3 Any entrant using multiple email addresses, phone numbers or multiple names to access the Prize Draw will be disqualified and any prize award will be void. McDonald’s reserves the right to determine, in its sole and absolute discretion, whether an entrant has already submitted an entry and to disqualify any subsequent entries or prize claims.
4 Prizes

(a) Each TV Entertainment Bundle Prize consists of:

(a) By 8th September 2023, each winner of the TV Entertainment Bundle Prize shall receive an email (to the email address submitted by the entrant on the online entry form at the time of entry) stating that they have won a prize, subject always to these Terms.
(b) Each TV Entertainment Bundle Prize will be dispatched by HISENSE (to the UK postal address provided by the respective winner at the time of entry) within 28 days of the Closing Date.
4.3 Cinema Ticket Prize
(a) Within 10 days of the Closing Date, each winner shall receive a unique prize code via email (to the email address submitted by the entrant on the online entry form at the time of entry) with redemption instructions. Winners will not be notified in advance. The unique prize code must be used to claim the pair of cinema tickets on or before 26th September 2023.
(b) To obtain the pair of cinema tickets, the winner must visit https://sparkwinners.com/summer2023 and enter the unique prize code and choose their participating cinema on or before 26th September 2023. Each winner will then receive two codes to be used on or before 26th March 2024. Each code can be used to obtain a cinema ticket at the chosen participating cinema’s box office or online at the participating cinema’s website. A code can be used separately or in combination with the other code at the chosen participating cinema box office or website. The cinema chains participating in the promotion are:
Cineworld, PictureHouse, Showcase, Empire, Reel, Savoy, Scott, Merlin, MovieHouse, The Light.
(c) Codes may be redeemed for entry to a qualifying standard 2D screening on or before 26th March 2024 (where a “qualifying standard screening” excludes 3D, 4DX, D-Box, Super Screen, IMAX, Alternative Content, any premiere, event cinema, special event, event not open to the public, school booking, corporate or private hire).
(d) Codes can be used to make bookings at a chosen cinema’s foyer Box Office or online. If codes are used to make a booking at the cinema’s foyer there are no additional charges. Online booking fees will be payable for online bookings. Codes can only be used once, cannot be used for any merchandise or item other than entry to the qualifying screening and may not be used for any special or private, viewing or booking. Any upgrade to premium seating or a non-standard screening will be subject to an additional fee and is at the cinema manager’s discretion.
(e) The terms and conditions of the selected participating cinema apply and may be reviewed at the corresponding cinema-websites including (without limit) in connection with general admission and age. Normal film classification rules and normal age restrictions apply. The management for each participating cinema reserves the right to refuse admissions and its decision is final.
(f) Codes are not to be used for financial gain in resale or in conjunction with any other offer and are subject to any other applicable terms including, but not limited to, the terms and conditions found at https://sparkwinners.co.uk/summer2023/terms-and-conditions.
5 Winner selection
5.1 There will be 1,005 winners in total. Within 24 hours of the Closing Date, all valid entries received by the Closing Date will be placed into one random prize draw conducted under independent supervision or via a computer programme producing a verifiably random draw. The winners of the TV Entertainment Bundle Prize shall be the first 5 entries selected when the draw is made and the winners of the Cinema Ticket Prize shall be the next 1,000 entries selected when the draw is made.
2.2 In the event that any winning entry later proves to be invalid or deemed void then McDonald’s may re-award the relevant prize as it sees fit (but shall not be obliged to do so); specifically, the drawing of one or more reserve entries shall not of itself imply any obligation for McDonald’s to award a prize to a reserve entry should a winning entry become invalid or deemed void.
6 Winner verification
6.1 It is the responsibility of the entrant to provide their correct, up-to-date details when entering the Prize Draw, in order for their prize claim to be processed if they are a winner. McDonald’s cannot be held responsible for a winner failing to supply accurate information at point of entry, which affects prize acceptance or delivery of their prize. Please note it will not be possible to update or amend a postal address after entering the Prize Draw or if you are drawn as a winner.
6.2 McDonald's may carry out such background checks and require such information (including proof of identity, address and/or age) as it considers necessary or desirable for the purposes of verifying eligibility or the validity of any entry, and any prize may be withheld unless and until McDonald's is satisfied with the verification.
6.3 Reference in the Terms or any promotional advertising, material or communication to any person as a "winner" or which otherwise expresses or might imply that a prize has been won, shall not thereby imply a waiver of any prize-claim/verification processes relating to the award of that prize or of McDonald's rights under the Terms to withhold or cancel (if already awarded) the prize, to adjudge the prize-claim as void for any or all purposes and/or to rule the entrant as ineligible for further participation in the Prize Draw.
6.4 Failure of the winner to comply with these Terms (including any deadlines therein) and other instructions of McDonald's at any stage during the Prize Draw and prize fulfilment process (whether or not communicated via an agent) may result (in McDonald's sole discretion) in the prize being withheld and the applicable claim being deemed void for all purposes.
7 Responsibility
7.1 Entry into this Prize Draw is at the entrant's sole risk. To the fullest extent permitted by applicable law (but not otherwise) McDonald's and its agents and/or commercial partners assume no responsibility and are not liable for:
(a) the accuracy or otherwise of any prize description or illustration;
(b) the non-availability, loss, late receipt or damage of any text, prize-claim, prize-notification or other communication for whatever reason;
(c) a prize lost, delayed or damaged in transit;
(d) (other than those warranties or conditions implied by statute and which cannot be excluded) any representation, warranty, condition or guarantee in respect of the prizes; or
(e) any taxes, fees, charges or other costs which a winner may be required to pay in connection with the prizes, (save to the extent expressly accepted by McDonald's in these Terms).
7.2 Nothing in these Terms will limit McDonald's liability for death or personal injury caused by its negligence or for fraud, or any other liability which cannot be excluded or limited under applicable law. Nothing in these Terms shall affect an entrant’s statutory rights.
8 Privacy
8.1 McDonald's shall use and process an entrant’s personal data in accordance with McDonald’s Privacy Statement https://www.mcdonalds.com/gb/en-gb/privacy-policy.html. Winner details provided on entry to the Prize Draw will be passed onto a third party for prize fulfilment purposes and winner notification. By participating in the Prize Draw, you agree to the use of your personal data as described in these Terms.
8.2 Winners of the Cinema Ticket Prize may be required to provide to the prize-provider personal data in connection with claiming and/or redeeming the prize or the products or services of the prize-provider. Entrants should review and satisfy themselves with the privacy policy of any such prize provider as McDonald’s cannot accept any responsibility for this.
8.3 A list of the surname and county of the winners of the prizes which the Promoter considers (in its discretion) to be major in the context of the prize-pool as a whole will be made available to anyone who requests it by sending by pre-paid post a signed, hand-written request specifying this requirement and addressed to AS SEEN IN PRIZE DRAW 2023, The Marketing Store, 16 Hatfields, London SE1 8DJ which is received within 30 days of the Closing Date. Entrants may request their surname and county is not published in the event they win by sending by a signed, hand-written request specifying this requirement and addressed to AS SEEN IN PRIZE DRAW 2023, The Marketing Store, 16 Hatfields, London SE1 8DJ before the Closing Date. Notwithstanding any such request, McDonald’s shall provide the surname and county of the winners of the TV Entertainment Bundle Prize to competent authorities (including the Advertising Standards Authority) upon request.
9General
9.1 There is no cash alternative (in whole or in part) to any prize and the prizes are not transferable. McDonald’s may substitute a product deemed to be an appropriate replacement and of equal or greater value in place of any part of a prize.
9.2 McDonald's decision in the exercise or interpretation of any of its rights or discretions in connection with the Terms shall be final and binding. No correspondence will be entered into.
9.3 All age limits shall be deemed to be actual age as at the time of acceptance of the Terms, unless expressly stated otherwise in these Terms.
9.4 McDonald's is not responsible for any changes to any entrant's email or postal address.
9.5 Incomplete, illegal, misdirected or late entries will not be accepted. McDonald's takes no responsibility for entries that are delayed, incomplete, invalid or lost due to technical reasons or otherwise.
9.6 McDonald’s reserves the right to exclude any entries which it believes to be fraudulent or based on misconduct, or if, in its reasonable opinion, it considers that there is a significant risk that the entrant may bring the McDonald’s brand into disrepute.
9.7 Entries via third parties, consumer groups or syndicates, entries by macros or other automated means and entries which do not satisfy the requirements of these Terms in full will be disqualified. If it becomes apparent, in the reasonable opinion of McDonald's, that either an entrant is using any means to circumvent this condition such as, and without limitation, fraudulently falsifying data, using multiple devices, acting fraudulently or dishonestly, using identities other than their own, creating fake identities or using any other automated or manual means in order to increase that entrant's entries or otherwise acting in violation of these Terms, those entrants will be disqualified, and any prize entitlement will be void.
9.8 McDonald's reserves the right to terminate, cancel, suspend, or amend the Prize Draw (or any part of it), with no liability to any entrants or third parties if it considers it necessary to do so due to circumstances outside its reasonable control. McDonald’s shall not exercise this right unreasonably and if this happens, McDonald’s shall use all reasonable endeavours to avoid consumer disappointment.
9.9 If using a device, computer and/or internet-access which is not owned or paid for by the entrant, the entrant is reminded to obtain the owner's permission before participating in the Prize Draw. McDonald’s will not be liable for any internet, mobile connection or other charges incurred in participating in the Prize Draw (or any part of it).
9.10 These Terms, and any dispute arising out of these Terms, shall be exclusively governed by and interpreted in accordance with English law and entrants submit to the exclusive jurisdiction of the English Courts, unless you live in another part of the UK, in which case your local courts will have jurisdiction.
