MONOPOLY DOUBLE PEEL AT McDONALD’S 2023 UK PROMOTION – CONSUMER RULES (“Rules”)

1. ENTRANTS

Each entrant must be aged 18 or over and a UK, Isle of Man or Channel Islands’ resident to participate in the MONOPOLY DOUBLE PEEL at McDonald’s 2023 UK Promotion (“Promotion”). The following are not eligible to participate: (a) Employees and immediate family members of employees of any of McDonald’s Restaurants Limited (“referred to in these Rules as “the Promoter” or “McDonald’s”), any company responsible for redemption of prizes/vouchers or for supplying prizes for the Promotion and their respective franchisees, subsidiaries, agents and advisors, (b) other persons assisting with this Promotion, (c) any person not being an individual person, (d) any syndicate or collection of persons acting in concert, (e) any person entering via an agent or using the services of or which is an entity carrying on the business of entering (or advising on entering) prize promotions and (f) any person using any application or process to submit an entry on that person’s behalf automatically or by proxy.

2. DURATION OF THE PROMOTION

2.1 Duration: – The Promotion is scheduled to take place from 6^th September 2023 to 17^th October 2023 (inclusive) at participating McDonald’s restaurants (meaning a restaurant owned by, or branded as, McDonald’s) located in the United Kingdom (including Northern Ireland but not the Republic of Ireland), Isle of Man and Channel Islands.

2.2 Continuing potential for changes: – Any supervening circumstances beyond McDonald’s control which causes McDonald’s to exercise its rights in section 7, may include McDonald’s curtailing, deferring and/or extending any scheduled period for entering any game, claiming any prize and/or completing any prize-fulfilment process referred to in these Rules at any time (including, without limit, for the purpose of issuing stocks of on-pack labels incorporating the Promotion-game pieces (“Game Pieces Labels”) which would otherwise remain undistributed at the end of the Promotion or for enabling originally estimated volumes of game-entries to be made). Although McDonald’s shall endeavour to post relevant information on the news page of the McDonald’s App or website at mcdnews.co.uk (and therefore entrants and prospective entrants are advised to check the news page regularly), please note that McDonald’s shall not be obliged to give notice of any such curtailment, deferral or extension of such scheduled periods (unless prescribed by law or applicable regulatory codes of practice).

3. HOW TO ENTER

3.1 Game Pieces Labels: –

3.1.1 How To Obtain A Game Pieces Label – Whilst stocks of Promotion-packaging at participating McDonald’s restaurants last, customers can obtain an on-pack Game Pieces Label on the purchase of a qualifying menu item. Carefully remove the Game Pieces Label from the packaging by peeling back where indicated.

3.1.2 QUALIFYING MENU ITEMS: –

Please note: 

(a) Any award of a Game Pieces Label which is not as advertised and is made at a restaurant for an item which is not a qualifying item or otherwise exceeds expectations in line with the above table for any other reason, shall in each case be deemed to have been made by the relevant server for that restaurant in the server’s discretion without giving rise to any right to the same or other favourable treatment for any other person;

(b) Beverages affected by the Government’s Soft Drinks Industry Levy are subject to an additional charge which is included in the prices shown in restaurants;

(c) Not all qualifying menu items are served in every McDonald’s outlet, such as Big Tasty items at outlets in ASDA stores, McCafé Iced range-items, other restaurants with a limited menu; and

(d) All outlets may (with or without notice) have to limit or otherwise vary their range of qualifying menu items Game Pieces Labels-awards, serving hours and/or purchasing-channels, due to the direct or indirect impact on McDonald’s of supervening events beyond its control. 

3.1.3 Composition of each Game Pieces Label – Each Game Pieces Label comprises two Game Pieces (“Game Pieces”) which in turn will either be two “Property Game Pieces” or one Property Game Piece and one “Instant Win Game Piece”, as each type and location of the “security code” is explained in section 3.3 below.

3.1.4 Volume of Game Pieces Labels – McDonald’s has produced a total volume of Game Pieces Labels across all types of qualifying menu items which it considers reasonably likely to satisfy estimated demand for Game Pieces Labels during the Promotion. Should demand across different types of qualifying menu item prove to be inconsistent, then Game Pieces Labels can be expected to run out prior to the end of the Promotion for some types of qualifying menu item, whilst remaining undistributed at the end of the Promotion for other types of qualifying menu item. As a result, customers wishing to obtain Game Pieces Labels towards the end of the Promotion should check with a Crew Member at the customer’s selected restaurant which qualifying menu items are most likely still to be supplied with Game Pieces Labels, before placing an order. Customers can also view the news page of the McDonald’s App or website at mcdnews.co.uk in case this includes updates from time to time about which types of qualifying menu items are most likely to remain available across all restaurants collectively.

3.1.5 McDonald’s Fair Ordering Policy – This will apply over the scheduled duration of the Promotion to assist McDonald’s to prevent inconsistent or premature depletion during the scheduled period of the Promotion of stocks of Game Pieces Labels across one or more types of qualifying menu item. Steps may be taken to apply a restaurant-wide maximum limit on numbers of Game Pieces Labels per order and/or a specific restriction against any order which does not appear to restaurant-servers or managers (in their discretion) to be primarily for the purposes of consumption by the persons ordering and others in their parties. Please view the news page of the McDonald’s App or website at mcdnews.co.uk during the Promotion to check for any announcements about implementation of the Fair Ordering Policy. 

3.2 What Entrants Need To Do To Play

3.2.1 Most of the games and most types of prize-claim require prior registration for a McDonald’s App account and opting in to the Promotion via the McDonald’s App account in order to create a digital wallet which is personal to each registrant (“Monopoly Wallet”) and within which different sections (separately referred to as “wallets”) are located to assist the participant to “bank” Properties (-see section 3.3 below), to participate in selected games and to store and initiate claims for selected prizes and awards.

3.2.2 In order to create a McDonald’s App account and Monopoly Wallet, registrants will first need to have used an internet-enabled, compatible smartphone or other device on to which the registrant has successfully download an up-to-date version of the McDonald’s App on to the phone or other device and to have registered for a McDonald’s App-account (which shall include accepting the terms and conditions for use of the McDonald’s App) before then providing the required confirmation to register for the Promotion and be provided with access to a Monopoly Wallet.

Please note:   

(i)  It is the registrant’s responsibility to obtain permission from the person who owns or pays for the device and internet-service in advance,

(ii) Personal data submitted when registering for a McDonald’s App account will be held and managed in accordance with the Promoter’s privacy statement,

(iii) The same email address which the registrant has used to register for a McDonald’s App account must then be used to play and claim prizes in the Promotion, and

(iv) Prize-claims for selected Promotion food prizes (including offers) and bonus points offers from Double Peel for the MyMcDonald’s Rewards scheme available for award via the Community Chest Peel described at section 3.3.3.2 below (“bonus points offers from Double Peel”) will be stored in the winner’s Monopoly Wallet for reference only. Following  award of one of these types of prize and offer, it will appear within the Rewards & Offers tab of the winner’s McDonald’s App account within 5 days, (so as to appear alongside any other food and bonus points offers obtained by the winner separately from the Promotion).

3.2.3. If an entrant creates more than one Monopoly Wallet by registering for multiple McDonald’s App-accounts using different personal information for each account, that entrant will not be able to combine Monopoly Wallets and may be disqualified from participating in the Promotion if the Promoter determines this to be appropriate (in its discretion).

3.3 Types of Game and Types of Game Piece: – Each of the following games (“Games”) can be entered by obtaining one or more Game Pieces Labels (depending on the type of game):

3.3.1 Collect To Win Game –this Game features properties (referred to as a “Property” or “Properties”) each comprising the name of a property street or station, a colour or train icon and a property reference prefaced with the “M”-shaped Golden Arches logo corresponding with one of the properties listed in the Collect To Win Game-column of the Prize Pools-Table in section 4.1 below.

 An image of one Property from the range of Properties will be featured individually:

3.3.1.1  on each Game Piece of this type (“Property Game Piece”) and shall include a 12-character security code printed vertically up the right hand side of the Property Game Piece, and

3.3.1.2  on selected Digital Peel outcomes described in section 3.3.3 below (each a “Digital Property”).

Each Property must be registered (“banked”) in the entrant’s Monopoly Wallet before that Property is able to count towards a Property set comprising one of the nine MONOPOLY-themed 2, 3 or 4 different Properties-sets as identified in the Collect To Win Game-column of the Prize Pools-Table (each a “Property Set”). The entrant is responsible for banking each Property Game Piece in that entrant’s Monopoly Wallet by following the instructions  in the Monopoly Wallet to enter the security code, whereas each Digital Property awarded by the Promoter is banked automatically in the entrant’s Monopoly Wallet. Once one of each of the Properties within a Property Set have been collected and banked in the entrant’s Monopoly Wallet, the entrant may (if otherwise permitted under the Rules) submit a claim for the Collect To Win prize featured in that table which corresponds with that Property Set.

Please note:        

(a) One specific Property-name in each Property Set shall be made available for award only in the limited numbers described in section 3.6.2 (each a “Rare” Property), either as a Property Game Piece, or as a Digital Property awarded via a Community Chest Peel (described in section 3.3.3.2 below);

(b) Each Property-name in each Property set which is not the Rare Property-name, is a “more frequently found Property”; and

(c) The award of all of the Collect To Win Game advertised prizes requires successful claims for all corresponding Property Sets, with each Property Set-claim in turn requiring each Property within that Property Set to be collected and banked (whether as Property Game Pieces or Digital Properties, or a mixture of both) by the same person.

3.3.2 Instant Win Game – selected Game Pieces (“Instant Win Game Pieces”) do not feature a Property but instead feature a prize-indication matching one of those in the column for the Instant Win prizes of the Prize Pools-Table in section 4.1 below (“Instant Win” prize). Once an entrant obtains an Instant Win Game Piece, the entrant may (if otherwise permitted under the Rules) submit a claim for the type of prize described in that table which corresponds with the featured prize-indication. If the claim for the Instant Win prize-type requires the entrant to submit the security code from the corresponding Instant Win Game Piece (or if the Promoter in its discretion and irrespective of the prize-type requires submission), the security code is to be found printed at the very bottom of the Instant Win Game Piece or vertically up the right hand side and will have 9, 10 or 12 characters.

3.3.3 Digital Peel Game – upon banking a Property Game Piece in the Monopoly Wallet (and as a separate and additional feature to the collection of that Property for the purposes of the Collect To Win Game), the entrant will receive an entry-opportunity for the Digital Peel Game. That entry-opportunity will be featured in the entrant’s Monopoly Wallet and can either be played in the Digital Peel Game immediately or stored by the entrant in the Monopoly Wallet to play at any time during the entry period. To play the entry-opportunity the entrant must follow the directions in the Monopoly Wallet for submitting the entry during the entry period, being any minute between 11:30:00 on 6^th September 2023 and 23:59:59 on 17^th October 2023 inclusive, being the entry period for the Digital Peel Game.

Upon the recorded receipt by the Promotion servers of a valid entry as described (and which doesn’t exceed the limit of 24 entries by that entrant in any “Day” being any 24 hour period starting from midnight or, for 6^th September 2023 only, from 11.30.00) (“Digital Peel entry”), the Promotion servers will allocate it to one of the following Digital Peel play-outcomes (“Digital Peel Outcomes”) namely:

 3.3.3.1   Cash Peel, meaning that the Digital Peel entry has been either the first valid entry recorded by the Promotion-servers as having been received at one of the pre-determined “winning moments” to which one of the Digital Cash prizes [stated in section 4.1.B has been pre-allocated, or if more than one entry has been received during that winning moment then it is the first of such entries to have been registered by the Promotion servers as received at one of those winning moments. If no valid Digital Peel entry is received at one of those winning moments, or if the award of any Digital Cash prize is declared invalid for any reason, in either case it will lapse and shall not be awarded or re-awarded

3.3.3.2  Community Chest Peel, meaning that the Digital Peel entry has been the first valid entry recorded by the Promotion-servers as having been received at one of the pre-determined “winning moments” to which one of the Community Chest prizes stated in section 4.1.B or (if no entries were received at that winning moment) received soonest after it. If the award of any Community Chest prize is declared invalid for any reason, it will lapse and shall not be re-awarded.

3.3.3.3   Bank or Swap Peel, meaning that the Digital Peel entry has generated the provisional award of a more frequently found Digital Property not being a Rare Property following which:

(a) that Property will automatically be banked in the entrant’s Monopoly Wallet if that has the effect of completing a Property Set or will become visible and provisionally available for award until the entrant opts either to manually bank the Property in the entrant’s Monopoly Wallet or to swap the Property (and thereby permanently discard it);

(b) if the entrant opts to swap the provisionally available Property once it becomes visible then the entrant will receive a new option to choose between:

(1) an undisclosed new Digital Property to be awarded at random from all of the more frequently found Properties (including the same type of Property as the entrant is choosing to swap, but excluding all Rare Properties) and which, after the entrant has selected this option, will be revealed and automatically banked in the entrant’s Monopoly Wallet (“Property Swap Outcome”), or

(2) an award of one entry in to a Prize Draw offering the chance to win the prize described in the table of section  below and which entry, after the entrant has selected this option, will automatically be submitted (“Prize Draw Outcome”);

(c) Should any one of these entrant’s options remain outstanding at the end of the entrant’s session which produces the Bank or Swap Peel, then the entrant can return to the same stage of the Bank or Swap Peel-process at any time up until 17^th October 2023. Any outstanding provisionally awarded Property, Property Swap Outcome or Prize Draw Outcome shall lapse and become void if not completed on or before 17^th October 2023 .

3.4 Using Game Pieces, Game Piece codes and Security:

3.4.1 Limit of one prize-claim per Game Piece – No Game Piece or “Game Piece code” (which expression includes the  security code and any other codes on the Game Piece, as the context permits) can be banked or used for more than one prize claim and, once a claim has been submitted, any Game Pieces and Game Piece codes relating to that claim may not be used for any other claim. For every type of win, please refer to section 5 for “How to Claim”.

3.4.2 Retaining Game Pieces – Please make sure Game Pieces and Game Piece codes are kept safe and undamaged at all times and that your McDonald’s App and wallets are retained without deleting the same or any data. This includes all Property Game Pieces even after they have been banked in your Monopoly Wallet in case they are connected with a Collect To Win Game or Digital Peel Game prize-claim or with any prize fulfilment-process. For some prizes, it is mandatory to send winning Game Pieces to the Promoter or the prize-provider as part of that prize claim and, for all other prizes, the Promoter reserves the right to require the claimant to send the winning Game Piece or Game Pieces to the Promoter or the prize-provider for verification as a pre-condition to the prize claim being verified (it being the case that McDonald’s is entitled to carry out verification even after notification that an award is being, or has been, made).

3.4.3 Keeping Game Piece codes private – Please make sure the Game Piece security-code and any other code on a Game Piece, together with your McDonald’s App and wallets, are kept private without being revealed to anyone else (other than to the Promoter as part of a prescribed process for an entry, registration or prize-claim in accordance with these Rules). Failure to do this may result in the Promoter determining (in its discretion) that the Game Piece and its codes together with all associated entries, registrations and/or prize-claims are void (and the Promoter may take this action irrespective of whether or not there is any evidence to suggest that the failure has resulted or will result in a wrongful prize claim or other action).

3.5 Game Pieces From Past or non-UK MONOPOLY-Themed Promotions: – For the avoidance of doubt, any physical or digital stickers, game pieces, labels or game-related wallets and their contents produced at any time for any other McDonald’s promotions in the UK or other country themed on MONOPOLY, together with any prize claims arising out of such other promotions, shall not be valid for the purposes of this Promotion.

3.6 Distribution and allocation of Game Pieces Labels, Game Pieces/Digital Peel Outcomes and prizes/awards: –

3.6.1 Distribution procedure for Game Pieces Labels – all Game Pieces Labels have been produced in advance of the Promotion and distributed by the Promoter on a random basis amongst participating McDonald’s restaurants, subject to the audited seeding processes applied to the Promotion. Following distribution, restaurants make every endeavour to reduce wastage of packaging to a minimum, but in the event this can’t be avoided for food safety or other reasons and promotional packaging has to be destroyed, any corresponding Game Pieces Labels attached to that packaging will also be destroyed without examination.

3.6.2 Total number of Instant Win Game Pieces and Property Game Pieces/Digital Properties  – In respect of:

3.6.2.1  the Instant Win Game Pieces, the number produced for the Promotion and made available for distribution for each type of Instant Win prize, shall be no less than the total number of Instant Win prizes of that type which are advertised as available to win via the Instant Win Game, an

3.6.2.2  the Property Game Pieces and Digital Properties:

(a) the number of each type of Rare Property for each of the Property Sets produced for the Promotion and made available for distribution, shall match the total number of prizes advertised as available to win via the Collect To Win Game for collecting the corresponding Property-Set (whether the Rare Property is awarded as a Game Piece or digitally as a Community Chest Peel outcome), and

(b) the number of Property Game Pieces for each type of more frequently found Property Game Piece produced for the Promotion and made available for distribution, shall be the same,

(c) the number of each type of more frequently found Property to be awarded via Bank or Swap, is not predetermined because it is awarded at random from the entire range of more frequently found Property-types

 (d) the total of all Properties distributed by 17^th October 2023, will depend on the degree and manner of consumer participation, including levels of the following; purchase of qualifying menu items, retention of Game Pieces, banking of Properties, volume and timing of Digital Peel entries, valid-submissions of prize-claims.

3.6.3 Distribution of Instant Win Game Pieces and Rare Properties and Allocation of Digital Peel Outcomes and Winning Moments for the Digital Peel Game – in the interests of ensuring a more balanced and fair distribution of prizes amongst entrants:

3.6.3.1 The Game Pieces in section 3.6.2.2(a) above have been seeded across all Game Pieces Labels made available for distribution in advance of the commencement of the Promotion under the Promoter’s audited procedures.

3.6.3.2  The duration of each winning moment to which one of the Cash Peel prizes or Community Chest Peel prizes has been pre-allocated, shall be determined by reference to a tenth of a second. The number of winning moments (and the prize-types to be allocated to those winning moments) have been allocated proportionately to each Day during the Digital Peel Game.

3.6.3.3  The winning moments to which Cash Peel prizes are to be pre-allocated for each Day (and the Cash Peel prize-types allocated to those winning moments) are allocated at the rate of 2 winning moments every minute throughout the Digital Peel Game, with both winning moments being allocated at random within the allocated minute.

3.6.3.4  The winning moments for the Community Chest Peel prizes for each Day (and the Community Chest Peel prize-types allocated to those winning moments) are allocated across the hours in that Day at random subject to due weighting to take account of anticipated rates of game-play at different times of the Day (and see sections 3.3.3.1 and 3.3.3.2 for the difference between the award-opportunity for each Cash Peel prize as compared to each Community Chest Peel prize).

3.6.3.5  All winning-moments and prize-type allocations to winning moments, have taken place in advance of the commencement of the Promotion and are carried out under the Promoter’s audited procedures.

3.6.3.6  Any Digital Peel entry which is entered at a winning moment to which a Cash Peel prize has been allocated shall be allocated that prize irrespective of it also qualifying for a Community Chest Peel.

3.6.3.7  All time-based determinations in this Promotion shall be made by the Promoter after reference to the Promotion clock on the Promotion servers and in accordance with the audited procedures and shall prevail irrespective of any variation with other sources of time-keeping or error having (or claimed by an entrant to have) an adverse effect upon any entry.

3.7 Complimentary Digital Peel entries: –

3.7.1  McDonald’s may (in its discretion) issue a number of complimentary codes (each a “Complimentary Digital Peel” code) for use in accordance with the Rules during the validity period and by invitees who have first validly registered and created a Monopoly Wallet in accordance with section 3.2.

3.7.2  Upon use of a Complimentary Digital Peel code, a more frequently found Property will be automatically banked in the user’s Monopoly Wallet and a Digital Peel entry will be automatically created which the user can then play in the Digital Peel Game at any time it remains open for entry and otherwise in accordance with section 3.3  .

3.7.3 The Complimentary Digital Peel codes available for McDonald’s to distribute  (in its discretion)  shall not exceed the maximum which the Promoter for each type of free offer has been pre-determined prior to the start of the Promotion – should any maximum be reached, the offer may be withdrawn by McDonald’s without notice and without any liability, although McDonald’s shall endeavour to provide information on the website at mcdnews.co.uk.

3.7.4  McDonald’s intends any distribution of Complimentary Digital Peel codes as described in section 3.7.3 to be to any or all of the following: (i) those who register for, or who have already opted in to, the MyMcDonald’s Rewards points scheme on their McDonald’s App-accounts (ii) consumers placing a first order for McDelivery during the relevant offer period, who have already opted in to, the MyMcDonald’s Rewards points scheme on their McDonald’s App-accounts and (iii) such other categories of persons as McDonald’s may determine from time to time.

3.7.5 Any published offer for a Complimentary Digital Peel code may be withdrawn at any time without notice or liability to anyone for loss of opportunity to benefit from the offer.

3.7.6 For the avoidance of doubt, any Property automatically loaded in to the invitee’s Monopoly Wallet in order to create the Digital Peel entry shall be a more frequently found Property and not a Rare Property.

The specific conditions attaching to each prize-type within this category are: –

4.2.1 £100k Cash Provided by McDonald’s – each “£100k” prize is for £100,000 which will be paid to the winner by bank transfer, without any right to interest and only in sterling. It is the winner’s responsibility to make the necessary arrangements to facilitate payment into a suitable licensed bank account in the UK. The Promoter’s offer to pay by bank transfer shall not prevent the Promoter from opting to make the payment by personal cheque or bankers’ draft if the Promoter determines that this is necessary or preferable. 4.2.2 MINI Electric Car Provided by McDonald’s – each “Electric Car” prize is a MINI Electric car (Level 2 LCI). Each car includes a 3-year warranty and will be supplied with a fully charged electric battery. Base model-specifications are for level 2, are pre-determined and are not variable in accordance with winners’ preferences, but colour may be selected from the selected range notified to the winner at time of order (which range is subject to availability but likely to include Moonwalk Grey and White Silver, each with cloth double stripe in carbon black). Prize includes 1st year road fund licence and pre-paid vehicle first registration fee. Each Electric Car shall be made available for collection (at the winner’s cost) at the mainland UK address which the Promoter determines as being most appropriate, having selected the same after endeavouring to take account where practicable of each winner’s address. 4.2.3 £2K Holiday with TUI – each “Holiday” prize is awarded as a voucher code to be redeemed at tui.co.uk on a TUI package holiday flying with TUI airways (which excludes flight-only and other bookings which aren’t described at tui.co.uk as being for a TUI package holiday). Bookings can be for any departure date at any package holiday location available at tui.co.uk at the time of booking but must be made before expiry of the voucher code on 14^th November 2024. All advertised holidays are subject to availability.

A valid payment card must be used to pay for any booking for which there is an excess cost due over the unspent voucher value. Any unspent balance from the voucher value following the booking using the voucher code, shall lapse and be reduced to zero without right to compensation. The first Meal Offer-period will commence on the specific day notified for each winner by the Promoter and will end on the immediately following Sunday at 23:59:59. Each of the remaining Meal Offer-periods will run consecutively immediately after the first Meal Offer-period and shall last for 1 week commencing on a Monday and ending on the immediately following Sunday at 23:59:59.

The meal choice provided by each Meal Offer, is between the following:

It is the winner’s responsibility to make the necessary arrangements to facilitate payment into a suitable licensed bank account in the UK. The Promoter’s offer to pay by bank transfer shall not prevent the Promoter from opting to make the payment by personal cheque or bankers’ draft if the Promoter determines that this is necessary or preferable. 4.3 Further Prize Details and Conditions for an Instant Win Food voucher-prize featured on a Game Piece Provided by McDonald's:

4.5 DIGITAL PEEL OUTCOMES AND PRIZES/AWARDS: –

Every valid Digital Peel entry will receive online notification of one type of Digital Peel Outcome. There are no limits to the number of Digital Peel prizes that a person can win other than those limits described at the end of section 4.1 above, being the Collective Prize Limit and any Individual Prize Limit referable to the Digital Prize-types described in this section 4.5. See section 5 for details of how to claim a Digital Peel Game prize.

The Digital Peel prize or award depends on the type of Digital Peel Outcome (described in section 3.3.3) as follows:

4.5.1  Cash Peel – creates a claim for one of the cash prize-types provided by McDonald’s and described in the table in section 4.1B above (collectively “Digital Cash prizes”) in one of the following amounts: £100, £50, £20, £10 or £5 (each a “value”), when an entry is received as described in section 3.3.3.1 above. Each cash prize (after verification) will be paid to the winner by bank transfer, without any right to interest and only in sterling.

4.5.2  Community Chest Peel – creates a claim for one of the following types of prize (collectively “Community Chest Peel prizes”) when an entry is received as described in section 3.3.3.2 above as follows:

4.5.2.1   a Digital Food voucher-prize of one of the types listed in the table in section 4.1 above ("Digital Food”) is awarded as a voucher in the winner’s Monopoly Wallet. Each voucher can only be redeemed on or before 31^st October 2023 by applying it from the “Rewards & Offers” tab of the winner’s McDonald’s App account to an order:

Please note:

(5)  Any cancellation of a qualifying purchase shall cause any applied Bonus points offer from Double Peel to become void and the associated points to be cancelled without right of compensation.

4.5.3  Bank or Swap Peel – if any entrant playing a Digital Peel and receiving a Bank or Swap Peel then selects the Prize Draw Outcome (as described in section 3.3.3.3 above) by no later than 17^th October 2023, then an entry will automatically be made on behalf of the entrant in to the Prize Draw for a chance to win the £100k Cash prize provided by McDonald’s (which prize is as described in section 4.2.1 above). An entrant receiving multiple Bank or Swap Peels during the Promotion may opt for entry in to the Prize Draw on any or all occasions (as desired) additional chances to win the Prize Draw at the rate of once chance per entry. There is no route of entry to the Prize Draw other than via the Prize Draw Outcome.

The Prize Draw shall be held by 31^st October 2023 with the winner being determined at random via a computer programme producing a verifiably random result from all eligible entries received by the Promoter for the Prize Draw. Please see section 5.5 for the notification process for the winner and details of the prize-claim procedure.

For the avoidance of doubt the Prize Draw forms part of the Promotion and the Rules shall apply to the Prize Draw wherever the same are capable of applying (but without changing anything in sections 3.3.3.3 or 4.5.3).

4.6 Conditions applicable to all Prizes: –

The expression “prizes” when used in these Rules shall include prizes, awards, vouchers, discount vouchers, offers and passes as well as the corresponding services and/or goods available to be redeemed through the use of such prizes, vouchers, discount vouchers, offers or passes. All Prizes (including individual elements of a prize) may not be exchanged for any cash or other alternative (unless stated) and prizes and Game Pieces and their respective codes are for single use (unless stated otherwise for a specific prize-type), not transferable, divisible or permitted to be sold, resold or (unless sharing is expressly permitted) gifted.

Neither the Promoter nor any redeeming outlet of a prize shall be under any obligation to enquire whether the person submitting any Game Piece or code:

(a)  is the person entitled to make the claim, irrespective as to whether or not that person first obtained that Game Piece or code,

(b)  is otherwise eligible to claim the prize, or

(c)  has supplied accurate and true details to ensure that a prize is only claimed by and fulfilled for the benefit of the winner

and no such enquiry or omission to make enquiry shall affect the Promoter’s rights in relation to anyone in breach of the Rules, including the right to disqualify anyone who sells, gives away or discloses (or attempts to do any of these things) a Game Piece, Game Piece code, entry code, prize, prize-code or other award (such as a pass or discount voucher) or the code for a prize or other award.

By claiming a prize, the winner represents for the winner and (to the extent this is applicable because the conditions for that prize permit the winner to share it and the winner opts to do so) the winner also represents on behalf of each person with whom the winner is sharing the prize (including as a travelling companion), that (in addition to agreeing to the Rules) each agrees to the terms and conditions of the prize supplier or (in the case of more than one contractor being involved in the provision of a prize) the suppliers which relate to the prize, any element of the prize or the redemption of goods or services using the prize, provided that if any such terms and conditions conflict with the interpretation of these Rules then the Rules shall prevail.

Phone Lines: Call costs of the claims/redemption/other assistance phone-lines for the Promotion depend on the type of number called (see gov.uk/call-charges for guidance), duration of call and the access charges payable to the caller’s phone company. Phone-lines are live, not automated, so call-duration will vary and there is no minimum or maximum duration. The Promoter is not responsible for any phone-services or online marketing opportunities offered separately by prize-providers in relation to their products or services – please check with the provider for details.

Responsibility and costs of obtaining and using internet-enabled equipment and broadband or other internet services (whether for a landline or via a mobile network) needed in connection with the Promotion (including without limit for the purposes of participation, prize-claims and utilisation of prizes requiring such equipment and/or services), is solely that of participants in all cases whether or not specifically stated elsewhere in these Rules.

All advertisements depicting the prizes and prize descriptions are illustrative rather than definitive. Any advertisement of the cash value of the prize-pool represents the Promoter’s best estimate of the normal retail-price or (in the case of discount voucher-prizes) of the discount offered (based in turn on the average discount if variable) for all prizes which are available to win; it does not thereby imply that any prize will be awarded in the absence of a corresponding valid claim. Reproduction of any prize-imagery does not thereby imply any endorsement or association by the producer of that prize-type nor by the owner of any brand associated with that prize-type. The featuring of selected prizes in any advertisement does not imply all of those prizes are representative of, or all available to be won within, a prize pool for a specific Game; those prizes may be selected from more than one prize pool, unless otherwise stated.

All unawarded or unclaimed prizes will lapse if not the subject of valid claims and the award of which has been completed within the time limits as prescribed by these Rules and in any event by 31^st January 2024 at the latest (unless otherwise specifically stated). Any Rare Property which becomes invalid for any reason including (without limit) for the reasons either not awarded, or awarded but not redeemed as part of the same Property Set, means that one prize of the type corresponding to that Set will lapse.

Prizes described in section 4 stated to be provided by McDonald's are owned by the Promoter until awarded to winners. Prizes stated to be provided by a partner are owned by that partner and ownership passes from the relevant partner direct to winners and not via the Promoter.

5. HOW TO CLAIM PRIZES FOR A PROPERTY SET, AN INSTANT WIN OR A DIGITAL PEEL WIN

• Before claiming any prize for a Property Set or Instant Win or from the Digital Peel Game, please pay particular attention to the appropriate section(s) below and note that: –
• Each prize claim must be submitted in accordance with all instructions and deadlines given in this section and in the Rules generally (with the deadlines applying to the time of receipt by the Promoter) and any failure to do so will cause the prize to be forfeit and the prize-claim and corresponding Game Pieces and/or Digital Peel entries to become invalid and void, all without any right to compensation.
• It is the entrant’s responsibility to contact the Promoter in the event of non-receipt of any communication stated in these Rules – all deadlines and time limits shall continue to apply regardless of such non-receipt.
• PRIZE CLAIM GAME PIECES MUST BE KEPT SAFE AND GAME PIECE CODES AND PRIZE-CODES MUST NOT BE REVEALED TO ANY PERSON (other than the Promoter or its prize partners as part of the prize claims-process). The Promoter may require to see an entrant’s Game Piece(s) or Game Piece codes for any purpose and at any time (even after a prize-award), following which that entrant must post (at the entrant’s expense) any Game Piece(s) used in the entrant’s prize claim or as requested by the Promoter (and, in that event, it is recommended that Game Pieces be sent in an envelope by Special Delivery from a post office after ordering and paying for this service). Failure to present any Game Piece when required will result in the corresponding prize claim and all related Game Pieces becoming void, whereupon the prize award will be withheld or cancelled or, if already dispatched, must be returned at that entrant’s expense.
• Calls relating to prize claims may be recorded for the purposes of promotional security, in which event callers will be notified of this at the outset of the call.
• PLEASE DO NOT TAKE ANY GAME PIECE TO A RESTAURANT TO TRY AND REDEEM A PRIZE. UNLESS IT IS A GAME PIECE FEATURING AN INSTANT WIN FOOD PRIZE (other than a Gold Card prize), STAFF HAVE NO AUTHORITY TO REDEEM GAME PIECES FOR ANY OTHER PRIZES.

5.1 Prize claims for all Prizes (excluding claims for Food voucher-prizes referred to in section 4.3, Discount Vouchers in section 4.4 and Digital Peel prizes referred to in section 4.5.):

5.1.1 To start a prize claim for one of these types of:

5.1.1.1   Collect To Win Game prize – each claimant should follow the instructions in their Monopoly Wallet in relation to the Property Set comprising the Properties already banked there, as to how to claim the corresponding prize. Each claimant will need to complete an online form and submit the claim in accordance with the instructions by no later than 31^st October 2023. The information required by the online form includes the entrant’s date of birth (to confirm eligibility), email address, phone number and full name and UK residential postal address. The entrant may also need to select one or more options relating to the prize being claimed or how it is to be received.

5.1.1.2   Instant Win prize – Go online to the website address printed on the Instant Win Game Piece, complete the online form and submit the claim in accordance with the instructions by no later than 31^st October 2023. Each entrant will need to provide the requested information, which will include the description and Game Piece security code and/or other code(s) printed on the Instant Win Game Piece (-see section together with the entrant’s date of birth (to confirm eligibility), email address, phone number and full name and UK residential postal address. The entrant may also need to select one or more options relating to the prize being claimed or how it is to be received.

5.1.2  Declarations: – For both Collect To Win prizes and Instant Win prizes, winners will be notified if the prize-type means that the winner is required to submit a declaration and, if so, whether this is solely an Online Declaration or if the winner is required to submit an Online Declaration and a Supplemental Declaration, as follows:

An Online Declaration:

At the same time that the digital claim-form is submitted (and, for Instant Win prize claims, the Instant Win Game Piece code is entered at the website-address stated on the Game Piece), the entrant will be prompted to submit an online declaration (amongst other things) certifying that:

a) the entrant is 18 or over and is the person making the prize claim,

b) the Rules have been complied with, and

c) the entrant releases the Promoter and its associates concerned with this Promotion from responsibility or liability for all those claims, losses and damages against either arising out of the prize being claimed and which the law permits to be released. Further details of the online declaration and release are available upon request to monopoly-support@mcdonalds.co.uk

Supplemental Declaration (required for £100k, Electric Car, £1k Home entertainment, Holiday, Laptop, and £1k Cash prizes only):

After the claimant has submitted the online claim as directed above, the claimant will then be contacted by the Promoter on the phone number submitted to continue the prize claim. This will be between 09.00 and 17.30 Monday to Friday (inclusive) excluding Bank Holidays, usually within the next-but-one working day. The claimant will also receive an email from the Promoter confirming that verification of the claim is subject to successful submission of Supplemental Declaration which will be received via DocuSign®.  The claimant will need to confirm via Docusign the same information that the claimant submitted for the claimant’s online-claim, including providing a more comprehensive version of the online declaration (with details available on request to monopoly-support@mcdonalds.co.uk.

If the prize is a £100k or £1k Cash prize, a bank details form will be included in the DocuSign. Both Supplemental Declaration and bank details forms will be pre-populated and the claimant will be guided to confirm the details by signing the document.

Submission of Game Piece(s) for Specific Prizes:

The claimants of specific prizes where there are Game Pieces (£100k, Electric Car, £500 Home Entertainment, Holiday, Laptop, and £1k Cash prizes) the claimant will receive a letter from the Promoter by post, enclosing a pre-paid reply envelope for returning Instant Win Game Pieces or Property Set-Game Pieces required for the prize claim. 

Upon receipt of the pre-paid reply envelope the claimant must then post the completed forms together with the claimant’s Instant Win Game Piece or Property Set Game Pieces for verification to the Promoter to ensure receipt by the date notified in the letter. In the event that the claimant doesn’t receive the Promoter’s letter, the claimant must contact the Promoter via monopoly-support@mcdonalds.co.uk by no later than 17^th November 2023 to prevent the prize-claim becoming void and the prize being withheld.

No Game Pieces should be put in the reply envelope other than the Instant Win Game Piece matching the code submitted online for the prize claim or the Property Game Pieces banked in the Monopoly Wallet which correspond with the Property Set for which a prize is claimed and (in either case) in relation to which the Promoter sent the claimant that pre-paid reply envelope. It is up to the claimant as to whether the pre-paid special delivery reply envelope is used or if another is used (but this will be sent at the claimant’s own cost).

5.1.3   Next steps: – Once a prize claim has been received and verified, if the claim is for the following:

5.1.3.1   £500 Home Entertainment – the claimant will be sent a notification-email by McDonald’s confirming that the claim has been verified and explaining that the award process is to continue by AO sending the winner an email within 7 days of the date of McDonald’s notification-email and in the meantime that the winner needs to visit the AO website-address as notified in order for the winner to prepare a selection of items to which the winner wishes the prize-credit to be applied. The AO award-email will then instruct the winner how to respond to AO, also by email, with that selection and the date by when this must be done. AO will then contact the winner to process the selection.

5.1.3.2   Gold Card – the claimant will be sent a notification-email by McDonald’s confirming that the claim has been verified and explaining what the claimant must do by no later than 7^th November 2023 to ensure the prize can be awarded to the McDonald’s App-account registered by the claimant.

5.1.3.3   EVM Food – once the relevant Game Pieces have been banked in the winner’s Monopoly Wallet, please follow the directions stated there for redeeming this prize by no later than 31^st October 2023, as also described in section 4.2.9

5.1.3.4   Any other prize for one of the types of prize-claim in this section 5.1 – the relevant prize and/or prize notification letter setting out details of the prize or email setting out the prize code with the relevant website address to redeem it on, either will be dispatched by post or courier to the claimant’s UK/Isle of Man/Channel Islands address (provided upon verification) or will be emailed to the address submitted by the claimant with the claim (or, if cash and the Promoter is prepared to transmit by bank transfer, transferred to the claimant’s bank account), in any event within 30 days of verification. The same letter or email will also include supplemental instructions should any be needed as to how, for example, to redeem a prize code and by when, to collect a prize requiring collection or to register an account/credit or debit card on the relevant website (should this be applicable).

5.2 To redeem all Food voucher-prizes referenced in section 4.3 above (which exclude Gold Card, EVM Food and Digital Food prizes): In order to redeem these Food voucher-prizes, the entrant will need to follow the instructions stated on the winning Game Piece or within the on-screen award-notification in the Monopoly Wallet (and confirmed by email to the registered address of the entrant) by no later than  31^st October 2023.

5.3 To redeem discount voucher-prizes featured on Instant Win Game Pieces and in McDonald’s App-award notifications for Digital Peel  : –

In order to redeem each discount voucher-prize, the entrant will need to follow the instructions on the winning Game Piece or in McDonald’s App by no later than the validity date stated and (if the winner desires to apply the voucher-prize to an order placed via the winner’s McDonald’s App) by following the directions in section 4.3. If applicable, the entrant will need to select the desired and permitted purchase and proceed to the checkout. Entrants will then be required to follow the instructions and provide the information as directed by the Game Piece and website in order to complete the transaction (including entering the notified prize code and, if applicable, details of a permitted debit or credit card or other payment method).

5.4 To redeem Digital Peel prizes for Cash Peel and Community Chest Peel: –

5.4.1  Digital Cash prizes: – Each winner will be served with immediate on-screen notification within the winner’s Monopoly Wallet of the cash-value of the prize to be awarded and a corresponding digital claim form requiring immediate completion and submission, as instructed. The claim form information will include identifying the restaurant name where the Property Game Piece with the security code providing the winning Digital Peel entry was obtained, providing the winner's contact details and date of birth and providing the winner’s bank account details. The winner will then receive further on-screen notification and email to notify whether the form has been received and if verification has been completed (and, if so, what fulfilment action is being taken by McDonald’s in order to send the prize within 30 days of confirmation of award).

If disconnected during the claims-process prior to notification of receipt of the claim form for any reason, please see section 5.4.4 below.

5.4.2   Digital Food voucher-prizes: – Following the successful submission and verification of a claim for the voucher-prize from the winner’s Monopoly Wallet, the relevant Food voucher-award will appear in the Rewards & Offers tab of the winner’s McDonald’s App account for the winner to choose the time of redemption by applying the voucher to an order in the manner described in the Monopoly Wallet for redeeming this prize and also as described in section 4.5.2.1 above, provided that the order is successfully placed or on or before 31^st October 2023.

5.4.3    Digital Non-Cash prizes: –

5.4.3.1   All Digital Non-Cash prizes (other than discount voucher-prizes, Rare Properties and bonus points offers from Double Peel):  Each winner will receive an online notification of award and the same information will be sent by email to the address the winner registered to play the Digital Peel Game.

(a)  If the award is a digital voucher or code for use on a prize supplier’s website and instructions for use are displayed on-screen within the winner’s Monopoly Wallet, then the code may be used immediately, or (if preferred) stored in the Monopoly Wallet or accessed via the notification email (which is sent to the winner’s registered email address in addition to the on-screen notification) provided that the code is successfully applied on the prize-supplier’s website on or before the expiry date corresponding to that prize-type as stated in section 4.4.

(b) if the award is for a prize which is to be physically delivered to the winner, after verification the Promoter will award the prize by sending within 30 days.

5.4.3.2   Discount voucher-prizes (via Digital Non-Cash): Each winner will receive the voucher-prize award in the winner’s Monopoly Wallet and will be provided with the choice either of redeeming immediately or saving in the Monopoly Wallet for later. To use the voucher-prize, the winner needs to apply it to an order on or before 31^st October 2023 in the manner described in the Monopoly Wallet for redeeming this prize and also as described in section 4.5.2.1 above.  

5.4.3.3   Rare Properties: See section 4.5.2.3 for details.

5.4.3.4   Rewards Points Offers (via Digital Non-Cash): See section 4.5.2.4 for details.   

5.4.4    Interrupted claims processes for prizes: For any claim in relation to one of the prize-types in this section 5.4 which requires the entrant to submit a digital claim-form via the Monopoly Wallet, the form must be received by the Promoter during the same session in which online notification of the award is transmitted to the entrant. If the entrant is disconnected before receiving on-screen confirmation that the claim form has been received by McDonald’s, then the claimant should try to find the prize-notification in either the claimed prizes-area or the unclaimed-prizes area of the History-section of the Monopoly Wallet. If not logged successfully, the entrant should complete and re-submit the form again by the deadline (including any bank details-form for a Digital Cash prize-claim). Once logged successfully, each award notification will be logged in the prizes-claimed area of the History section of the Monopoly Wallet.

Upon any further attempt to submit a claim-form, the claimant will receive an on-screen message from the Promotion servers stating that:

(i)  the award is confirmed (with the opportunity to redeem it immediately or to retain the award in that claimant’s Monopoly Wallet and claim it later before the deadline), or

(ii)  the claim is being verified with any such decision being final and binding and resulting in the entry and prize-claim becoming void and the prize withheld.

Please note: Any reason for non-award stated in the on-screen invalid-claim message shall be indicative and not definitive and will not give rise to any right of challenge of the decision not to award irrespective of whether that given reason is incorrect.

Please Note: If disconnected

(a)  during the award of a Digital Property (which should be automatically banked in the Property Wallet and gameboard within the entrant’s Monopoly Wallet without the entrant needing to do anything), or 

(b)  whilst the entrant is attempting to bank a Property featured on a Game Piece

and the entrant is unsure whether the Property has been successfully banked in the Property wallet of the entrant’s Monopoly Wallet, the entrant should check both the Property wallet and the gameboard to see if the Property was banked successfully. Should you still not see the Property, please contact monopoly-support@mcdonalds.co.uk.

5.5  Prize Draw – The Promoter shall notify the Prize Draw winner by email (using the email-address with which the winner registered the winner’s McDonald’s App account) by 27^th October 2023. The winner will have 14 days therefrom to accept the prize in the manner stated in the Promoter’s email, failing which the prize claim shall be invalid and the entry shall become void without right of compensation and the Promoter may (but shall not be required to) select another winner either from reserves in the order drawn or (if no reserves) at random from all remaining entries yet to be drawn. Each prize will be awarded only on verification by McDonald’s that the winner has complied with the Rules, whereupon the prize will be delivered to the winner in the manner as notified within 30 days of receipt of the winner’s acceptance of the prize in accordance with the Promoter’s instructions. 

6. RESPONSIBILITY

To the fullest extent permitted by applicable law (but not otherwise) the Promoter and its agents assume no responsibility and are not liable for: (a) the accuracy or otherwise of the prize description or illustration, (b) the non-availability, loss, interception or interference with, late or non-receipt, corruption or damage of or to any entry, prize claim, Game Pieces Label, Game Piece, discount voucher-prize, voucher-prize, voucher, code, prize or notification or other communication, (c) (other than those warranties or conditions implied by statute and which cannot be excluded by the Promoter) any representation, warranty, condition or guarantee in respect of a prize, (d) any taxes, fees, charges or other costs which winners may be required to pay at any time in connection with a prize, (save to the extent that the Promoter has expressly and specifically accepted responsibility in these Rules for the same), (e) any actual or perceived loss or reduction of opportunity or any actual or perceived damage arising at any time in connection in either case with the termination, cancellation, suspension, postponement or alteration of or to the Promotion (or to any part, game, feature or other element of the Promotion or the manner in which it is to be conducted) and which termination, cancellation, suspension, postponement or alteration is due to supervening circumstances beyond the Promoter’s control or (f) for any actual or perceived loss of opportunity or damage arising in connection with any omission or in reviewing and acting upon information in the Rules or announcement posted on the news page of the McDonald’s App or website at mcdnews.co.uk in the lead up to, during the course of or after the Promotion.

7. THE PROMOTER’S RIGHTS

The Promoter may (a) extend any time limit, exercise a right of discretion or waive any of the Rules where a person might otherwise have been disqualified or otherwise disadvantaged (without obliging the Promoter to extend any time limit, exercise a right of discretion or waive any Rule on any further occasion for that entrant or at all for any other person), (b) terminate, suspend, cancel, postpone or vary the Promotion (or any part, feature or element of the Promotion including, without limit, any entry-method, game, prize or prize-pool,) at any time due to supervening circumstances beyond the Promoter’s control including (without limit) those which the Promoter determines have or are likely to compromise the security or credibility of the Promotion (or the affected part, feature or element of it), and (c) substitute a product deemed to be an appropriate replacement and of equal or greater value in the place of any of the prizes (or any part of a prize). The Promoter’s decision in the exercise or interpretation of any of its rights or discretions in connection with these Rules shall be final and binding and reference to the discretion of the Promoter shall mean its sole discretion.

Please note: selected partners of the Promoter (depending upon the nature of the prize and whether in addition to or in place of an entrant providing personal data to the Promoter) may require entrants to provide to those partners personal-data in connection with claiming/redeeming prizes and (for prizes which are vouchers) any products or services of partners which are to be redeemed using voucher-prizes, so entrants should satisfy themselves with the privacy policies of such partners, as the Promoter cannot accept any responsibility for them.

An anonymised list of winners of the prizes which the Promoter considers (in its discretion) to be major in the context of the prize-pool as a whole, will be posted at mcdnews.co.uk between 1^st December 2023 and 31^st January 2024.

Should the Promoter invite any winner of a prize-type to be redeemed under section 5.1 above to participate in publicity, it shall not imply any obligation on the Promoter to extend the same or similar invitation to any other winner, nor to proceed with any publicity offered to the invitee.

9. GENERAL

9.1  The acceptance of a Game Pieces label in a restaurant and the peeling off of any panel covering a Game Piece or its removal from the themed promotional-packaging (which shall be deemed to have taken place in the restaurant) or the application by post for a Game Piece, amounts to acceptance of the Rules and to their respective interpretation under English law and by the English courts and of the terms of the following licence:

You understand and accept that (a) the Promoter retains ownership of all Game Pieces, and ownership or control of the trade marks and other intellectual property in and over the Game Pieces, and all Promotion-advertising at all times (“the Promoter's Property”), (b) the Promoter grants you a licence to use the Promoter's Property solely for the purposes of the proper participation in the Promotion in accordance with the Rules, (c) none of the following shall be considered proper participation in the Scheme, namely; any sale, offer to sell, giving away or other dealing with any Game Piece, Game Piece-code, voucher or prize code or pass, any use for any purpose whatsoever of any Promotion advertising or any feature taken from it or anything which is a breach by you of the Rules, (d) you may not assign this licence or any benefit under it, (e) any use of the Promoter's Property for a purpose not stated to be permitted or any failure otherwise to observe any provision of this licence shall result in automatic termination of the licence without requirement as to notice and amount to an irremediable infringement of the Promoter’s intellectual property entitling the Promoter to all rights and remedies available by law, and (f) following termination or expiry of this licence you will return all Game Pieces to the Promoter without attempting to redeem the same and shall cease to use the Property for any purpose whatsoever.

9.2  All age limits shall be deemed to be actual age as at the time of acceptance of the Rules, unless expressly stated otherwise in these Rules.

9.3  The Promoter and/or the Partner may carry out such background checks and require such information (in addition to the information required to be given on entries or prize claims) as they consider necessary or desirable for the purposes of verifying any entry or claim for a prize or award or an entrant’s/claimant’s compliance generally with the Rules and any prize or award may be withheld unless and until the Promoter and the Partner is satisfied with the verification.

9.4  Reference to any Game Piece or code printed on a Game Piece being or becoming invalid or void shall mean that the Game Piece and all codes printed on it (as applicable), together with all prize claims made and rights to make any prize claim arising in connection with such Game Piece or any code printed on it, shall be or become invalid and void.

9.5  Any communication which an entrant is required to send by post under these Rules must be sent via the Royal Mail alone and, if a "stamped" envelope is required, franking is not acceptable. The Promoter is entitled to treat any communication, however sent, as not received if not sent in the manner directed by the Rules, such as ( without limit) a mailed communication that isn’t properly stamped.

9.6  No claim under or participation in this Promotion or any Game Piece or Game Piece-code or prize code, is valid in combination with any other offer or promotion, save to the extent expressly stated herein.

9.7  Any Game Piece,  Game Piece code, Digital Peel entry and other voucher/prize code, entry, prize claim and/or communication (including any marketing material or communication) made or received by the Promoter or an agent, will be invalid and void for all purposes if it is deemed by the Promoter or by any other prize supplier involved with prize-redemption to be (a) damaged, (b) counterfeit, (c) copied, (d) misprinted (except that a date described as superseded in section 2.2 above shall not be deemed by the Promoter to have been ‘misprinted’ for this purpose), (e) incomplete, (f) illegible, (g) reproduced/transmitted incorrectly, (h) the result of a technical malfunction or (i) handled, used, disclosed, offered for sale by an ineligible person.

9.8  An entrant’s sole remedy for a void Game Piece, Game Piece code or Digital Peel entry through the fault of the Promoter or its agents, will (conditional upon the same still being valid and available) a replacement Game Piece, Game Piece code or Digital Peel entry (as appropriate).

9.9  Should the Promoter determine (in the Promoter’s discretion) based on the evidence in its possession at any given time that any person (a) is ineligible (b) has disclosed a Game Piece code to another person (other than the Promoter or its agents concerned with the operation of the Promotion as contemplated by these Rules), (c) has failed to comply with any of these Rules or (d) is misusing or tampering or attempting to misuse or tamper with the proper conduct of the Promotion, then in any of those events the Promoter may adjudge (in its discretion) that:

(1) every Game Piece, Game Piece code, Digital Peel entry and other voucher/prize code, entry, prize claim and/or communication made by that person to the Promoter or any of its agents, will be invalid and void for all purposes,

(2) such person shall become (with retrospective effect) ineligible to take part in this Promotion, and/or

(3) such person shall become (with retrospective effect) ineligible for every other promotion or offer of the Promoter (with the effect that every entry, claim and request by that person then in process or still to be made shall be void, invalid and have no force or effect so that the Promoter is entitled to disregard them all without incurring any liability therefor.

9.10  Reference in these Rules or any promotional advertising, material or communication to any person as a “winner” or which otherwise expresses or might imply that a prize has been won, shall not thereby imply a waiver of any verification or claims processes for the award of prizes and any related rights of the Promoter arising in accordance with these Rules to delay, withhold or invalidate any prize-awards. Any waiver of any verification or claims processes stipulated in these Rules for the award of prizes shall only be effective and binding upon the Promoter if communicated by the Promoter in writing and then only to the extent specifically stated in that communication and (whether stated or not) solely applying for the named recipient and no other person or persons.

9.11  To the extent that the Promoter publicises the Promotion on any social media platform such as Twitter, Snapchat, Instagram or Facebook (a) it shall not thereby be implied that the social media platform provider is jointly or solely sponsoring, endorsing or administering the Promotion, (b) each entrant hereby releases the social media platform-provider absolutely and unconditionally from responsibility for the Promotion, (c) each entrant understands that the entrant is alone responsible for ensuring that the content of any posting on social media and for sharing any post in other media, is done in a responsible manner and each entrant undertakes to take account before doing so of the suitability of the media and the age and other characteristics of its users for the posting, and (d) information supplied by any person via a social platform (including taking part in any poll or vote for marketing activity in support of the Promotion) is deemed to have been provided solely to the Promoter and not to the social media platform and on the prior understanding and acceptance that such information may be subject to use by the social platform-provider in accordance with its published terms of use.

9.12 The Promoter may (in its discretion) (a) decline to enter into any correspondence save as otherwise stated in these Rules, (b) alter these Rules during the Promotion to the extent it considers necessary or desirable to maintain and preserve the integrity and reputation of the Promotion or the fair, effective or secure operation of the Promotion (and altered Rules will be notified and made available for review at mcdnews.co.uk), and (c) perform any stated function in these Rules via an agent and the entrant shall be required to accept such performance as if it was directly by the Promoter.

9.13  Any person with a disability preventing compliance with any stated requirement for entrants to hand-write applications for a copy of the Rules, a list of prize winners or further details of prizes or otherwise, should contact the Promoter by means of the McDonald’s Customer Services Hotline or, if on mcdonalds.co.uk, by reference to the “contact us” feature.

9.14  Rules:

9.14.1  Nothing in these Rules shall affect the statutory rights of entrants.

9.14.2  All instructions, rules and conditions on any advertising or promotional materials (including notifications, acceptance forms and declaration forms) relating to this Promotion form part of the Rules although, in the event of conflict, the document entitled “MONOPOLY DOUBLE PEEL AT McDONALD’S 2023 UK PROMOTION – CONSUMER RULES” as posted at mcdonalds.co.uk/monopoly/rules shall prevail over all such other instructions, rules and conditions.

9.14.3  Expressions which have been defined in these Rules shall have the same meanings when used in such other instructions, rules and conditions wherever the context admits.

9.14.4   These Rules are available for customer-review on the Promotion website-page at mcdonalds.co.uk/monopoly/rules (also reached via mcdrules.co.uk) and a copy may be obtained no later than (a) 31^st December 2023 via download at mcdonalds.co.uk/monopoly/rules, or (b) 31^st December 2023 by sending by pre-paid post a signed, hand-written request specifying this requirement and addressed to MONOPOLY Double Peel at McDonald’s 2023 UK Promotion – Rules, The Marketing Store, 16 Hatfields, London SE1 8DJ which is received by this date.

9.14.5   Please note that any version of the Rules made available for customer reference at restaurants either (upon request) as a printed copy or (where present in restaurants) uploaded in digital format on to the tablets provided for customer-use is believed to be correct at the time of print or upload but please note that in the event of any differences the website version shall prevail.
