1. ENTRANTS

Each entrant must be aged 16 or over and a IE, Isle of Man or Channel Islands’ resident to participate in the MONOPOLY Wiiiin! Promotion at McDonald’s 2018 (“Promotion”). The following are not eligible to participate: (i) Employees and immediate family members of employees of any of McDonald’s Restaurants Limited (“the Promoter”), any company responsible for redemption of prizes/vouchers or for supplying prizes for the Promotion and their respective franchisees, subsidiaries, agents and advisors, (ii) other persons assisting with this Promotion, (iii) any person not being an individual person, (iv) any syndicate or collection of persons acting in concert, (v) any person entering via an agent or using the services of or which is an entity carrying on the business of entering (or advising on entering) prize promotions and (vi) any person using any application or process to submit an entry on that person’s behalf automatically or by proxy.

2. DURATION

Participation in the Promotion is scheduled to take place from 21^st March 2018 to 1^st May 2018 (inclusive) at participating McDonald’s restaurants in the United Kingdom (including Northern Ireland but not the Republic of Ireland), Isle of Man and Channel Islands. These dates may be extended by the Promoter for some or all of the game-elements described below until all stocks of on-pack labels incorporating the Promotion-game pieces (“Game Pieces Labels”) have been issued and the deadline for prize claims (as described below) may be consequentially extended. Check for details of any changes on the McDonald’s website at mcdonalds.co.uk/monopoly/news

3. HOW TO ENTER

3.1 How To Obtain Game Pieces Labels and their Availability and the McDonald’s Fair Ordering Policy: -

3.1.1  How To Obtain A Game Pieces Label: Whilst stocks of Promotion-packaging at participating McDonald’s restaurants last, customers can obtain an on-pack Game Pieces Label on the purchase of a qualifying menu item. Carefully remove the Game Pieces Label from the packaging by peeling back where indicated.

3.1.2  Availability of Game Pieces Labels: McDonald’s has produced a total volume of Game Pieces Labels across all types of qualifying menu items which it considers reasonably likely to satisfy estimated demand for Game Pieces Labels during the Promotion. Should demand across different types of qualifying menu item prove to be inconsistent, then Game Pieces Labels can be expected to run out prior to the end of the Promotion for some types of qualifying menu item, whilst remaining undistributed at the end of the Promotion for other types of qualifying menu item. As a result, customers wishing to obtain Game Pieces Labels towards the end of the Promotion should check with a Crew Member at the customer’s selected restaurant which qualifying menu items are most likely still to be supplied with Game Pieces Labels, before placing an order. Customers can also visit mcdonalds.co.uk/monopoly/news to see any updates about which types of qualifying menu items are most likely to remain available across all restaurants collectively.

3.1.3 McDonald’s Fair Ordering Policy: This will apply over the scheduled duration of the Promotion to assist McDonald’s to prevent unfair and inconsistent or premature depletion during the scheduled period of the Promotion of stocks of Game Pieces Labels across one or more types of qualifying menu item. Steps may be taken to apply a restaurant-wide maximum limit on numbers of Game Pieces Labels per order and/or a specific restriction against any order which does not appear to restaurant managers (in their discretion) to be primarily for the purposes of consumption by the persons ordering and others in their parties. 3.2 Types of Game Pieces which can be found on Game Pieces Labels: - Each Game Pieces Label can comprise the following types of game piece (“Game Pieces”):

3.2.1 Instant Win Game Pieces – selected Game Pieces each have an instant-win message (“Instant Win”) which will match the messaging stated in the column for the Instant Win Game prizes of the Prize Pools-Table in section 4.1 below for one of the corresponding prize-types stated in that section.

3.2.2 Property Game Pieces – selected Game Pieces each feature a street or station name, a colour or train icon from one of the 9 MONOPOLY-themed property sets (“Property Sets”) and a property reference prefaced with the “M”-shaped Golden Arches logo, as identified in the Prize Pools-Table in section 4.1 below (“Property”). Each Property Game Piece can be collected for the following:

(a) Collect To Win Game, requiring the collection of a Property Set comprising the 2, 3 or 4 different Properties from the same Property Set described in the Collect To Win Game prizes and Property Sets columns of the Prize Pools-Table in section 4.1 below for the prize featured in that table which corresponds with that Property Set, and

(b) Got 10 Spares Game, requiring the collection of any 10 Property Game Pieces (including duplicates and without regard to Property Sets) for the NOW TV Pass featured for the Got 10 Spares Game in the Prize Pools-Table in section 4.1 below.

3.2.3 Online Game Pieces – each has a unique 10 character-long code (“Online Code”) which can be entered (without hyphens) with an entrant’s details by web-entry (whether by computer or mobile device with internet capability) at mcdonalds.co.uk/monopoly in any minute between 11:00:00 on 21^st March 2018 and 23:59:59 on 1^st May 2018 inclusive for a chance to win one of the Online Game prizes featured in the Online Game section of the Prize Pools-Table in section 4.1 below.

Each Game Pieces Label comprises either two Game Pieces (“Double Label”) or three Game Pieces (“Triple Label”) depending on the type of menu item purchased, as indicated in section 3.3 below. One of the Game Pieces on every Game Pieces Label will always be an Online Game Piece. The other Game Piece on any Double Label, will be from a Property Set or be an Instant Win. The other Game Pieces on any Triple Label will be from a Property Set and one may be an Instant Win Game Piece. Each Property Game Piece and Instant Win Game Piece has at least one code which will be a unique security-code having 12 characters (except Game Pieces for selected discount voucher-prizes and other selected Instant Win prizes where the unique security-code may be for 10 or 12 characters); for any Game Piece with more than one code printed on it, the unique security-code is the one printed at the very bottom of the Game Piece or vertically up the right hand side (each a “Game Piece Code”).

For every type of win, please refer to section 5 for “How to Claim”. 

3.3 Details of the types of qualifying menu item and the corresponding number of Game Pieces awarded with each: -

* not available at “limited menu restaurants” (meaning those outlets located in Asda supermarkets and others which provide a similarly limited menu).

** The Chicken Legend with Bacon-mains are only available at Asda supermarkets and The Signature Collection items are available in most but not all restaurants.

*** upon request. Purchases of Meals will qualify for the aggregate of any Game Pieces Labels corresponding to the qualifying items comprised in the Meal. For this purpose, a Salad Meal comprises a medium sized drink qualifying for a Double Label.

Please also note:

(a) In the above table and related notes, “Meal” comprises any Meal served after 10.30am (including any Extra Value Meal) when purchased with fries or a Shaker Side Salad and with a carbonated soft drink, a hot drink or drink served in a bottle or carton;

(b) Any award of Game Pieces which is not as advertised and is made at a restaurant (1) for an item which is not a qualifying item, (2) for a qualifying item but is greater than the number of Game Pieces described above as corresponding for that qualifying item, or (3) for any other reason, in each of these cases is deemed to have been made by the relevant server for that restaurant in the server’s discretion and does not give rise in the same or similar circumstances to a right to the same or other favourable treatment for any other person; and

(c) From 6th April 2018, beverages affected by the Government’s Soft Drinks Industry Levy are subject to an additional charge and, as a result, the price charged for a Meal which includes Coca-Cola Classic will incur an additional charge of 12p (Medium) or 14p (Large) in addition to the price for the Meal advertised in the restaurant.

3.4 Keeping Game Pieces and their codes safe: - For some prizes, it is mandatory to send winning Game Pieces to the Promoter or the prize-provider as part of that prize claim and, for all other prizes, the Promoter reserves the right to require the claimant to send the winning Game Piece or Game Pieces to the Promoter or the prize-provider for verification as a pre-condition to the prize claim being verified; verification can take place even after notification that an award is being, or has been, made.

Important: Please make sure Game Pieces are kept safe and undamaged and the Game Piece Code and any other code on a Game Piece are kept private without being revealed to anyone else (other than the Promoter as part of an online-entry or prize claim in accordance with these Rules). Failure to do this may result in the Promoter determining (in its discretion) that the Game Piece and its codes together with all associated prize claims are void (and the Promoter may take this action irrespective of whether or not there is any evidence to suggest that the failure has resulted or will result in a wrongful prize claim or other action).

3.5 Game Pieces From Past or non-IE MONOPOLY-Themed Promotions: - For the avoidance of doubt, any stickers, game pieces, labels produced at any time for any other McDonald’s MONOPOLY promotions in the IE or other country (and any prize claims arising out of such other promotions) shall not be valid for the purposes of this Promotion.

3.6 No Purchase Necessary for Northern Ireland Only: - If eligible and a resident in Northern Ireland (but not any other part of the IE, the Channel Islands or the Isle of Man), a person may obtain a Double Label without making any purchase by hand-writing clearly and legibly in block capitals on a piece of plain paper “Game Pieces Label” together with the person’s name and address and postcode and then signing and sending it in a properly stamped, handwritten envelope addressed to – “No Purchase Necessary Game Pieces Label Northern Ireland” MONOPOLY Wiiiin! Promotion At McDonald’s 2018, Dept 6709, P.O. Box 99, Aylesbury, Buckinghamshire HP19 8RR.

The Promoter will not process any application:

There is a limit of two applications for a Game Pieces Label per person per scheduled consecutive 7-day period of the Promotion. The receipt of a Game Pieces Label via this offer shall not entitle redemption of any prize prior to the starting time for the Promotion.

3.7 Distribution of Game Pieces Labels and Game Pieces: -

3.7.1 Distribution procedure for Game Pieces Labels for prizes in the Instant Win Game and Collect To Win Game prize pools – all Game Pieces Labels have been distributed by the Promoter on a random basis amongst participating McDonald’s restaurants and the No Purchase Necessary for Northern Ireland address, subject to the audited seeding processes applied to the Promotion. Following distribution, restaurants make every endeavour to reduce wastage of packaging to a minimum, but in the event this can’t be avoided for food safety or other reasons and promotional packaging has to be destroyed, any corresponding Game Pieces Labels attached to that packaging will also be destroyed without examination.

3.7.2 Total number of Winning Game Pieces – in respect of the Game Pieces produced for the Promotion the Promoter has made every practical effort to verify: (i) for each Property Set, that the number of Game Pieces for one of the Property names within each Property Set shall be the same as the total number of prizes advertised for that Property Set, and (ii) for each type of Instant Win, that the number of Game Pieces for that Instant Win-type shall be the same as the total number of Instant Win prizes advertised for that Instant Win prize type.

Customers should understand that the award of all of the advertised prizes for the Property Sets depends (amongst other things) upon the same person collecting each Property from the same Property Set.

3.7.3 Distribution of Game Pieces/Winning Chances for the Instant Win Game, Collect To Win/Got 10 Spares Games and Online Game – in the interests of ensuring a more balanced and fair distribution of prizes amongst entrants:

3.8 Complimentary Online Codes: - McDonald’s may (in its discretion) issue a number of complimentary Online Codes (up to a maximum which the Promoter has pre-determined prior to the start of the Promotion) to persons who at the start of or during the Promotion are opted-in to one or more marketing databases maintained by McDonald's. Each complimentary Online Code will be awarded digitally.

4. PRIZE-DESCRIPTIONS AND CONDITIONS

4.1 Prize Pools-Table for the Instant Win, Collect To Win, Online Game and Got 10 Spares Game: -

The specific conditions attaching to each prize-type within this category are:

4.2.1 £100k Cash Provided by McDonald’s – each “£100k” prize is for £100,000 which will be paid to the winner by bank transfer or by personal cheque if appropriate (in McDonald’s discretion), without any right to interest and only in sterling. It is the winner’s responsibility to make the necessary arrangements to facilitate payment into a suitable licensed bank account in the IE. The Promoter’s offer to pay by bank transfer shall not prevent the Promoter from opting to make the payment by personal cheque if the Promoter determines that this is necessary or preferable. The winner agrees that payment of the prize by bank transfer shall be at the winner’s risk to the extent that the transfer is not received in the winner’s nominated account due to bank error or any other reason that is not directly due to the Promoter. If the winner is under 18, the winner’s parent or legal guardian must claim on the winner’s behalf.

4.2.2 Mini Cooper choice of 3 door or convertible models Provided by McDonald’s – each “Car” prize is a choice for the winner of a MINI Cooper 3-door Hatch 1.5 model or a MINI Cooper Convertible 1.5 model. Each is registered with 12 months’ road fund licence, a three-year warranty and a tank part-filled with approx. 10 litres of fuel. Base model-specifications are pre-determined and not variable in accordance with winners’ preferences, but colour may be selected from the selected range notified to the winner. Each Car shall be made available for collection (at the winner’s cost) at the mainland IE address which the Promoter determines as being most appropriate, having selected the same after endeavouring to take account where practicable of each winner’s address. Vehicle first-registration fee is pre-paid.

If the winner is under 18, the winner’s parent or legal guardian must claim on the winner’s behalf.

It is the winner’s responsibility to ensure that the winner, or a companion selected by the winner to drive the vehicle, has a valid driver’s licence and insurance and can present evidence of this at the collection point.

4.2.3 Universal Orlando Resort™ Trip for 4 Provided by Universal Orlando Resort – each Universal Orlando “Holiday” prize is awarded as a 6 day, 5 night trip for the winner and up to 3 nominated companions to Universal Orlando Resort™ in Orlando, Florida, USA taking the trip on the same itinerary as a single group and is provided by Universal City Development Partners, Ltd (trading as Universal Orlando Resort). If a winner is under 18, the winner’s parent or legal guardian must (i) claim the prize on the winner’s behalf (ii) be the first-named party on the booking and (iii) travel with the winner. Winners may give notice of cancellation at any time during the 12 months’ subscription period and it will be effective from the end of the 12 months’ subscription period. Booking can’t be changed except in the provider’s discretion (and any change is likely to be subject to charges).

4.5.1      The Online Game will take place at mcdonalds.co.uk/monopoly during the period between 11:00:00 on 21^st March 2018 and ending at 23:59:59 on 1^st May 2018 inclusive.

To make a “valid Online Game entry”, an eligible entrant must enter a valid Online Code as part of a valid submission via the online form at mcdonalds.co.uk/monopoly and it must be recorded as received by the Promotion servers, all during the period for the Online Game and always subject to the daily limit of 24 entries per entrant per calendar day (i.e. each 24 hour period starting from midnight or, for 21^st March 2018 only, from 11.00.00).

A “valid Online Code” is the unique, 10 character-long code which has not previously been submitted for the Online Game and which is (i) to be found on each Online Game, Game Piece, or (ii) provided on a complimentary basis by McDonald’s for the reasons stated in section 3.8 of the Rules.

A “valid submission” can only be made by a person (one valid Online Code at a time) via mcdonalds.co.uk/monopoly by using a computer, mobile phone or other browsing platform enabling access via the internet and by entering the required information including a valid email address for that entrant. It is the entrant’s responsibility to obtain permission from the person who owns or pays for the equipment and internet-service, before entering. Costs of accessing the internet by mobile phone depend on the owner’s price plan – please find out before entering. Entrants must follow the instructions on mcdonalds.co.uk/monopoly for submitting an Online Code and for submitting the required information.

An entrant’s “valid email address” (i) must be the entrant’s personal email account or one under that entrant’s control, (ii) remain the same for all of the entrant’s entries and (iii) must not have been used by anyone else to enter the Online Game, failing any of which the entry will become void and that person may be adjudged by the Promoter to be ineligible for the Online Game or this Promotion (within the Promoter’s discretion). PLEASE MAKE SURE THE CORRECT EMAIL ADDRESS IS ENTERED AS ERRORS CANNOT BE RECTIFIED LATER.

4.5.2      A valid Online Game entry will win a prize from the Online Game prize-pool if it is recorded as received by the Promotion servers at one of the “winning moments”, each of which is a random single moment taking place within any minute during the Online Game period which moment has been randomly selected in advance of the Promotion for this purpose under the Promoter’s audited procedures.

If more than one valid entry is received during the same winning moment in any minute, then the first entry to be received during that winning moment will automatically be determined by the Promotion servers and will be the sole winner of the Online Game prize allocated to that winning moment.

 

(a) “Online Cash” Prizes Provided by McDonald’s –cash prizes provided by McDonald’s which are available to be won in the Online Game, are for £100, £50, £20, £10 and £5. Each Online Cash prize will be paid to the winner by bank transfer, without any right to interest and only in sterling, or (if winner prefers) by prepaid card charged with the value of the prize awarded for use in purchasing goods or services from sellers who accept such prepaid cards in payment and based on the winner agreeing to the terms of use for such cards at cardaccount.co.uk/Terms (which terms include that cards cannot be topped up, the balance can’t be drawn down as cash and no compensation is available if the card or value is lost or stolen). If the winner cannot, or does not wish, to make the necessary arrangements to facilitate payment into a suitable licensed bank account in the IE, the Promoter will provide a prepaid card instead. The Promoter’s offer to pay by bank transfer or prepaid card shall not prevent the Promoter from opting to make the payment by personal cheque if the Promoter determines that this is necessary or preferable. The winner agrees that payment of the prize by bank transfer shall be at the winner’s risk to the extent that the transfer is not received in the winner’s nominated account due to bank error or any other reason that is not directly due to the Promoter.

(b) 3-month Deezer Premium+ subscription voucher prizes Provided by McDonald’s – each “Deezer” voucher-prize is for a 3-month Deezer Premium+ online subscription provided by McDonald’s and awarded as an e-code. The subscription gives the usual Deezer internet streaming service for all of the music at Deezer.com, but without the ads, with high quality sound and also enabling downloading of music to listen to offline on up to 3 compatible tablets, phones or computers. For compatible devices, please see Deezer.com/devices. Registration at Deezer.com is necessary, as well as broadband or 3G (or better) access. Existing subscribers will benefit by a postponement of their existing subscription payment-requirements for the duration of the 3 months’ period provided by this e-code, after which they will automatically resume. (c) CeX voucher-prizes Provided by CeX – see section 4.2.20 for details.

(e) Digital Food voucher-prizes Provided by McDonald’s – each “Digital Food” voucher-prize is for the food prize-description from section 4.1 above identified when awarded as a digital voucher (on-screen and via email) and may only be redeemed via a Self Order Kiosk (which kiosks are located only at selected restaurants). No other method of redemption is permitted. Please also note: (i) Digital Food voucher-prizes can’t be redeemed when ordering McDonald’s food items via Uber Eats or McDonald’s Mobile Ordering app, (ii) Only ONE Digital Food voucher-prize may be redeemed per transaction, (iii) Redemption of Digital Food voucher-prizes is subject to availability of the food and to its normal serving hours, and (iv) Digital Food voucher-prizes are only valid until 15^th May 2018, not for use in conjunction with any other promotion or offer, can only be redeemed once and cannot be applied retrospectively.

119,520 Online Cash prizes are available to be won during the Online Game period at the rate of TWO Online Cash prizes per minute for 24 hours a day and for 42 days (subject to taking into account the scheduled start time on day one and the change from Greenwich Mean Time to British Summer Time).  Each Online Cash prize is available to be won by a valid Online Game entry received at a winning moment for a cash prize during the Online Game period. If any Online Cash prize is not won at the winning moment allocated for that prize, or if the award of an Online Cash prize is declared invalid for any reason, that Online Cash prize will lapse and shall not be re-awarded.

11,650 Deezer voucher-prizes, 3,750 CeX voucher-prizes, 25,000 Movie voucher-prizes and 25,000 Digital Food voucher-prizes (collectively “Online Non-cash" prizes) are available to be won during the Online Game period. Each Online Non-cash prize is available to be won by a valid Online Game entry received at one of the winning moments which have been allocated to these types of prize during the Online Game period. If any Online Non-cash prize is not won at the winning moment allocated to that prize for the reason that no valid Online Game entry is received at the corresponding winning moment, then that Online Non-cash prize will not lapse but shall be won by the valid Online Game entry which is next to be received after that winning moment. If the award of any Online Non-cash prize is declared invalid for any reason, that Online Non-cash prize will lapse and shall not be re-awarded.

There is no limit to the number of Online Game prizes a person can win. Every valid entry will receive online notification stating whether or not the entry was at a winning moment. See section 5 for details of how to claim an Online Game prize.

4.5.4       Online Game – Marketing Opt-In Prize Draw Opportunity -

(a) Any person who makes a valid Online Game entry may, provided that person is 18 or over, first tick the box on the entry page to opt-in to receive the McDonald’s marketing stated and to be entered in to a prize draw for a grand prize of £2,000, which prize draw-entry shall only become effective upon the making of the valid Online Game entry. The entrant may unsubscribe on receipt of such marketing without affecting the prize draw-entry or the Online Game entry by which the opt-in was effected.

(b) Only one entry per person is permitted.

(c) The prize will be paid to the winner by bank transfer or by personal cheque if appropriate (in McDonald’s discretion), without any right to interest and only in sterling. It is the winner’s responsibility to make the necessary arrangements to facilitate payment into a suitable licensed bank account in the IE. The Promoter’s offer to pay by bank transfer shall not prevent the Promoter from opting to make the payment by personal cheque if the Promoter determines that this is necessary or preferable. The winner agrees that payment of the prize by bank transfer shall be at the winner’s risk to the extent that the transfer is not received in the winner’s nominated account due to bank error or any other reason that is not directly due to the Promoter.

(d) The prize draw will be held within 3 working days of the closing date for valid Online Game entries from all such entries for which the opt-in described above has been ticked. The winner will be determined by a random draw via a computer programme producing a verifiably random result from all eligible entries received by the Promoter which will take place.

(e) The Promoter shall notify the winner via the entrant’s valid email address used for the Online Game within 30 days of the closing date for entry.

(f) The winner will have 7 days from the date on which Promoter sends notification to accept the prize in the manner stated in the Promoter’s email, failing which the prize claim shall be invalid and the entry shall become void whereupon the Promoter may (but shall not be required to) select another winner either from reserves in the order drawn or (if no reserves) at random from all remaining entries yet to be drawn.

(g) Prizes will be awarded only on verification by the Promoter that the winner has complied with the Rules. The prize will be delivered to the winner in the manner as notified within 14 days of receipt of the winner’s acceptance of the prize in accordance with the Promoter’s instructions.

(h) For the avoidance of doubt the prize draw forms part of the Promotion and the Rules shall apply to the prize draw wherever the same are capable of applying.

 

4.6.1 To Qualify – collect any 10 Property Game Pieces in any combination in order to enter them at mcdonalds.co.uk/monopoly and make a Got 10 Spares Game-claim for a NOW TV Pass for 10 Property Game Pieces by no later than 1^st June 2018. You do not need to enter all 10 Game Piece Codes at the same time, but you must use the same email address at all times.

You must be 18 or over to enter any Game Piece Code towards a Got 10 Spares Game-claim or (once 10 are collected) to claim a NOW TV Pass for 10 Property Game Pieces. If you are 16 or 17, you must have your parent enter all Game Piece Codes and claim the NOW TV Pass for 10 Property Game Pieces, before redeeming it at nowtv.com; please make sure only the email address of your parent/legal guardian is used to enter the Game Piece Codes and to make the claim.

Once a Game Piece Code has been entered for the purposes of saving it for a Got 10 Spares claim, that Game Piece Code shall be “locked” to that email address and must be used as one of the 10 Game Piece Codes for the next claim.

Remember – a person cannot use more than one email address.

A Game Piece Code is only valid for a Got 10 Spares Game-claim if it is from a valid Game Piece, is within the validity period at the time of submission and is otherwise valid (including, by way of one non-exhaustive example, not having been previously submitted as part of a successful Got 10 Spares claim nor been locked to anyone else).

4.6.2 Award – subject to verification and to the limit of 3 awards per person for this Game not having been exceeded, each valid claim will be awarded a voucher-code for a NOW TV Pass for 10 Property Game Pieces redeemable at nowtv.com for a choice of 1 of the following 4 types of Pass (all Passes are available at no charge for the winner for the duration stated): (i) “Sky Cinema” Pass providing 1 month’s access to Sky Cinema channels and on-demand movies, (ii) “Entertainment” Pass providing 1 month’s access to entertainment channels not on Freeview, plus catch-up TV and box-sets, (iii)  “Sports” 1 day Pass providing 24 hours’ access to all Sky Sports channels live, or (iv) “Kids” Pass providing 1 month’s access to dedicated kids channels. The winner will need an existing or new customer account with NOW TV, a valid credit/debit card, broadband/3G and a compatible device – see nowtv.com for details, including any content access-restrictions for selected devices.

The voucher-code for the Pass-type selected by each winner must be redeemed with NOW TV by 31^st December 2018.

The maximum of 3 of these NOW TV Passes for 10 Property Game Pieces which can be claimed by the same person, must also each be for a different Pass-type. Winners with an existing NOW TV subscription may still benefit from the chosen Pass-type, but if already benefitting from a different offer a winner will need to wait until that offer has expired or been cancelled before being able to redeem the voucher-code (and redemption must not be later than 31^st December 2018 to be valid).

Sky Cinema, Entertainment or Kids Passes: unless a winner has provided cancellation-notice before the end of the month provided by these Pass-types, the subscription will automatically continue thereafter and the winner's account will be charged the then current fees for that particular Pass each subsequent month until the subscription is cancelled. Please check nowtv.com for prices in force at the time of considering whether to cancel or continue with auto-renewal. Winners will be sent an email during the month of the Pass to remind them that their subscription is coming to an end and that it will automatically be extended, unless cancelled. Winners may give notice of cancellation at any time and it will be effective from the end of the month’s duration of the Pass. For the avoidance of doubt, the Sports 1 day Pass is not a subscription so it will not continue after expiry of the selected day (and won’t result in any charge as a result).

If a person wins more than one different prize-type featuring a NOW TV Pass (namely the NOW TV Smart Box plus 1 Year Pass, the NOW TV Pass Instant Win, and the NOW TV Pass for 10 Property Game Pieces) and the winner wishes to select the same category for more than one such award, the winner will only be able to redeem a Pass voucher-code at nowtv.com once any previously redeemed Pass of the same category has expired and provided such redemption can still take place before 31^st December 2018. For example, if a winner has a NOW TV Smart Box plus 1 Year Pass voucher-code for Sky Cinema together with a NOW TV Pass for 10 Property Game Pieces voucher-code also for Sky Cinema, the winner will need to redeem the NOW TV Pass for 10 Property Game Pieces voucher-code at nowtv.com first and by no later than 30^th November 2018, to enable that Pass to expire in time to redeem the NOW TV Smart Box plus 1 Year Pass voucher-code by 31^st December 2018.

A NOW TV Pass for 10 Property Game Pieces award may not be used in conjunction with any other promotion, concession, discount or offer.

4.6.3 For convenience, the Got 10 Spares Game may also be referred to in advertising for the Promotion as “10 Spares”.

4.7 Conditions applicable to all Prizes:

The expression “prizes” when used in these Rules shall include prizes, awards, vouchers, discount vouchers and passes as well as the corresponding services and/or goods available to be redeemed through the use of such prizes, vouchers, discount vouchers or passes. Prizes (including individual elements of a prize) may not be exchanged for any cash or other alternative (unless stated) and prizes and Game Pieces or their codes are not transferable, divisible or permitted to be sold or resold.

Neither the Promoter nor any redeeming outlet of a prize shall be under any obligation to enquire whether the person submitting any Game Piece or code:

(i)  is the person entitled to make the claim, irrespective as to whether or not that person first obtained that Game Piece or code,

(ii) is otherwise eligible to claim the prize, or

(iii) has supplied accurate and true details to ensure that a prize is only claimed by and fulfilled for the benefit of the winner

and no such enquiry or omission to make enquiry shall affect the Promoter’s rights in relation to anyone in breach of the Rules, including the right to disqualify anyone who sells, gives away or discloses (or attempts to do any of these things) a Game Piece, Game Piece Code, Online Code, prize or other award (such as a pass or discount voucher) or the code for a prize or other award.

By claiming a prize the winner represents for the winner and, if relevant, his or her companion(s) sharing the prize, that (in addition to agreeing to the Rules) each agrees to the terms and conditions relating to the prize, any element of the prize or the redemption of goods or services using the prize of the prize supplier or, in the case of more than one contractor being involved in the provision of a prize, the suppliers, provided that if any such terms and conditions conflict with the interpretation of these Rules then the latter shall prevail.

All advertisements depicting the prizes and prize descriptions are illustrative rather than definitive. Any advertisement of the cash value of the prize-pool represents the Promoter’s best estimate of the normal retail-price or (in the case of discount voucher-prizes) of the discount offered (based in turn on the average discount if variable) for all prizes which are available to win; it does not thereby imply that any prize will be awarded in the absence of a corresponding valid claim. Reproduction of any prize-imagery does not thereby imply any endorsement or association by the producer of that prize-type nor by the owner of any brand associated with that prize-type. The featuring of selected prizes in any advertisement does not imply all of those prizes are representative of, or all available to be won within, a prize pool for a specific Game; those prizes may be selected from more than one prize pool, unless otherwise stated.

All unawarded or unclaimed prizes will lapse if not the subject of valid claims and the award of which has been completed within the time limits as prescribed by these Rules and in any event by 31^st December 2018 at the latest (unless otherwise specifically stated).

Prizes described in section 4 stated to be provided by McDonald's are owned by the Promoter until awarded to winners. Prizes stated to be provided by a partner are owned by that partner and ownership passes from the relevant partner direct to winners and not via the Promoter.

 

Before claiming any prize for a Property Set or Instant Win, or from the Online Game or Got 10 Spares Game, please pay particular attention to the appropriate section(s) below and note that:

5.1 Prize claims (excluding claims for food voucher-prizes of any type, discount voucher-prizes, Online Game prizes and the Got 10 Spares Game prizes): - DO NOT take winning Game Piece(s) to a McDonald’s restaurant; staff and managers have no authority to verify any of these prize claims.

5.1.1      To start a prize claim: - Go online to the website address printed on the winning Game Piece, complete the online form and submit the claim in accordance with the instructions by no later than 1^st June 2018. Each entrant will need to provide the requested information, which will include the description and Game Piece Code(s) printed on the Instant Win Game Piece or on each Game Piece within the Property Set, together with the entrant’s date of birth (to confirm eligibility), email address, phone number and full name and IE residential postal address. The entrant will also need to select one or more options relating to the prize being claimed or how it is to be received.

5.1.2      Declarations required for these types of Property Set and Instant Win Prizes: -

(a) Online Declarations: - At the same time that the Game Piece Code(s) are entered at the website-address stated on the Game Piece, the entrant will be prompted to submit an online declaration (amongst other things) certifying that:

(i) (if for a prize requiring the parent or legal guardian of a winner aged 16 or 17 to claim on the entrant’s behalf), the entrant is 18 or over and is the person making the prize claim, or the entrant is aged 16 or 17 or over and the person making the prize claim is the parent or legal guardian of that entrant,

(ii) the Rules have been complied with and the claimant understands that the Rules require the claimant (and, if different, the entrant) to agree to the publicity described in these Rules, and

(iii) (on behalf of the claimant and, if different, the entrant), the claimant releases the Promoter and its associates concerned with this Promotion from responsibility or liability for all those claims, losses and damages against either arising out of the prize being claimed and which the law permits to be released. Further details of the online declaration and release are available upon request to query@mcdmonopoly.co.uk.

(b) Printed Supplemental Declarations and Submission of Game Piece(s) required for £100k, £25k, Car, Holiday and City Break prizes (only): - After the claimant has finished the stage of entering the Game Piece Code(s) online, the claimant will then be contacted by the Promoter on the phone number submitted to continue the prize claim. This will be between 09.00 and 17.30 Monday to Friday (inclusive) excluding Bank Holidays, usually within the next-but-one working day. The claimant will need to confirm in writing the same information that the claimant submitted for the claimant’s online-claim, including providing a more comprehensive, written version of the online declaration. Further details of the printed declaration and release are available upon request to query@mcdmonopoly.co.uk.

Upon receipt of the pre-paid reply envelope, a declaration form (and in the case of the £100k and £25k prizes) a bank-details form, the claimant must then post the completed forms together with the claimant’s Instant Win Game Piece or Property Set Game Pieces for verification to the Promoter to ensure receipt by 15^th June 2018 or such other date as the claimant has been notified in the letter. No Game Pieces should be put in the reply envelope other than the Game Piece or Game Pieces with the Game Piece Code(s) entered online and in relation to which the Promoter sent the claimant that pre-paid reply envelope. It is up to the claimant as to whether the pre-paid reply envelope is used or if another is used (but this will be sent at the claimant’s own cost). It is also up to the claimant whether or not the claimant visits a post office and uses a Special Delivery service, although it is highly recommended as the Promoter cannot be responsible for any loss or delay in the post. Irrespective of the claimant’s choice of envelope, all Game Pieces required for the prize claim, the declaration form and (for a £100k or £25k prize) the bank-details form, must all be included within the same envelope.

5.1.3      Next steps: - Once a prize claim has been received and verified, if the claim is for:

(a) A Car - the claimant will be contacted on behalf of the Promoter by phone to agree the choice of model and other details and to arrange for delivery of the Car and registration forms to a collection point with BMW or one of their respective dealers (which the Promoter will endeavour to select based on the location being relatively convenient for the claimant). The claimant or, if not the person who is to collect and drive the vehicle after its award, the person collecting it, must prove that he or she holds a valid IE driving licence (which is full and not just provisional), has obtained appropriate insurance cover for the vehicle and has a letter of authorisation for the collection from the claimant, before the vehicle may be taken away from the collection point.

(b) A Hotel Break - the email confirming verification, which we send the claimant, will also notify the claimant of the Best Western Central Reservations booking line phone number which the claimant must ring and the date by which it must be done, as well as the Best Western booking number which will need to be quoted. Failure to make contact as described to confirm the allocated break, will cause the prize claim to lapse and the related Game Piece(s) to become void. The claimant must do everything else necessary to complete the booking arrangements by no later than 30^th September 2018, failing which the prize claim will lapse and the related Game Piece(s) become void.

(c) Cinema Tickets - the prize notification email will set out details of the claimant’s prize code with the relevant website address where the claimant will be required to enter the prize code and select a participating cinema in order to be sent by email two eCodes each for one ticket (if for a Cineworld venue) or by post within 3 working days two printed vouchers each for one ticket (if for an independent venue). Winners booking with Cineworld have the choice of booking at the venue or via Cineworld.co.uk (subject to the prevailing booking charge at that time). The deadline for using all eCodes and printed vouchers is 31^st August 2018.

(d) Any other prize for one of these types of prize claim - the relevant prize and/or prize notification letter setting out details of the prize or email setting out the prize code with the relevant website address to redeem it on, either will be dispatched by post or courier to the claimant’s IE/Isle of Man/Channel Islands address (provided upon verification) or will be emailed to the address submitted by the claimant with the claim (or, if cash and the Promoter is prepared to transmit by bank transfer, transferred to the claimant’s bank account), in any event within 30 days of verification. The same letter or email will also include supplemental instructions should any be needed as to how to, for example, redeem a prize code and by when or register an account/credit or debit card on the relevant website (should this be applicable).

 

Take the Game Piece or Game Pieces (if for an EVM Food voucher-prize) to a McDonald’s restaurant on or before 15^th May 2018.

Game Pieces for a Food voucher-prize may only be redeemed at restaurants, including at restaurant-counters, Drive-Thrus or Self Order Kiosks; Game Pieces for a Food voucher-prize can’t be redeemed by any other means, including the Mobile Ordering APP or Uber Eats. Please submit your Game Piece to the Crew Member before placing your order, unless using a Self Order Kiosk, when you should follow the on-screen directions for entering the 12 character-long Game Piece Code from your Game Piece (or from each Game Piece for an EVM Food voucher-prize) before then submitting the voucher to a Crew Member upon receipt of your order. The Crew Member will retain each Game Piece.

Please see section 5.4 below for how to redeem Digital Food voucher-prizes.

5.3 To redeem discount voucher-prizes: -

In each case, in order to complete the transaction, a claimant will need the relevant discount voucher-prize Game Piece and a valid debit or credit card (or other payment facility, to the extent permitted).

5.4 To redeem Online Game prizes (including Digital Food voucher-prizes): -

5.4.1      Provided an Online Code is submitted by 23:59:59 on 1^st May 2018 inclusive immediate online notification of the type of prize will be received if the entry is a winning one.

5.4.2       For:

A winner aged 18 or over must then submit the form, but if aged 16 or 17, the winner must first also provide the email address of the winner’s parent or legal guardian (and only after first getting the permission of the parent or legal guardian to provide the email address and to make the claim in the winner’s place), before submitting the claim form. The parent or legal guardian will then be sent an email with a link to a supplemental, online, claim form which must then be completed by the deadline stated in that email. Subject to verification, the Promoter will send within 30 days an email to the claimant’s email address which contains the prize e-code together with instructions for redeeming the prize.

Please note: the claim form for any of the above prize-types must be submitted and received during the same session in which online notification of a prize and claim form was received. If disconnected before successfully submitting the claim form for any reason, then it may still be possible successfully to submit a claim provided that the claim form can be retrieved (having revisited the website and re-entered the same Online Code and email address used for entry) by no later than 23:59:59 on 1^st May 2018 and further provided that the claim form is then completed and submitted as instructed during the same session. But if disconnected for any reason after that deadline (including a disconnection by the Online Game system through the connection being idle for a period of time), then the prize claim will become invalid.

5.4.3          Digital Food voucher-prizes: Subject to verification the Promoter will send within 30 days an email to the winner’s email address confirming the prize e-code and type of Digital Food voucher-prize which it represents, together with instructions for redeeming it at a Self Order Kiosk. The winner may (at McDonald’s discretion) first receive on-screen notification of the prize e-code to enable immediate redemption without waiting until receipt of the email, but please note that this is for the winner’s convenience and only the e-code as notified online or in the email may be redeemed, not both. Please note: All Digital Food voucher-prize e-codes must be redeemed via Self Order Kiosks, so please find one of the selected restaurants which have these kiosks and then follow the on-screen instructions for redeeming digital vouchers. Digital vouchers may still be required to be shown to a Crew Member, both before and after placing an order.

5.4.4       KEEP ONLINE GAME PIECE SAFE, EVEN AFTER ENTERING AN ONLINE CODE – EACH ENTRANT MUST PRODUCE THE GAME PIECE WITH THE RIGHT ONLINE CODE, IF THE PROMOTER REQUIRES THIS IN ORDER TO VERIFY A PRIZE CLAIM.

5.5 To redeem Got 10 Spares for a NOW TV Pass for 10 Property Game Pieces: - 

5.5.1      An entrant aged 18 or over, or that entrant’s parent or legal guardian if the entrant is aged 16 or 17, may on one or more visits enter the 12 character Game Piece Code from each of 10 Property Game Pieces (provided that each Game Piece Code is valid according to section 4.6.1 above), together with the other information as requested, into the online form at mcdonalds.co.uk/monopoly and submit the same on or before 1^st June 2018 in order to claim 1 of the 4 types of NOW TV Pass for 10 Property Game Pieces described in the prize table at section 4.1 above (which is not a type for which that entrant has previously submitted a Got 10 Spares claim or had a parent or legal guardian do so and provided no more than 3 such claims are submitted in total).

5.5.2      The NOW TV Pass for 10 Property Game Pieces will be sent within 30 days to the same email address used to submit the claim. The winner may (at McDonald’s discretion) first receive on-screen notification of the NOW TV Pass for 10 Property Game Pieces to enable immediate redemption without waiting until receipt of the email. Entrants should keep their Property Game Pieces safe, so that they are available to use in the Collect To Win game if needed (or in case the Promoter wishes to carry out further verification).

 

To the fullest extent permitted by applicable law (but not otherwise) the Promoter and its agents assume no responsibility and are not liable for: (i) the accuracy or otherwise of the prize description or illustration, (ii) the non-availability, loss, interception or interference with, late or non-receipt, corruption or damage of or to any entry, prize claim, Game Pieces Label, Game Piece, discount voucher-prize, voucher-prize, voucher, code, prize or notification or other communication, (iii) (other than those warranties or conditions implied by statute and which cannot be excluded by the Promoter) any representation, warranty, condition or guarantee in respect of a prize, (iv) any taxes, fees, charges or other costs which winners may be required to pay at any time in connection with a prize, (save to the extent that the Promoter has expressly and specifically accepted responsibility in these Rules for the same), or (v) any actual or perceived loss of opportunity or damage arising in connection with the termination or suspension of the Promotion (or any part, feature or element of the Promotion) at any time and which suspension or termination is due to supervening circumstances beyond the Promoter’s control (although the Promoter will still honour any valid claims received prior to the termination or suspension).

For any prize which must be claimed by the winner’s parent/legal guardian, the Promoter will not be obliged to award it to anyone other than that parent/legal guardian, if the winner is under 18. The Promoter may also withhold that award should the Promoter determine in its discretion that a dispute may have arisen as between the winner and the parent/legal guardian in relation to the prize.

7. THE PROMOTER’S RIGHTS

The Promoter may (i) extend any time limit, exercise a right of discretion or waive any of the Rules where a person might otherwise have been disqualified or otherwise disadvantaged (without obliging the Promoter to extend any time limit, exercise a right of discretion or waive any Rule on any further occasion for that entrant or at all for any other person), (ii) terminate or suspend the Promotion (or any part, feature or element of the Promotion) at any time due to supervening circumstances beyond the Promoter’s control including (without limit) those which the Promoter determines have or are likely to compromise the security or credibility of the Promotion (or the affected part, feature or element of it), and (iii) substitute a product deemed to be an appropriate replacement and of equal or greater value in the place of any of the prizes (or any part of a prize). The Promoter’s decision in the exercise or interpretation of any of its rights or discretions in connection with these Rules shall be final and binding and reference to the discretion of the Promoter shall mean its sole discretion.

Please note: selected partners of the Promoter (depending upon the nature of the prize and whether in addition to or in place of an entrant providing personal data to the Promoter) may require entrants to provide to those partners personal-data in connection with claiming/redeeming prizes and (for prizes which are vouchers) any products or services of partners which are to be redeemed using prize-vouchers, so entrants should satisfy themselves with the privacy policies of such partners, as the Promoter cannot accept any responsibility for them.

9. GENERAL

All instructions, rules and conditions on any advertising or promotional materials (including notifications, acceptance forms and declaration forms) relating to this Promotion form part of the Rules although, in the event of conflict, the provisions at mcdonalds.co.uk/monopoly/rules shall prevail over all such other instructions, rules and conditions. Expressions which have been defined in these Rules shall have the same meanings when used in such other instructions, rules and conditions wherever the context admits.

Any communication which an entrant is required to send by post under these Rules must be sent via the Royal Mail alone and, if a "stamped" envelope is required, franking is not acceptable.

No claim under or participation in this Promotion or any Game Piece is valid in combination with any other offer or promotion, save to the extent expressly stated herein.

A list of the names and counties of winners of prizes which the Promoter considers (in its discretion) to be major in the context of the prize-pool as a whole, may be obtained by sending an email to query@mcdmonopoly.co.uk or a signed hand-written request along with a stamped self-addressed envelope (SAE) to MONOPOLY Wiiiin! Promotion At McDonald’s 2018 – Prize Winners List, The Marketing Store, 16 Hatfields, London SE1 8DJ, to arrive before 31^st July 2018, following which a list will be sent by email response or within the SAE (as appropriate) within 30 days.

The Promoter and/or the Partner may carry out such background checks and require such information (in addition to the information required to be given on entries or prize claims) as they consider necessary or desirable for the purposes of verifying any entry or claim for a prize or award or an entrant’s/claimant’s compliance generally with the Rules and any prize or award may be withheld unless and until the Promoter and the Partner is satisfied with the verification.

Should the Promoter determine (in the Promoter’s discretion) based on the evidence in its possession at any given time that any person (i) is ineligible (ii) has disclosed a Game Piece code to another person (other than the Promoter or its agents concerned with the operation of the Promotion as contemplated by these Rules), (iii) has failed to comply with any of these Rules or (iv) is misusing or tampering or attempting to misuse or tamper with the proper conduct of the Promotion, then the Promoter may adjudge (in its discretion) that:

(1) every Game Piece, Online Code, Game Piece Code and other voucher/prize code, entry, prize claim and/or communication made by that person to the Promoter or any of its agents, will be invalid and void for all purposes,

(2) such person shall become (with retrospective effect) ineligible to take part in this Promotion, and/or

(3) such person shall become (with retrospective effect) ineligible for every other promotion or offer of the Promoter (with the effect that every entry, claim and request by that person then in process or still to be made shall be void, invalid and have no force or effect so that the Promoter is entitled to disregard them all without incurring any liability therefor.

Reference to any Game Piece being or becoming invalid or void shall include the Game Piece and the codes printed on it.

Reference in these Rules or any promotional advertising, material or communication to any person as a “winner” or which otherwise expresses or might imply that a prize has been won, shall not thereby imply a waiver of any verification or claims processes for the award of prizes. Any waiver of any verification or claims processes stipulated in these Rules for the award of prizes shall only be effective and binding upon the Promoter if communicated by the Promoter in writing and then only to the extent specifically stated in that communication and solely for the named recipient.

The peeling off of any panel covering a Game Piece or its removal from the themed promotional-packaging or the application by post for a Game Piece, amounts to acceptance of the Rules and to their respective interpretation under English law and by the English courts and of the terms of the following licence:

You understand and accept that (i) the Promoter retains ownership of all Game Pieces, and ownership or control of the trade marks and other intellectual property in and over the Game Pieces, and all Promotion-advertising at all times (“the Promoter's Property”), (ii) the Promoter grants you a licence to use the Promoter's Property solely for the purposes of the proper participation in the Promotion in accordance with the Rules, (iii) none of the following shall be considered proper participation in the Scheme, namely; any sale, offer to sell, giving away or other dealing with any Game Piece, Game Piece-code, voucher or prize code or pass, any use for any purpose whatsoever of any Promotion advertising or any feature taken from it or anything which is a breach by you of the Rules, (iv) you may not assign this licence or any benefit under it, (v) any use of the Promoter's Property for a purpose not stated to be permitted or any failure otherwise to observe any provision of this licence shall result in automatic termination of the licence without requirement as to notice and amount to an irremediable infringement of the Promoter’s intellectual property entitling the Promoter to all rights and remedies available by law, and (vi) following termination or expiry of this licence you will return all Game Pieces to the Promoter without attempting to redeem the same and shall cease to use the Property for any purpose whatsoever.

All age limits shall be deemed to be actual age as at the time of acceptance of the Rules, unless expressly stated otherwise in these Rules.

Any Game Piece, Online Code, other Game Piece/voucher code, Online Game message, entry, prize claim and/or communication (including any marketing material or communication) made or received by the Promoter or an agent, will be invalid and void for all purposes if it is deemed by the Promoter or by any other prize-supplier involved with prize-redemption to be (i) damaged, (ii) counterfeit, (iii) copied, (iv) misprinted, (v) incomplete, (vi) illegible, (vii) reproduced/transmitted incorrectly, (viii) the result of a technical malfunction or (ix) handled, used, disclosed, offered for sale by an ineligible person.

An entrant’s sole remedy for a void Game Piece or Online Code will be (subject to availability) a replacement Game Piece, or Online Code (as appropriate).

Nothing in these Rules shall affect the statutory rights of entrants.

The Promoter may (in its discretion) (i) decline to enter into any correspondence save as otherwise stated in these Rules, (ii) alter these Rules during the Promotion to the extent it considers necessary or desirable to maintain and preserve the integrity and reputation of the Promotion or the fair, effective or secure operation of the Promotion (and altered Rules will be notified and made available for review at mcdonalds.co.uk/monopoly/news), and (iii) perform any stated function in these Rules via an agent and the entrant shall be required to accept such performance as if it was directly by the Promoter.
