McDonald's Big Mac Prize Draw Terms and Conditions
These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry/claim instructions are deemed to form part of these Terms and Conditions and by participating all entrants/claimants will be deemed to have accepted and be bound by these Terms and Conditions. Please retain a copy of these Terms and Conditions for your information.
1 Promoter: McDonald's Restaurants Ltd, 11-59 High Road, East Finchley, London, N2 8AW.
2 Eligibility: This Promotion is open to all GB residents (England, Scotland and Wales) aged 18 or over, except for the following:
(a) employees of McDonald's, McDonald's franchisees and employees of McDonald's franchisees and their immediate families;
(b) employees of any company responsible for redemption of prizes or for supplying prizes for the Promotion and their respective franchisees, subsidiaries, agents and advisors;
(c) other persons assisting with this Promotion or otherwise professionally connected with the Promotion;
(d) any person entering via an agent or using the services of an agent, or which is an entity carrying on the business of entering (or advising or entering) prize promotions.
This promotion is not available in Northern Ireland or the Republic of Ireland.
3 Promotional Period: The Promotion opens at 00:00:01 on 13th March 2023 and closes at 23:59:59 on 15th March 2023 (the "Closing Date").
4 Location: an undisclosed location in the Essex area.
5 Internet access and the McDonald's app are required for entry. Entrants can download the McDonald's app via Google Play or the App Store. Entrants are reminded to get the owner's permission before using a device and/or internet-access which is not owned or paid for by the entrant to enter the Promotion. The Promoter will not be liable for any internet or mobile connection, or other charges incurred in entering the Promotion.
6 Entry Details
a. Locate the promotional post on the McDonald’s app.
b. Submit a prize draw form that includes full name, email address and phone number.
d. Entries are restricted to one entry per e-mail address. Any subsequent entries will be disqualified.
e. The Promotion is free to enter, and no purchase is necessary.
f. Incomplete, illegal, misdirected or late entries will not be accepted. The Promoter takes no responsibility for entries that are delayed, incomplete or lost due to technical reasons or otherwise.
g. No third party or bulk entries. Do not enter on behalf of another person. Entries via third parties, consumer groups or syndicates, entries by macros or other automated means and entries which do not satisfy the requirements of these Terms and Conditions in full will be disqualified. If it becomes apparent in the reasonable opinion of the Promoter that either an entrant or household is using any means to circumvent this condition such as, and without limitation, fraudulently falsifying data; using multiple devices; acting fraudulently or dishonestly in the reasonable opinion of the Promoter; using identities other than their own; creating fake identities or using any other automated or manual means in order to increase that entrant's or a household’s entries or otherwise acting in violation of these Terms and Conditions, those participants and any household will be disqualified, and any prize entitlement will be void.
h. Any entrant or household using multiple email addresses, phone numbers or multiple names to access the Promotion will be disqualified and any prize will be void. The Promoter reserves the right to determine, in its sole and absolute discretion, whether an entrant or household has already submitted an entry (or won a prize) and to disqualify any subsequent entries or prize claims.
i. All entries and any related material must be free from sexist, racist, defamatory, obscene, anti-religious, homophobic, bullying, harassing, violent, sexual or otherwise unacceptable content in the sole opinion of McDonald’s. McDonald’s reserves the right to review, edit, alter or remove any entry in its sole discretion, which does not comply with these Rules or which it reasonably believes does not comply with these Rules.
7 Winner Selection: There will be 50 winners. All valid entries for the Draw will be collated and will compete for the Prize. The Draw will take place within 24 hours after the Closing Date of the Draw. Each draw will be made from all valid entries at random under independent supervision or via a computer programme producing a verifiably random draw.
In the event that any winning entry later proves to be invalid or adjudged void then McDonald's may re-award the Prize as it sees fit (but shall not be obliged to do so); specifically, the drawing of one or more reserve entries for any draw shall not of itself imply any obligation for McDonald's to award the Prize to a reserve entry should a winning entry become invalid or adjudged void.
8 Winner Notification: Each winner will be contacted on the phone number provided at the point of entry. Each winner will be notified by Monday 20 March 2023 via email informing of their win. The notified winners will receive a phone call on the week commencing the 20 March 2023 to confirm their attendance in the undisclosed location in the Essex area. If the winner cannot be contacted at the first attempt, a second phone call will be made during this time. If contact with a winner is not made by 23:59:59 on 22 March 2023 that winner will forfeit their Prize and a new winner will be drawn.
a. There are 50 prizes of 2 x McDonald’s Big Mac products (one Big Mac product per person) (the "Prize") to be served to each winner and their guest at the Location on 28 March 2023 between 12:00pm – 14:00pm, which shall also include a celebrity appearance.
b. Each winner shall be entitled to bring 1 guest who must be aged 18 or over. The winner shall confirm the guest's name when informed of their win.
c. The Promotion is free to enter and no purchase is necessary. The Prize is limited to 1 per person and e-mail address.
d. There is no cash alternative to the Prize stated and the Prize must be accepted by the named winners. The Prize is non-transferable.
e. Winners and their guests must be willing to be filmed receiving their Prize and shall be required to sign a release form.
f. The Promoter reserves the right to provide an alternative prize of equal or greater value should circumstances outside its control make this necessary.
g. The Promoter shall not be responsible for reimbursing any travel costs incurred by the winners.
h. It is the responsibility of the entrant to provide their correct, up-to-date details when entering the Promotion, in order for their Prize claim to be processed if they are a winner. The Promoter cannot be held responsible for winners failing to supply accurate information at point of entry which affects Prize acceptance or delivery of their Prize. Please note it will not be possible to update or amend an e-mail address after entering the Promotion, or if you are drawn as a winner.
i. Whilst the Promoter will take all reasonable steps to ensure that its obligations relating to meeting specific timeframes for Prize dispatch are met, the Promoter shall not be liable in any way for its inability to meet these timeframes resulting from an outbreak of Covid-19 either within its own business or within the Prize delivery supply chain.
j. Should a national or local lockdown affect the Promoter’s ability to meet these deadlines, it will fulfil its obligations as soon as is reasonably possible after its and/or its third-party fulfilment provider's resume business as usual.
a. Details are collected for the purpose of administering the Promotion only. Winner details will be passed onto a third party for prize fulfilment and winner notification only and will not be used for any other purpose. b. The surname of the winners will be made available to anyone who requests it by emailing email@example.com by 23:59:59 on 12 May 2023. Entrants may request their surname not be published in the event they win by emailing firstname.lastname@example.org at the time a winner is notified they have won. However, the Promoter shall provide the surname of the winners to competent authorities upon request from such competent authorities (including the Advertising Standards Authority).
d. McDonald's retains entrant's data for 28 days and a winner's data for a maximum of three months. In addition to the foregoing, McDonald's may process further information relating to entrants to the extent they separately receive communications from McDonald’s and / or have opted in receiving marketing messages (in which case personal data will be sent to McDonald's third-party providers such as Armadillo for sending newsletters).
e. Any enquiries about personal information held by McDonald's, including any request for deletion of personal data, may be made by contacting the Customer Services number which is notified on the Contact Us section of www.mcdonalds.co.uk for UK or customerservices.mcdonalds.ie/hc/en-gb/requests/new to obtain the contact name and address to which to send an envelope marked "Data Protection Request".
f. Subject to clauses f. and g. and without prejudice to McDonald's data protection obligations under relevant law, McDonald's shall make available, upon receipt of a written request to our Customer Services team at customerservices.mcdonalds.co.uk/hc/en-gb/requests/new for UK, the winner(s) surname or such other information McDonald's deems necessary.
g. Entrants to the Promotion shall, at or before the time of entry, have the right to object to all or some of their personal information being made available in accordance with clause (8)e. You can object by contacting our Customer Services team at customerservices.mcdonalds.co.uk/hc/en-gb/requests/new for UK.
h. Without prejudice to clause (8)e. and f. above, McDonald's shall provide the information set out in clause (8)e. upon request from the Advertising Standards Authority.
i. These Rules shall be exclusively governed by and construed in accordance with the laws of England but is subject to the mandatory local law protections for consumers, and the courts of England and Wales will have exclusive jurisdiction in the event of any dispute.
a. The Promoter reserves the right to hold void, cancel, suspend, or amend the Promotion at its discretion owing to factors outside its reasonable control, but will use all reasonable endeavours to avoid consumer disappointment.
b. Where we suspect that an entrant has breached these Terms and Conditions, we reserve the right to verify the winners and ask for proof of identity, age and address and that they are the person associated with the winning notification.
c. The Promoter accepts no responsibility for system errors or other issues that may result in disruption to winner notifications or prizes. The Promoter or its agencies will not be responsible for the non-inclusion of entries, including any such failure which is within the control of The Promoter or its agencies.
d. Entry into the Promotion is at the entrant's sole risk. To the extent permitted by law, the Promoter does not accept any responsibility for any damage, loss, liabilities, injury, costs, expenses or claims (whether in contract, tort or otherwise) suffered by entrants or any third parties arising out of or in connection with the Promotion and/or accepting a prize. The Promoter further disclaims liability for any injury or damage to entrants or any other person relating to or resulting from participation with this Promotion save that nothing in these Terms and Conditions shall act to limit or exclude the Promoter's liability resulting from its negligence or fraud.
e. The Promoter’s decision is final and binding. No correspondence will be entered into.
f. The application and interpretation of these Terms and Conditions shall be governed by the law of England and Wales and the courts of England and Wales shall have exclusive jurisdiction in relation to any dispute concerning them.
