McDonald’s Grinch Festive Social Competition ("Promotion") - Full Terms & Conditions

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of these Terms and Conditions and by participating all entrants ("Entrants") will be deemed to have accepted and be bound by these Terms and Conditions. Please retain a copy of these Terms and Conditions for your information.

1. Promoter: McDonald's Restaurants Ltd, 11-59 High Road, East Finchley, London, N2 8AW.

2. Eligibility: This Promotion is open to all GB residents (England, Scotland and Wales) aged 18 or over, except for anyone directly connected with the planning or administration of the Promotion including the following:

a. employees of McDonald's, McDonald's franchisees and employees of McDonald's franchisees and their immediate families (spouses, parents, children, siblings, grandparents and/or ‘step’ family);

b. employees of any company responsible for redemption of prizes or for supplying prizes for the Promotion and their respective franchisees, subsidiaries, agents and advisors;

c. other persons assisting with this Promotion or otherwise professionally connected with the Promotion;

d. any person entering via an agent or using the services of an agent, or which is an entity carrying on the business of entering (or advising or entering) prize promotions.

This promotion is available to UK residents only.

3. Promotional Period: The Promotion opens at 5pm on 2nd December and closes at 5pm on 3rd December ("Closing Time"). Entries must be received by the Promoter no later than the Closing Time. Entries received after the Closing Time will be void.

4. Internet access and an Instagram account are required for entry.

5. An Instagram account can be opened at Instagram.com. Entrants are reminded to get the owner's permission before using a computer, device and/or internet-access which is not owned or paid for by the Entrant to enter the Promotion. The Promoter will not be liable for any Internet or mobile connection, or other charges incurred in entering the Promotion.

6. Entrants hereby agree to reasonable publicity relating to this Promotion without any payment. Publicity includes but is not limited to McDonald’s UK social media channels sharing entries, the Promoter publishing the winners' names and Instagram handles, and any statements made by winners concerning the Promotion and the prize on McDonald’s UK social media channels. Entrants and winners acknowledge and agree that @mcdonaldsuk may comment on entries. This does not mean that an Entrant is a winner, neither does it increase an Entrant's chance of winning.

7. How to enter

To enter the Promotion and to be considered for a chance to win one of the prizes (outlined below) each Entrant must:

a. tag another Instagram account in a comment on the @mcdonaldsuk Instagram post for this Promotion (the "Promotional Post");

b. ‘like’ the Promotional Post; and

c. follow the McDonald's Instagram account @mcdonaldsuk.

8. The Promotion is free to enter, and no purchase is necessary.

9. Entries are restricted to one entry per person. The Promoter reserves the right to determine, in its sole and absolute discretion, whether an Entrant has already submitted an entry (or won a prize) and to disqualify any subsequent entries or prize claims.

10. Proof of sending will not be accepted as proof of delivery or receipt of entry.

11. Incomplete, illegal, misdirected or late entries will not be accepted. The Promoter takes no responsibility for entries that are delayed, incomplete or lost due to technical reasons or otherwise.

12. No third party or bulk entries. Entries via third parties, consumer groups or syndicates, entries by macros or other automated means and entries which do not satisfy the requirements of these Terms and Conditions in full will be disqualified. If it becomes apparent in the reasonable opinion of the Promoter that either an Entrant or household is using any means to circumvent this condition such as, and without limitation, fraudulently falsifying data; using multiple Instagram accounts; acting fraudulently or dishonestly in the reasonable opinion of the Promoter; using identities other than their own; creating fake identities or using any other automated or manual means in order to increase that Entrant's or a household’s entries or otherwise acting in violation of these Terms and Conditions, these Entrants and their household will be disqualified, and any prize entitlement under this Promotion will be void.

13. The Promoter reserves the right to review, edit, alter or remove any entry in its sole discretion, which does not comply with these Terms and Conditions or which it reasonably believes does not comply with these Terms and Conditions.

14. Any entries that the Promoter considers (in its absolute discretion) to be bullying, spiteful or upsetting, political, dangerous, profane, suggestive, vulgar, offensive, indecent, illegal, racist, copied, offensive (including but not limited to words or symbols that might be considered offensive to individuals of any race, ethnicity, religion, sexual orientation or socioeconomic group), cruel or fraudulent, or which infringe intellectual property rights of others will be immediately disqualified.

15. The Promoter reserves the right to exclude any entries where there is a significant risk that the Entrant may bring the Promoter's brand into disrepute.

16. Winner Selection

There are 22 winners in total. All entries received will be placed into a random prize draw conducted by an independent third-party or via a computer programme producing a verifiably random draw within 7 days of the Closing Date. The winners will be the first 22 randomly selected eligible entries. The Promoter reserves the right to not award all the prizes if there are not enough valid entries.

17. Winner Notification

a. Each winner will be contacted via direct message from the McDonald’s UK Instagram Account @mcdonaldsuk within 7 days of the Closing Date, informing them of their win and asking them to reply to the message with confirmation of prize acceptance and asking them to share information as required by the Promoter so that each winner can redeem their prize. 

b. Winners will have 48 hours to accept their prize. It is the responsibility of the Entrant to ensure that they respond to the winner notification. If contact cannot be made, or the prize is not claimed within 48 hours of the initial prize notification date, an alternative winner may be randomly selected. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.

18.   Prizes

a. There are 22 prizes to be won.

b. Each prize consists of one (1) Festive Jumper with the following sizes available:

i.     x 7 Small

ii.     x 2 Medium

iii.     x 6 Large

iv.     x 7 Extra-Large.

c. Sizes will be allocated based on the order of the winner selection. Prizes are limited to one per household.

d. There is no cash alternative to the prize stated and prize must be accepted by the named winners. Prizes are non-transferable.

e. The Promoter reserves the right to provide an alternative prize of equal or greater value should circumstances outside its control make this necessary.

f. Prizes will be sent to the winners within 10 working days of the winners accepting the prize.

g. It is the responsibility of the Entrant to provide their correct, up-to-date details when entering the Promotion, in order for their prize claim to be processed if they are a winner. The Promoter cannot be held responsible for winners failing to supply accurate information at point of acceptance which affects prize acceptance or delivery of their prize.

19.    Privacy

a. Details are collected for the purpose of administering the Promotion only. Winner details will be passed onto a third party for prize fulfilment and winner notification only and will not be used for any other purpose. b. The Promoter will process all personal data in accordance with McDonald's privacy statement - here. In particular the Promoter: (i) will not collect more of the winners' personal information than needed for the purpose of administering and analysing this Promotion (including carrying out security checks as stated) and for posting features on its website which are informed by one entry-submission; and (ii) will only use the winner's personal information for those purposes (and such use may include transferring the winner's personal information to McDonald's respective associates).

c. The Promoter retains a winner's data for a maximum of three months. In addition to the foregoing, the Promoter may process further information relating to winners to the extent they separately receive communications from McDonald's and/or have opted in receiving marketing messages (in which case personal data will be sent to McDonald's third-party providers such as Armadillo for sending newsletters). 

d. Any enquiries about personal information held by McDonald's, including any request for deletion of personal data, may be made by contacting the Customer Services number which is notified on the Contact Us section of http://www.mcdonalds.co.uk for UK or customerservices.mcdonalds.ie/hc/en-gb/requests/new to obtain the contact name and address to which to send an envelope marked "Data Protection Request".

e. Subject to clauses 19(f) and 19(g) and without prejudice to McDonald's data protection obligations under relevant law, McDonald's shall make available, upon receipt of a written request to our Customer Services team at customerservices.mcdonalds.co.uk/hc/en-gb/requests/new for UK, the winners surnames or such other information McDonald's deems necessary.

f. Winners to the Promotion shall, at or before the time of entry, have the right to object to all or some of their personal information being made available in accordance with clause 19(g). Winners can object by contacting our Customer Services team at customerservices.mcdonalds.co.uk/hc/en-gb/requests/new for UK.

g. Without prejudice to clause 19(e) and 19(f) above, McDonald's shall provide the information set out in clause 19(e) upon request from the Advertising Standards Authority.

20.   General:

a. The Promoter reserves the right to hold void, cancel, suspend, or amend the Promotion at its discretion owing to factors outside its reasonable control or if it considers it necessary to do so, but will use all reasonable endeavours to avoid Entrant disappointment.

b. Where the Promoter suspects that an Entrant has breached these Terms and Conditions, the Promoter reserves the right to verify the winners and ask for proof of identity, age and address and that they are the person associated with the winning notification.

c. The Promoter accepts no responsibility for system errors or other issues that may result in disruption to winner notifications or prizes. The Promoter or its agencies will not be responsible for the non-inclusion of entries, including any such failure which is within the control of the Promoter or its agencies.

d. Entry into the Promotion is at the Entrant's sole risk. To the extent permitted by law, the Promoter does not accept any responsibility for any damage, loss, liabilities, injury, costs, expenses or claims (whether in contract, tort or otherwise) suffered by Entrants or any third parties arising out of or in connection with the Promotion and/or accepting a prize. The Promoter further disclaims liability for any injury or damage to Entrants or any other person relating to or resulting from participation with this Promotion save that nothing in these Terms and Conditions shall act to limit or exclude the Promoter's liability resulting from its negligence or fraud.

e. This Promotion is in no way sponsored, endorsed or administered by, or associated with Instagram. Entrants understand that they are providing information to the Promoter and not to Instagram. f. The Promoter’s decision is final and binding. No correspondence will be entered into.

h. The application and interpretation of these Terms and Conditions shall be governed by the law of England and Wales and the courts of England and Wales shall have exclusive jurisdiction in relation to any dispute concerning them.
