MY WINNING STORY PROMOTION - TERMS AND CONDITIONS

1. The My Winning Story promotion via the McDonald’s app (“Promotion”) starts from 00:01 on 14^th February 2022 until 23:59 on 20^th February 2022 (“Promotion Period”). It consists of the prize draws promotion (“PD Promotion”) and the discounted food offers (“Offers”) as set out below. You may not enter the PD Promotion without choosing to receive an Offer, and vice versa.

2. The Promotion is promoted by McDonald’s Restaurants Limited, 11-59 High Road, East Finchley, London, N2 8AW, UK (“McDonald’s”).

Prize Draws

3. The PD Promotion is subject to these terms. By participating in the PD Promotion, you agree to be bound by these terms.

4. Entries received after the Promotion Period shall not be entered into the draws.

5. The PD Promotion is open to entries from residents of the UK aged 18 and over.

6. The following are not eligible to participate:

6.1. employees of McDonald's, McDonald's franchisees and employees of McDonald's franchisees and their immediate families;

6.2. employees of any company responsible for redemption of prizes or for supplying prizes for the Promotion and their respective franchisees, subsidiaries, agents and advisors;

6.3. other persons assisting with this Promotion or otherwise professionally connected with the Promotion; or

6.4. any person entering via an agent or using the services of or which is an entity carrying on the business of entering (or advising on entering) prize promotions.

7. The PD Promotion prize details are as follows. All prizes will be in digital format. 

8. The winners of the One4all e-gift card prize will be provided with the e-gift card by One4all directly.

9. The PD Promotion allows for an entry into one prize draw (as selected by you) per day of the PD Promotion per person with a registered McDonald’s app (UK) account. So you may only enter one prize draw each day of the Promotion Period (with a maximum of seven entries across the overall PD Promotion). Each prize draw entry will be as selected by you via the fourth drop-down box of the prize draw entry page. To enter a prize draw each day of the PD Promotion, you must complete the mandatory fields of the entry form on the My Winning Story page of the McDonald’s app (UK) and successfully submit the form by 23:59 of that day.

10. The PD Promotion is free to enter and no purchase is necessary.

11. McDonald’s reserves the right to validate any claim and may ask for proof of identity and/or address and/or age.

12. All entries must be made directly by the person entering the PD Promotion. Entries made using methods such as a computer macro, a script or the use of automated devices or processes are not allowed and all such entries will be disqualified. McDonald’s is not responsible for changes in any entrant’s postal address or e-mail address.

13. Entries received after the end of the Promotion Period will be void.

14. The winners will be selected by 23:59 on 24 February 2022.

15. The winners for each prize draw will be selected from all valid entries at random under independent supervision or via a computer program producing a verifiably random draw.

16. There is no cash alternative and the prizes are not transferable. McDonald's may substitute a product deemed to be an appropriate replacement and of equal or greater value in the place of any of the prizes.

17. Winners will be notified via their registered email address for the McDonald’s app (UK), which will also be used for prize correspondence and delivery.

18. Please note: Each prize is subject to the terms and conditions of the issuer or supplier of the prize (“Supplier”), which will form a separate contract setting out the rights and obligations between the Supplier and the winner. Although McDonald’s is responsible for providing the One4all e-gift cards and Merlin, Red letters Day and Skullcandy voucher codes to winners, McDonald’s is not responsible or liable for any problems/issues in relation to use or redemption of the voucher codes/e-gift cards, or the good or services to which the voucher codes/e-gift cards relate (for example, McDonald’s is not responsible for the Red Letter Days experiences or Skullcandy products). These are the responsibility of the relevant Supplier. Winners should contact the customer services team of the Supplier in the event of any problems or queries. Each Supplier acts as a separate independent controller of any personal data that it processes in relation to this PD Promotion. Please review the privacy policy of the relevant Supplier if you are a prize winner.

20.2. One4all: The One4all Gift Card is issued by GVS Prepaid Limited, authorised by the Financial Conduct Authority under the Electronic Money Regulations 2011 (register ref 900230) for the issuing of electronic money. GVSP22009.

20.3. Skullcandy: Cannot be used in conjunction with any other code. Cannot be used to pay for freight or Carbon Checkout. One time use code. No change given on code. Use on Skullcandy.co.uk. Only valid till 20th May 2022. Can be used on any product on Skullcandy.co.uk.

21. McDonald’s reserves the right to review, edit, alter or remove any entry in its sole discretion, which does not comply with these terms or which it reasonably believes does not comply with these terms.

22. McDonald’s reserves the right to exclude any entries which it believes to be fraudulent or based on misconduct, or if, in its reasonable opinion, it considers that there is a significant risk that the entrant may bring the McDonald’s brand into disrepute.

23. McDonald’s reserves the right to amend, terminate or temporarily suspend the PD Promotion if, in its absolute discretion, it considers it necessary to do so. McDonald’s shall not exercise this right unreasonably.

24. No responsibility will be accepted by McDonald’s for incomplete, invalid or illegible entries and these will be declared void in the sole discretion of McDonald’s.

25. If using a computer and/or internet-access which is not owned or paid for by the entrant, the entrant is reminded to obtain the owner's permission before entering. McDonald’s will not be liable for any internet or mobile connection or other charges incurred in entering the PD Promotion.

26. To the fullest extent permitted by applicable law (but not otherwise), McDonald's and its agents and/or commercial partners (but this does not include Suppliers) assume no responsibility and are not liable for:

(i) the accuracy or otherwise of any prize description or illustration;

(ii) (where applicable) the non-availability, loss, late receipt or damage of any text, prize-claim, prize or notification or other communication and whether by reason of mobile-telephone network-operator error or other problem, failed or corrupted transmission, handset failure (including full or unserviceable inbox) or otherwise;

(iii) (other than those warranties or conditions implied by statute and which cannot be excluded) any representation, warranty, condition or guarantee in respect of a prize;

(iv) any taxes, fees, charges or other costs which winners may be required to pay in connection with a prize, (save to the extent expressly accepted by McDonald's in these terms); and

(v) (except for any loss which cannot be excluded or limited by applicable law) any loss in relation to use or redemption of the voucher code or e-gift card prizes and any loss in relation to the goods or services to which the voucher code or e-gift card prizes relate. Nothing in these terms and conditions will limit McDonald's' liability for death or personal injury caused by its negligence or for fraud, or any other liability which cannot be excluded or limited under applicable law. This does not affect entrants' statutory rights.

27. McDonald’s does not guarantee continuous uninterrupted access to the McDonald’s app (UK). Numerous factors outside the control of McDonald’s may interfere with the operation of the McDonald’s app (UK). No responsibility will be accepted for any technical or other difficulties in entering or any entries delayed or corrupted.

28. McDonald's will process all personal data in accordance with McDonald's privacy policies (https://www.mcdonalds.com/gb/en-gb/privacy-policy.html). In particular McDonald's:

(i) will not collect more of the entrant's personal information than needed for the purpose of administering and analysing this PD Promotion (including carrying out security checks as stated) and

(ii) will only use the entrant's personal information for those purposes (and such use may include transferring the entrant's personal information to McDonald's respective associates (e.g. The Marketing Store) and any third party suppliers (such as the prize suppliers) for the purpose of fulfilling the prizes. Promotion entry data will be stored for 30 days and winners data for 90 days before it is anonymised. In addition to the foregoing, McDonald's may process further information relating to entrants to the extent they separately receive communications from McDonald’s and / or have opted in receiving marketing messages (in which case personal data will be sent to McDonald's third party providers such as Armadillo for sending newsletters).

29. Any enquiries about personal information held by McDonald's, including any request for deletion of personal data, may be made by contacting Customer Services via  https://customerservices.mcdonalds.co.uk/hc/en-gb/requests/new.

30.  Subject to clauses 31 and 32, and without prejudice to McDonald's data protection obligations under relevant law, McDonald's will make available, upon receipt of a written request to McDonald’s Customer Services team at https://customerservices.mcdonalds.co.uk/hc/en-gb/requests/new, the winner(s) surname and county or such other information McDonald's deems necessary.

31.  Entrants to the Promotion shall, at or before the time of entry, have the right to object to all or some of their personal information being made available in accordance with clause 30. You can object by contacting our Customer Services team at https://customerservices.mcdonalds.co.uk/hc/en-gb/requests/new.

32. Without prejudice to clauses 31 and 32 above, McDonald's shall provide the information set out in clause 30 upon request from the UK’s Advertising Standards Authority.

33. Each Supplier acts as a separate independent controller of any personal data that it processes in relation to this PD Promotion. Please review the privacy policy of the relevant Supplier if you are a prize winner.

34. These terms shall be exclusively governed by and construed in accordance with the laws of England, and the courts of England and Wales will have exclusive jurisdiction in the event of any dispute.

35. Offers: One separate offer each day of the Promotion Period. Each daily offer will consist of one of the following, as selected by you via the second drop-down box of the prize draw entry page.

36. Eligibility: To be eligible to receive each offer, you must:

36.1. be 18 years old or over;

36.2. have downloaded, registered, and signed in via, the McDonald's app (UK); and

36.3. have selected your food offer via the daily prize draw entry form submitted via the app.

37. The daily offer each day is only valid from 00.01 to 23.59 of that day. Offers are not automatically added to your order. To redeem an offer, you must order via the ‘Offers’ section of the McDonald's app (UK) by clicking on the button describing the offer in that section, adding the offer to your order and placing your order on the McDonald’s app(UK)  at a participating McDonald's restaurant, following which the order should be collected the same day from that participating restaurant.

38. Serving times apply and breakfast hours of 5am to 11am are excluded. Offers are subject to restaurant opening hours.

39. The offers are valid on delivery orders only on the McDonald’s app (UK).

40. Each offer is one-time use per customer only and cannot be used in conjunction with any other offer or promotion. You may select the same discounted food item each day if you wish. The offers do not apply to any other McDonald's items which may be ordered for which full payment will be required. The offers cannot be used to contribute towards payment for an Extra Value Meal or to pay for an Extra Value Meal in full.

41. No cash or other alternative is available. Your usual data charges apply.

43. McDonald's will reasonably decide whether a customer has already redeemed any offer and its decision is final.
