McDonald's Festival Merchandise - Prize Draw Terms and Conditions
These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry/claim instructions are deemed to form part of the terms and conditions and by participating all claimants will be deemed to have accepted and be bound by the terms and conditions. Please retain a copy of these terms and conditions for your information.
1 Promoter: McDonald's Restaurants Ltd, 11-59 High Road, East Finchley, London, N2 8AW.
2 Eligibility: This Promotion is open to GB (England, Scotland, and Wales) residents aged 18 or over, The Following people are not eligible to participate:
a. employees of any company responsible for redemption of prizes or for supplying prizes for the Promotion and their respective franchisees, subsidiaries, agents and advisors;
b. other persons assisting with this Promotion or otherwise professionally connected with the Promotion;
c. any person entering via an agent or using the services of, or which is an entity carrying on the business of entering (or advising on entering) prize promotions; or
d. employees of McDonald's, McDonald's franchisees and employees of McDonald's franchisees and their immediate families.
3 Promotion: the McDonald's Festival Merchandise prize draw.
4 Promotional Period: The Promotion opens at 8am on Monday 22nd May 2023 and closes at 11:59pm on Saturday 27th May 2023 (‘Closing Date’). Entries must be received by the Promoter by no later than the Closing Date. Entries received after the Closing Date will be void.
Internet access and a Facebook account are required for entry. A Facebook account can be opened at www.Facebook.com. Participants are reminded to get the owner's permission before using a computer, device and/or internet-access which is not owned or paid for by the entrant to enter the Promotion. The Promoter will not be liable for any internet or mobile connection, or other charges incurred in entering the Promotion.
5 Entry Details
a. Locate the promotional post on the McDonald’s UK Facebook page;
b. Fill in the form with your full name, address, email address and choice of sizing from S, M, L or XL;
d. Entry is limited to one entry per person. If you enter more than once your first entry will be accepted and all others will be disqualified. For the avoidance of doubt, a household can use one Facebook account to enter and can enter the Promotion once.
e. Proof of sending will not be accepted as proof of delivery or receipt of entry. Incomplete, illegal, misdirected, or late entries will not be accepted. The Promoter takes no responsibility for entries that are delayed, incomplete or lost due to technical reasons or otherwise.
f. No third party or bulk entries. Entries via third parties, consumer groups or syndicates, entries by macros or other automated means and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified. If it becomes apparent in the reasonable opinion of the Promoter that either a participant or household is using any means to circumvent this condition such as, and without limitation, fraudulently falsifying data; using multiple Facebook accounts; acting fraudulently or dishonestly in the reasonable opinion of the Promoter; using identities other than their own; creating fake identities or using any other automated or manual means in order to increase that participant's or a household’s entries or otherwise acting in violation of these terms, these participants and their household will be disqualified, and any prize entitlement will be void.
g. All entries and any related material must be free from sexist, racist, defamatory, obscene, anti-religious, homophobic, bullying, harassing, violent, sexual or otherwise unacceptable content in the sole opinion of the Promoter. The Promoter reserves the right to review, edit, alter or remove any entry in its sole discretion, which does not comply with these Terms and Conditions or which it reasonably believes does not comply with these Terms and Conditions.
h. The Promoter reserves the right to exclude any entries which it believes to be fraudulent or based on misconduct, or if, in its reasonable opinion, it considers that there is a significant risk that the entrant may bring the Promoter's brand into disrepute.
6 Winner Selection:
a. There are 200 winners in total.
b. The winners will be drawn using a random number generator within 7 working days of the Closing Date.
c. In the event that any winning entry later proves to be invalid or adjudged void then the Promoter may re-award the prize for that winning entry as it sees fit (but shall not be obliged to do so).
7 Winner Notification:
a. Each winner will be contacted via the email address provided at point of entry within 28 working days of the prize draw and informed of their win No further action is required by winners.
b. Choice of size requested at the point of entry cannot be guaranteed. There is no choice of colour. Pink and blue T-shirts randomly allocated.
c. It is the responsibility of the participant to ensure that they provide correct mailing details at the point of entry. The Promoter cannot be held responsible for winners failing to supply accurate information which affects delivery of their prize
a. There are 200 prizes in total.
b. The prize a set of McDonald’s festival merchandise consisting of 1 x McDonald's bespoke black cowboy hat (1 size only), 1 x black fabric hand fan with a Golden Arches design, 1 x Fries Shirt in size S, M, L or XL in pink or blue.
c. Only one prize per household .
d. There is no alternative sizing or styles available.
e. There is no cash alternative to the prize stated and prize must be accepted by the named winners. Prizes are non-transferable.
f. The Promoter reserves the right to provide an alternative prize of equal or greater value should circumstances outside its control make this necessary.
g. Prizes will be delivered to the address provided at point of entry within 28 working days of the Promoter notifying a winner that they have won . Please note if you have booked a festival, we cannot guarantee your prize will arrive in time for the festival.
h. It is the responsibility of the entrant to provide their correct, up-to-date details when entering the Promotion, for their prize claim to be processed if they are a winner. The Promoter cannot be held responsible for winner or runners-up failing to supply accurate information at point of entry which affects prize acceptance or delivery of their prize. Please note it will not be possible to update or amend a postal address after entering the Promotion, or if you are drawn as a winner.
i. Whilst the Promoter will take all reasonable steps to ensure that its obligations relating to meeting specific timeframes for prize dispatch are met, the Promoter shall not be liable in any way for its inability to meet these timeframes resulting from an outbreak of Covid-19 either within its own business or within the prize delivery supply chain.
a. Details are collected for the purpose of administering the Promotion only. Winner details will be passed onto a third party for prize fulfilment and winner notification only and will not be used for any other purpose. b. The surname and county of the winners will be made available to anyone who requests it by emailing firstname.lastname@example.org within 1 month of the Closing Date. Participants may request their surname and county is not published in the event they win by emailing email@example.com before the Closing Date. However, the Promoter shall provide the surname and county of the winner and runners-up to competent authorities upon request from such competent authorities (including the Advertising Standards Authority).
d. The Promoter retains entrant's data for 28 days and a winner's data for a maximum of three months. In addition to the foregoing, the Promoter may process further information relating to entrants to the extent they separately receive communications from the Promoter and / or have opted in receiving marketing messages (in which case personal data will be sent to the Promoter's third-party providers such as Armadillo for sending newsletters).
e. Any enquiries about personal information held by the Promoter, including any request for deletion of personal data, may be made by contacting the Customer Services number which is notified on the Contact Us section of www.mcdonalds.co.uk for UK or customerservices.mcdonalds.ie/hc/en-gb/requests/new to obtain the contact name and address to which to send an envelope marked "Data Protection Request".
f. Subject to clauses g. and h. below and without prejudice to the Promoter's data protection obligations under relevant law, the Promoter shall make available, upon receipt of a written request to our Customer Services team at customerservices.mcdonalds.ie/hc/en-gb/requests/new for UK, the winner(s) surname or such other information the Promoter deems necessary.
g. Entrants to the Promotion shall, at or before the time of entry, have the right to object to all or some of their personal information being made available in accordance with clause (9)f. You can object by contacting our Customer Services team at customerservices.mcdonalds.ie/hc/en-gb/requests/new for UK.
h. Without prejudice to clause (9)f. and g. above, the Promoter shall provide the information set out in clause 9f. upon request from the Advertising Standards Authority.
a. The Promoter reserves the right to hold void, cancel, suspend, or amend the Promotion at its discretion owing to factors outside its reasonable control or if it considers it necessary to do so, but will use all reasonable endeavours to avoid consumer disappointment. The Promoter will not exercise this right unreasonably.
b. Where we suspect that an individual has breached these terms and conditions, we reserve the right to verify the winner and runners-up and ask for proof of identity, age, and address and that they are the person associated with the winning notification.
c. The Promoter accepts no responsibility for system errors or other issues that may result in disruption to winner notifications or prizes. The Promoter or its agencies will not be responsible for the non-inclusion of entries, including any such failure which is within the control of the Promoter or its agencies.
d. Entry into the Promotion is at the entrant's sole risk. To the fullest extent permitted by applicable law (but not otherwise) the Promoter and its agents and/or commercial partners assume no responsibility and are not liable for: (i) the accuracy or otherwise of any prize description or illustration; (ii) (where applicable) the non-availability, loss, late receipt or damage of any text, prize-claim, prize or notification or other communication and whether by reason of mobile-telephone network-operator error or other problem, failed or corrupted transmission, handset failure (including full or unserviceable inbox) or otherwise; (iii) (other than those warranties or conditions implied by statute and which cannot be excluded) any representation, warranty, condition or guarantee in respect of a prize; or (iv) any taxes, fees, charges or other costs which winners may be required to pay in connection with a prize, (save to the extent expressly accepted by the Promoter in these Terms and Conditions). Nothing in these Terms and Conditions will limit the Promoter's liability for death or personal injury caused by its negligence or for fraud, or any other liability which cannot be excluded or limited under applicable law. This does not affect entrants' statutory rights
f. Prizes will be awarded for the draw only on verification by the Promoter that the relevant entrant has complied with the Terms and Conditions. Failure of a winner to follow the deadlines and other instructions of the Promoter at any stage of the Promotion and prize fulfilment process (whether or not communicated via an agent) may result (in the Promoter's sole discretion) in the prize being withheld and the winner's claim being judged void for all purposes.
g. The promoter’s decision is final and binding. No correspondence will be entered into.
h. The Promoter does not guarantee continuous uninterrupted access to the relevant entry form and or the website(s). Numerous factors outside the control of the Promoter may interfere with the operation of any of the same. No responsibility will be accepted for any technical or other difficulties in entering or any entries delayed or corrupted.
i. By entering you understand that you are providing your information to the owner of this Facebook page and not to Facebook. This promotion is in no way sponsored, endorsed, or administered by, or associated with Facebook.
j. The application and interpretation of these terms and conditions shall be governed by the law of England and Wales and the courts of England and Wales shall have exclusive jurisdiction in relation to any dispute concerning them.
